GENERAL MSC CRUISES Terms and Conditions

All travel services featured in the Company’s brochure and/or in the Official Website are advertised for sale by MSC Cruises S.A. (“MSC Cruises”). When we confirm your Booking, you will be entering into a Contract with MSC Cruises for the supply of each travel service to you.

1.1 MSC Cruises (Australia) Pty Ltd, hereinafter referred to as the “Company”, provides a booking service for Passengers wishing to book a Holiday Package with MSC Cruises.

1.2 When making your Booking the role of the Company is limited to the Company’s Services, however, any enquiries regarding your Booking, Holiday Package, MSC Cruises’ Services, cancellations and refunds may be directed to the Company. Certain laws such as the ACL, the CGA and any applicable state-based consumer legislation (Consumer Laws) are in place for your protection.

As the Company helps you to combine and purchase Holiday Packages, the Company will have certain obligations to you under the Consumer Laws.

1.3 These Booking Terms & Conditions: (a) apply to the supply of Services listed on the Passenger’s itinerary from the date that you accept these Booking Terms & Conditions; and (b) do not alter any rights or protections granted to you under the Consumer Laws.

1.4 You accept these Booking Terms & Conditions (and applicable World Cruise terms and conditions stated on the Official Website), when you submit a Booking Request for any Holiday Package to the Company (or a Booking is made on your behalf pursuant to clause 1.5). A Contract is formed between MSC Cruises and the Passenger upon the Company or the Passenger’s Agent sending the booking confirmation to the Passenger.

1.5 If you make a Booking on behalf of a third party, you warrant that you have the authority of that third party to make the Booking on his or her behalf and that that third party has read and has the authority to accept these Booking Terms & Conditions on behalf of all the persons (including any minors) named on the Booking Request submitted to the Company. You are liable for making payment of any Booking you have made irrespective of the name in which the Booking is made and related Service Fees. You must compensate the Company (as applicable) for any losses the Company or MSC Cruises suffers as a result of any conduct of that third party leading to a breach of these Booking Terms & Conditions as the third party is deemed to be a party to these Booking Terms & Conditions pursuant to this clause  1.5.

1.6 If a passenger or his/her representative (other than an Agent) books MSC Cruises Services directly with the Company, the passenger or his/her representative may deal with the Company in relation to those services as well as in relation to making amendments, requesting refunds, cancellations and any other related issues or claims.

1.7 If a passenger, or his/her representative, books MSC Cruises Services through an Agent, any amendments or enquiries on the Booking will need to be made by the Agent (unless otherwise agreed). We note that your Agent may have different cancellations, refund and other terms and conditions that may apply to you and any refunds will be issued back to the Agent (unless otherwise agreed) where applicable and in accordance with the ACL.

1.8 If an Agent makes a Booking, the Agent must provide, and warrants that it has provided, to the Passenger a copy of these Booking Terms & Conditions.

2. Interpretations and definitions

2.1 Except where the context otherwise provides or requires, the terms you or your refers to any Passenger, including any authorised representative of the relevant Passenger or related company, related party, officer or authorised person of the relevant entity, that books a Holiday Package, makes any amendments to a Holiday Package or books MSC Cruises’ Services through the Company and agrees (by conduct, notice, payment, or otherwise) to be bound by these Booking Terms & Conditions.

2.2 In these Booking Terms & Conditions the following expressions shall have the meanings defined hereunder:

“A$” means Australian dollars.

“ACL” means the Australian Consumer Law under Schedule 2 of the Consumer and Competition Act 2010 (Cth) as amended.

“Agent” means the person or travel agency that either sells or offers for sale the Holiday Packages to you on its own behalf as a principal and an organiser; or makes available the Services as an agent of MSC Cruises and the Company respectively (with the Company acting in the capacity described in these Booking Terms & Conditions).

“Booking” means the steps taken by you to book a Holiday Package.

“Booking Request” means any request to the Company to make a Booking for you which is subject to confirmation by issuance of a Confirmation Invoice.

“Booking Terms & Conditions” means these terms and conditions.

“Carrier” means any entity which has undertaken the obligation to carry the Passenger from one place to another as indicated in the Cruise ticket, airline ticket or other ticket issued for any other applicable transport and is thereby indicated on such documents as “carrier”, other than the MSC Cruises’ vessel.

“CGA” means the New Zealand Consumer Guarantees Act 1993.

“Combined Tour” means the combination of two or more Cruises prearranged by the Company and offered for sale as a single Holiday Package. For any relevant purposes, the Combined Tour shall always be considered as a single and indivisible Holiday Package. All terms and references to a Cruise and or Holiday Package shall include and be equally applicable to a Combined Tour unless otherwise stated. References to price are references to the total price paid for the Combined Tour.

“Company” means MSC Cruises (Australia) Pty Limited (ABN 55 003 526 725) of 532/5-19 Lime Street, Sydney, NSW 2000.

“Company’s Services” means the booking of Cruises, flights, accomodation and other on-shore activities at the various destinations included in a Holiday Package, ticket issuing for Cruises, liaising with Carriers to distribute tickets issued by them, and generally managing the relationship between MSC Cruises and the Passenger on behalf of MSC Cruises.

“Conditions of Carriage” means the terms and conditions under which the Carrier provides transport either by air, road or sea. The Conditions of Carriage may refer to the provisions of the law of the country of the Carrier and/or international conventions which may limit or exclude the liability of the Carrier. Copies of the Conditions of Carriage of any Carrier are available to the Passengers upon request.

“Confirmation Invoice” means the invoice issued under clause 1.4.

“Contract” means the contract concluded between the MSC Cruises and the Passenger relating to the relevant Holiday Package.

“Consumer Laws” has the meaning given in clause 1.2.

“Cruise” means the transport by sea and the stay on board a MSC vessel (as described in the relevant brochure of MSC Cruises, the Official Website or other documentation produced for or on behalf of MSC Cruises by the Company), which – if not purchased with pre- or post-Cruise services – can be considered by itself as a Holiday Package.

“Disabled Passenger” or “Passenger with Reduced Mobility” means any Passenger whose mobility when using transports is reduced as a result of any physical disability (sensory or locomotor, permanent or temporary), intellectual or psychosocial disability or impairment, or any other cause of disability or impairment or as a result of age, and whose situation needs appropriate attention and adaptation to his/her particular needs for the services made available to all Passengers, and the terms “Disabled” and “Reduced Mobility” will have the equivalent meaning.

“Flag State requirements” means the requirements under the laws in the jurisdiction in which a vessel is registered or licensed.

“Force Majeure” means any unforeseeable and unpredictable event out of the Carrier’s or the Company’s control including Acts of God (such as, flood, earthquake, storm, hurricane or other natural disasters), war, invasion, act of foreign enemies, hostilities (regardless of whether war is declared), civil war, rebellion, revolution, insurrection, military or usurped power or confiscation, terrorist activities, riots, civil disturbances, industrial disputes, natural and nuclear disasters, fire, epidemics, pandemic, health risks, nationalisation, government sanction, blockage, embargo, labour dispute, strike, lockout or interruption or failure of electricity or telephone service and/or any unforeseen technical problems with transport including changes due to rescheduling or cancellation or alteration of flights, closed or congested airports or ports.

“FTA” means the New Zealand Fair Trading Act 1986.

“Holiday Package” means the Cruise whether or not in combination with flight(s) and/or any pre- and/or post-Cruise arrangement for accommodation. It does not include Shore Excursions or shuttle services which do not form part of the inclusive Holiday Package price nor any other services.

“International Air Conventions” has the meaning given in clause 20.6.

“MSC Cruises” means MSC Cruises S.A. whose registered address is 19, Eugene Pittard, CH-1206 Geneva, Switzerland.

“MSC Cruises’ Services” means providing all Cruise services outlined in the relevant brochure of MSC Cruises, the Official Website or other documentation produced for or on behalf of MSC Cruises by the Company but not including third party services.

“NZ$” means New Zealand dollars.

“Official Website” means www.msccruises.com.au / www.msccruises.co.nz.

“Passenger” means the person named on the Confirmation Invoice issued to you by the Company (on behalf of MSC Cruises) or their successor or assign.

“Personal Information” has the meaning given to that term in the Privacy Act 1988 (Cth).

“Services” means the Company’s Services and MSC Cruises’ Services.

“Shore Excursion” means any excursion, trip or activity ashore that is not included as part of the all-inclusive price of the Holiday Package and is offered for sale by MSC Cruises on board MSC vessels.

“World Cruise” means a tour of the world prearranged by the Company and offered for sale as a single Holiday Package. For any relevant purposes, a World Cruise shall always be considered as a single and indivisible Holiday Package. All terms and references to a Cruise and or Holiday Package shall include and be equally applicable to a World Cruise unless otherwise stated. References to price are references to the total price paid for the World Cruise. 3. Booking procedure and deposit

3.1 You may make a Booking in Australia (or New Zealand) by contacting the Company or one of the Company’s authorised Agents or representatives. 3.2 By booking the Holiday Package, the person making the Booking confirms, agrees and accepts that all persons named in the Booking request and on the invoice have agreed to be bound by the Booking Terms & Conditions and that he/she has authority to accept these Booking Terms & Conditions on behalf of all the persons named on the Booking request and invoice.

3.3 Deposit: A deposit of A$200 per person per Cruise is due and payable by you to the Company within five (5) days (or earlier if advised at the time of Booking). For group/air/special packages additional deposit amounts and/or final payment is required dependent on special packages promoted and will be advised at time of booking. Children 17 and under sailing as the 3rd or 4th guest in a stateroom do not require an additional deposit.

3.4 World Cruise Deposit: a non-refundable and non-transferable deposit equal to 15% of the price of the cruise fare including hotel service charges and port charges is due and payable by the Passenger within seven (7) days to secure your cruise fare or earlier if advised at the time of booking.

3.5 A Booking will be completed and the Contract will be effective only when the Company accepts the Booking by sending a confirmation invoice to the Passenger or to the Passenger’s Agent.

4.1 Every Holiday Package is subject to availability at the time of Booking.

4.2 No Contract shall be made until the deposit or the full amount (according to the present Booking Terms & Conditions) is paid and the Confirmation Invoice provided to the Passenger.

4.3 Full payment to the Company is required no later than 90 days prior to departure, unless special payment conditions apply. For a World Cruise, full payment to the Company is required no later than 90 days prior to departure.

4.4 If the Booking Request is made within 90 days prior to departure, then full payment must be made at the time of making a Booking.

4.5 If you fail to pay the balance 90 days prior to departure, the Company has the right to cancel the Booking without notice and levy cancellation charges in accordance with clause 15 below, whether the Holiday Package is resold or not.

4.6 You must make all payments by direct credit to the bank account nominated by the Company or by credit card or as otherwise indicated by the Company in writing.

4.7 You acknowledge that you understand that selected credit cards may incur a foreign bank transaction fee in addition to the payment amount. This fee is not applied by the Company but could be applied by the card-issuing institution, depending on the type of card being used. As this is not an MSC Cruises fee, it cannot be refunded by the Company.

5. Prices and price guarantee

5.1 No change to the Holiday Package price will be made within the 20-day period before departure or once full payment has been received by the Company.

5.2 Subject to your rights at law, the Company reserves the right to modify the Contract price at all times prior to those detailed in clause 5.1 up to and including the date you make full payment of the Contract price above to allow variations for: 

(a) air transportation costs; 

(b) fuel costs for the propulsion of the vessel; 

(c) dues, taxes or fees chargeable for services such as embarkation or disembarkation fees at ports or airports; and 

(d) the exchange rates relevant to the Holiday Package. 

5.3 Variations may be upwards or downwards. For paragraph a) any variation of the Holiday Package price will be equal to the extra amount charged by the airline. For paragraph b) any variation of the Holiday Package price will be equal to 0.33% of the price of the Cruise for every dollar of increase of the fuel per barrel (NYMEX Index). For paragraph c) any variation of the Holiday Package price will be equal to the full amount of the additional dues, taxes or fees chargeable (or where a reduction in such dues, taxes or fees applies, the Holiday Package price will be adjusted accordingly to reflect the reduction in such dues, taxes or fees). 

5.4 If the increase in the Holiday Package price issued pursuant to clause 5.2 amounts to more than 8% of the total Holiday Package price at the time of Booking, subject to clause 5.4(a) to clause 5.4(c) you will be entitled to cancel the Contract with a full refund of the Holiday Package price to the extent of the amount paid by you to the Company at the time of cancellation. Such right of refund does not: 

(a) include insurance premiums paid which are in no case refundable by the Company; 

(b) apply to any voluntary amendments made to your booking; 

(c) apply to flights which are regulated by the applicable Carrier’s terms and conditions. 

5.5 Clause 15 will apply in respect of your entitlement to refunds where you cancel a Booking. 

5.6 To exercise the right to cancel, the Passenger must notify the Company in writing within 7 days of receiving the price increase notification under this clause 5.

5.7 HOTEL SERVICE CHARGE For all new bookings made from 15 January 2024, a hotel service charge will be included as an integrated part of the total Holiday Package price for Passengers over the age of 2 years old at the time of departure. Payment of the hotel service charge by the Passenger is not discretionary and, subject to the Consumer Laws, the Company will not reduce, cancel or refund the Hotel Service Charge as a separate component of the Holiday Package price. Any rights a Passenger may have under the Consumer Laws are unaffected by this change.

6. Insurance

7. passports and visas.

7.1 Passengers must hold fully valid passports for the whole duration of the Holiday Package and the expiry date must be at least 6 months after the return date.

7.2 The Company is not responsible for obtaining visas for any passenger, this is the responsibility of the individual passenger. It is the duty of the Passenger to verify that his/her passport, visas, or other documents for travel are accepted in the countries where the Holiday Package is deployed. Passengers are strongly advised to check for all legal requirements for travelling abroad and at the various ports to include the requirement of visas, immigration, customs, health and excise. Certain countries insist on machine-readable and digital photo passports, especially Russia and the USA. 

Passengers under 18 years of age (or 21 years of age for United States Passengers or Passengers embarking from a United States port) must travel accompanied by their parents or a legal guardian. If one of the travelling minor’s parents is not cruising, a signed authorisation letter, made in accordance with the laws of the country where the minor resides, from the absent parent authorising the minor to travel has to be provided at the moment of Booking. 

7.3 If the minor is travelling with Passengers that are not his parents or legal guardians, the Company shall require, at the point of booking, a document signed by the parents or legal guardian authorising the minor to travel with a chaperone or a designated individual, in accordance with Company’s policies. 

7.4 Each passenger is liable to the Company and the Carrier for, and you agree to indemnify and keep the Company and the Carrier against, all damages, losses and liabilities (including any fines or penalties imposed by any authorities) incurred by the Company or the Carrier in connection with (directly or indirectly) the Passenger’s failure to observe or comply with any local governmental laws or regulations, including requirements relating to visas, immigration, customs, health or excise.

8. Fitness to travel

8.1 When you accept these Booking Terms & Conditions, you warrant to the Company and MSC Cruises that the named Passengers on your Booking Request are fit to travel by sea (and if applicable by air) and that their conduct or condition will not impair the safety or convenience of MSC Cruises’ vessel (or any third party Carrier booked through the Company) and the other passengers on that vessel or Carrier, and that they can be carried safely in accordance with applicable safety requirements established by international, Australian or national law. 

8.2 Any Passenger with a condition that may affect his or her fitness to travel (including pregnancy), taking into account the his/her itinerary, must inform the Company or MSC Cruises (as applicable) at the time of Booking and submit a doctor’s certificate prior to making a Booking Request. 

8.3 In any case, the Company, MSC Cruises and any applicable Carriers have the right to request(at their absolute discretion) that the Passengers produce appropriate medical certificates supporting fitness to travel. Unwillingness or inability to produce medical certificates which (in the Company’s, MSC Cruises’ or any applicable Carrier’s reasonable opinion) evidence fitness to travel will be sufficient grounds for a Booking Request to be declined. 8.4 Pregnant women are requested to seek medical advice before travelling, and at any stage of their pregnancy they must obtain a medical certificate from a doctor confirming their fitness to travel on board the vessel taking into account the specific itinerary. 

8.5 MSC Cruises does not have on board any of the cruise vessels adequate medical facilities or equipment for childbirth. The Company cannot accept a Booking and MSC Cruises’ vessels cannot carry any Passenger who will be 24 weeks pregnant or more by the end of the Cruise. 

8.6 The Company and the Carrier expressly reserve the right to refuse boarding rights to any Passenger who appears to be in any advanced state of pregnancy or who does not provide the medical certificate according to clause 8.4 above and shall have no liability in respect of such refusal. In the case of a Booking made for a Passenger who was not aware at the time of Booking and could not have reasonably known at the time of Booking that she was pregnant then; the Company will offer you the choice of: 

(a) booking another Cruise for that Passenger from the Company’s brochure and/or from the Official Website of equivalent quality compliant with the abovementioned terms, if available; 

(b) cancelling and receiving a full refund of the full price paid by you for any cancellation of the Booking less the non-refundable deposit, as long as such cancellation is notified immediately by you as soon as you become aware of that Passenger’s pregnancy and it is within 120 days prior to departure. The refund will not include insurance premiums paid which are in no case refundable. Cancellation fees will apply under clause 15 if you notify us within 120 days of departure. 

8.7 The Passenger acknowledges and accepts that if it appears to the master or doctor on board the relevant MSC Cruises’ vessel that the Passenger is for any reason unfit to travel, likely to endanger safety, or likely to be refused permission to disembark at any port or likely to render MSC Cruises’ vessel liable for maintenance, support or repatriation, then:

(a) the Passenger may not be permitted by MSC Cruises’ staff to embark or disembark at any applicable port or transfer to another berth or cabin; 

(b) the doctor on board the applicable MSC Cruises’ vessel has the right to administer first aid and any drug, therapy or other medical treatment and/or to admit and/or confine the Passenger to the vessel’s hospital or other similar facility, if such measure is considered necessary by the doctor and is supported by the master’s authority; and 

(c) refusal by the Passenger to cooperate with regard to any treatment deemed necessary by the doctor on board the applicable MSC Cruises’ vessel pursuant to this clause 

8.7 may result in the Passenger being disembarked at any port, if necessary through the intervention of local police officers or other competent authorities, and neither the Company nor MSC Cruises shall be liable for any loss, expense, damages, liability or compensation to the Passenger in connection with any action taken under this clause 8.7. 

8.8 Where a Passenger is assessed as unfit to travel and refused embarkation then, to the extent permitted by law, neither the Company nor MSC Cruises has any liability to the Passenger.

9. Disabled passengers and passengers with reduced mobility

9.1 The Company’s and the Carriers’ priority is always the comfort and safety of its Passengers and in order to achieve this the Passenger is asked at the time of Booking to provide as much detail as possible of the matters given below so that the Company and Carrier can consider its obligation to carry the Passenger in a safe or operationally feasible manner, taking into account any issues relating to the design of the passenger ship or port infrastructure and equipment including port terminals which may make it impossible to carry out the embarkation, disembarkation or carriage of the Passenger which may have an impact on the Passengers safety and comfort. 

9.2 When submitting a Booking Request, you must provide full details if the Passenger: 

(a) is unwell, infirm, Disabled or has Reduced Mobility; 

(b) requires a special Disabled cabin, since there is a limited number of these available and since the Company would like to, wherever possible, accommodate the Passenger so that the Passenger is comfortable and safe for the duration of the Cruise; 

(c) has any special seating requirements; 

(d) needs to bring any medical equipment on board; or 

(e) needs to bring a recognised service or assistance dog on board the vessel (and you confirm that that you are aware that assistance dogs are subject to local regulations with which you must comply). 

9.3 Where the MSC Cruises and/or authorised crew members of the MSC Cruises’ vessel consider it strictly necessary for the safety of the Passenger and in order for the Passenger to fully enjoy the Cruise, they may require a Disabled Passenger or Passenger with Reduced Mobility to be accompanied by another person who is capable of providing the assistance required by the Disabled Passenger or Passenger with Reduced Mobility. This requirement will be based entirely on the opinion of the authorised crew member on board the applicable MSC Cruises’ vessel assessing the need of the Passenger on grounds of safety and may vary from vessel to vessel and/or itinerary to itinerary. 

9.4 Passengers confined to a wheelchair must furnish their own standard size collapsible wheelchair during the whole Holiday Package and may be requested to be accompanied by a travelling Passenger fit and able to assist them. 

9.5 If the Passenger has any particular conditions, Disability or Reduced Mobility which require personal care or supervision then such personal care or supervision must be organised by the Passenger and at the Passenger’s expense. The MSC Cruises’ vessel is unable to provide respite services, one-to-one personal care or supervision or any other form of care for physical or psychiatric or other conditions. 

9.6 The Passenger acknowledges and accepts that: 

(a) after carefully assessing the Passenger’s specific needs and requirements, the Company and/or the applicable MSC Cruises’ vessel may conclude that the Passenger cannot be carried safely and in accordance with applicable safety requirements and the Company may refuse to accept a Booking and/or the applicable MSC Cruises’ vessel may refuse embarkation of the Disabled Passenger or Passenger with Reduced Mobility on the grounds of safety; and 

(b) he or she may be refused the right to board the applicable MSC Cruises’ vessel if he or she has failed to adequately notify the Company of any disabilities or needs for assistance in order for the Company and/or the applicable MSC Cruises’ vessel to make an informed assessment that the Passenger can be carried in a safe or operationally feasible manner on the grounds of safety. 

9.7 If the Passenger does not agree with a decision of the Company and/or the applicable MSC Cruises’ vessel under clauses 

9.6 of these Booking Terms & Conditions, the Passenger must provide a complaint in writing with all supporting evidence to the Company. 

9.8 The Company reserves the right to refuse to carry any Passenger who in the opinion of the Company and/or the applicable MSC Cruises’ vessel is unfit for travel or whose condition may constitute a danger to themselves or others on the Cruise on the grounds of safety. 

9.9 For the safety and comfort of the Passenger, if the Passenger becomes aware between the date of Booking the Holiday Package and the date of commencement of the Holiday Package that he/she will require special care or assistance as detailed above, the Passenger must inform the Company immediately so that the Company and the applicable MSC Cruises’ vessel can make an informed assessment whether or not the Passenger can be carried in a safe or operationally feasible manner. 

9.10 Disabled Passengers or Passengers with Reduced Mobility may not be able to go ashore at ports where vessels do not berth alongside. A list of these ports is available upon written request. 

9.11 The Passenger acknowledges and accepts that: 

(a) in some ports, it is necessary to anchor offshore rather than alongside. When this is the case, the applicable MSC Cruises’ vessel will use a tender to take Passengers ashore (A tender is a small vessel and may not be suitable for persons with Disabilities or Reduced Mobility or balance problems. When using tenders, safety is the utmost priority. It is important that Passengers are able to use the tender safely.); 

(b) Passengers may be required to descend to a platform or pontoon and into the tender. (There may be steps both up and down and Passengers may need to navigate a gap between the platform and the tender (which can be approximately 45cm). Depending on weather, tide and sea conditions, there may be some movement, which could change throughout the course of the day.); 

(c) Passengers must be fit and mobile enough to access and disembark the tender. (If Passengers have impaired mobility, or use a mobility aid such as a stick, then they must carefully consider their ability to embark the tender safely before making their way down to the platform. Passengers must take into consideration the use of steps, the possibility of a gap and height difference between the platform and the tender, and the potential sudden movement of the tender when making a decision).

(d) wheelchairs and mobility scooters will not be carried by the crew into the tender; 

(e) all Passengers must be independently mobile enough to use the tenders; 

(f) carriage by tender may be refused by the master of the applicable MSC Cruises’ vessel or any of his officers if there is any doubt as to the safety of any Passenger; and 

(g) all Passengers must take extra care when stepping on and off the tender (There will be crew members there to guide and steady Passengers as they embark and disembark but they cannot support, lift or carry Passengers. The same precautions apply when Passengers disembark the tender in the port.)

10. Public Health Questionnaire

10.1 The Passenger acknowledges and accepts that: 

(a) the Company and/or the applicable MSC Cruises’ vessel and/or the health authorities in any port on the Passenger’s Itinerary may administer a public health questionnaire at any time; 

(b) the Passenger must supply accurate information regarding symptoms of any illness including but not limited to COVID-19, gastrointestinal illness and H1N1; 

(c) the applicable MSC Cruises’ vessel may deny boarding to any Passenger that it considers in its sole discretion to have symptoms of any illness including viral or bacterial illness including but not limited to COVID-19, Norovirus and H1N1; and 

(d) refusal by a Passenger to complete the questionnaire may result in the Passenger being told he/she cannot board the applicable MSC Cruises’ vessel by the master of the vessel or other authorised crew members. 

10.2 Where Passengers become ill during the Cruise with any illness, the ship’s doctor may request them to remain in their cabin for reasons of safety. Passengers must follow the instructions of members of the crew members the MSC Cruises’ vessel and refusal to do so may result in disembarkation without any liability for loss, expense, liability, compensation or damages or a refund from MSC Cruises or the applicable MSC Cruises’ vessel crew members.

11. Food allergies

11.1 If the Passenger has any known allergies, or is intolerant to any food, he/she is required to: 

(a) inform the Company at the time of Booking (by duly filling in a specific form); and 

(b) to further report it to the maître d’hôtel on the applicable MSC Cruises’ vessel as soon as possible after boarding the vessel. 

11.2 The Passenger must ensure that he/she actively avoids any food he/ she is allergic to while on the MSC Cruises’ vessel. 

11.3 The Company will take all reasonable care if the Passenger or his/her Agent has made the Company aware in writing of any specific food or ingredient the Passenger has an allergic reaction to and assist the Passenger within reason to avoid any such food or ingredients. In absence of such information: 

(a) neither the Company, nor the applicable MSC Cruises’ vessel will be held responsible for preparing special meals for the Passenger or any other prepared meals consumed by the Passenger and MSC Cruises; and 

(b) the Passenger releases and indemnifies the Company and MSC Cruises from all liability arising in connection with any claim that any specific food or ingredient caused or contributed to any allergic reaction experienced by the Passenger. 

11.4 In case of multiple allergies/intolerances, even though the Passenger or his/her Agent has informed the Company or the applicable MSC Cruises’ vessel, the vessel might not be able to avoid the risk of cross-contamination during food preparation and therefore neither the Company, nor the applicable MSC Cruises’ vessel will be held responsible if such contamination occurs.

12. Medical Assistance

12.1 Passengers are strongly recommended to have comprehensive travel health insurance covering medical treatment and repatriation costs and expenses. 

12.2 In compliance with Flag State requirements applicable to MSC Cruises’ vessels, there is a qualified doctor on board and a medical centre equipped for first aid and minor conditions only. The Passenger acknowledges and accepts that: 

(a) the medical centre is not equipped as a land based hospital and the doctor is not a specialist; 

(b) neither the Company, nor the applicable MSC Cruises’ vessel or its crew members, nor the doctor on board the vessel is liable to the Passenger as a result of any inability to treat any medical condition; 

(c) whilst there is a qualified doctor on board the applicable MSC Cruises’ vessel, it is the Passenger’s obligation and responsibility to seek medical assistance, if necessary, during the Cruise and the Passenger will be responsible to pay for onboard medical services; (d) in the event of illness or accident, the Passenger may have to disembark the applicable MSC Cruises’ vessel for medical treatment; 

(e) neither the Company nor the applicable MSC Cruises’ vessel make any representation or accept any responsibility regarding the quality of the available medical facilities or treatments at any port of call or at the place at which the Passenger is landed; 

(f) medical facilities and standards vary from port to port; 

(g) neither the Company nor the applicable MSC Cruises’ vessel makes any representations or warranties in relation to the standard of medical treatment ashore; and 

(h) the doctor’s professional opinion as to the fitness of the Passenger to board the applicable MSC Cruises’ vessel or to continue the Cruise is final and binding on the Passenger. 

It is recommended that medical advice is sought before Booking for children up to 12 months of age. For the avoidance of doubt the provisions of clause 8 and the requirement of fitness to travel is applicable to all Passengers including infants.

13. Medical equipment

13.1 The Passenger must: (a) do all things to ensure any medical equipment he/she is intending to bring on board the applicable MSC Cruises’ vessel is safe to use and in good working order; 

(b) arrange delivery to the docks prior to departure of all medical equipment he/she is intending to bring on board the applicable MSC Cruises’ vessel and to notify the Company prior to making a Booking if he/she needs to have medical equipment on board so that the Company and the applicable MSC Cruises’ vessel can ensure that the medical equipment can be carried safely; and 

(c) ensure he/she has enough medical equipment and/or medication to last the duration of the entire Holiday Package. 

13.2 The Passenger acknowledges and accepts that: 

(a) the applicable MSC Cruises’ vessel may not carry any replacement medical equipment and/or medication; 

(b) access to shore side care and equipment may be difficult and expensive to obtain; and 

(c) the Passenger must be able to operate all such equipment that the Passenger brings on board the applicable MSC Cruises’ vessel.

14. Booking changes requested by the passenger

14.1 The Passenger or his or her authorised representative or Agent is entitled to replace the name of the Passenger with the name of a third party, provided that: 

(a) said third party satisfies all the conditions for the use of the Holiday Package; and 

(b) written notice is duly sent to the Company no later than 90 days before departure of the Cruise. 

14.2 If the conditions stated above in clause 14.1 are met, the name change will in any case be subject to a fee reflecting the costs for the Company of effectuating the transfer. The name change request done prior to 120 days before departure is free of charge. Name changes requested within 90 days of the departure will be considered a cancellation and fees will apply under clause 15. 

14.3 You and the third party contract assignee are jointly liable to pay: 

(a) the price of the Holiday Package; and 

(b) any additional cost that may arise as a consequence of the change in Passenger (including but not limited to cancellations fees and/or increased prices levied by Carriers or other third party providers in relation to any name change); and 

upon the new Passenger’s name being registered by the Company or MSC Cruises as the new Passenger, you and/or that new Passenger (or his or her legal guardian) is deemed to have accepted these Booking Terms & Conditions. 

14.4 Even after the booking confirmation has been issued, you are also entitled to exchange, once only, the purchased Holiday Package (“Original Holiday Package”) with another Holiday Package (“New Holiday Package”) on the following conditions: 

(a) the date of departure of the New Holiday Package is later than that of the Original Holiday Package;

(b) the request for the substitution of the New Holiday Package in place of the Original Holiday Package is received by the Company not later than 90 days before the date of the scheduled departure of the Original Holiday Package and there is availability of spaces on the New Holiday Package; 

(c) the itinerary for the New Holiday Package refers to the same destination as the Original Holiday Package as defined in the relevant brochure of the Company (or Official Website); and 

(d) the expected date of departure of the New Holiday Package falls within 90 days from the expected date of departure of the Original Holiday Package. 

14.5 The company has the right to assign another cabin for the Passenger, as long as it has similar characteristics. If there is a change in accommodation to a lower-priced cabin, the Passengers affected will be entitled to a refund of the price difference according to the current rates. 

14.6 If the price of the New Holiday Package is higher than that of the Original Holiday Package, the difference in price as well as in insurance premium will be borne exclusively by the Passenger. On the other hand, if the price of the New Holiday Package is lower than that of the Original Holiday Package, no reimbursement or refund will be due to the Passenger. 

14.7 In case of substitution of the Original Holiday Package with the New Holiday Package, the Passenger will still be entitled to withdraw from the Contract and therefore cancellation fees will apply. Cancellation fees will be based on the price due (as per above provisions) and the scale provided under clause 15 (Cancellation by the Passenger) according to the Original Holiday Package departure date. 

14.8 The Company and MSC Cruises will make reasonable endeavours to comply with the Passenger requests for changes to flight, transport or other services arrangements and adapt them to the New Holiday Package. In no case whatsoever will the Company or MSC Cruises be held liable for change requests to a binding Contract that cannot be satisfied and the Carrier’s terms and conditions will apply in relation to such changes. (Name or date changes are not always allowed by Carriers and other transport or services providers. Most Carriers and other transport or services providers treat such changes as a cancellation and charge accordingly.) 

14.9 Save as provided above, other changes to the Booking may be requested (even after the booking confirmation has been issued) until 90 days prior to departure, subject to a minimum non-refundable administration fee of A$100/N$100 per person per amendment. Any additional costs that may arise as a consequence of the change will be exclusively for the Passenger’s account. 

14.10 Requests of amendments to the Booking received by the Company beyond the above time limits will be treated as cancellations and the cancellation charges detailed in clause 15 below will apply. 

14.11 In case the changes requested by the Passengers entail the printing of new Cruise tickets, further to the above-mentioned fees an amount of A$55/N$55 per cabin will be charged to cover the extra costs

14.12 Any changes requested by the Passenger on a Combined Tour shall always apply to the whole Holiday Package. All the relevant time limits run from the scheduled date of departure of the first Cruise of the Combined Tour. IF THE CONDITIONS STATED ABOVE IN THIS CLAUSE ARE MET, THE SUBSTITUTION OF THE ORIGINAL HOLIDAY PACKAGE WITH THE NEW HOLIDAY PACKAGE OR A NAME CHANGE WILL IN ANY CASE BE SUBJECT TO THE FOLLOWING ADMINISTRATION FEE PER PASSENGER INCLUDING CHILDREN:

Any change request related to the World Cruise shall be permitted exclusively for another World Cruise and, in such case, will trigger the loss of the non-refundable deposit equal to 15% of the price of the Package paid by the passenger.

15. Cancellation by the passenger

 15.1 To cancel a Booking, you must submit a written request (via email) to the Company or via the Passenger’s Agent. Please refer to MSC Cruises Cancellation Policy below. All tickets issued and the Confirmation Invoice must be returned together with the notice of cancellation. 

15.2 If a cabin remains for single use after you have cancelled the Passenger’s Booking, the remaining passenger occupying that cabin will be asked to pay a single surcharge charged by the Company for any single cabin Booking. Alternatively, should the remaining single passenger opt to cancel the Booking, the latter will pay the cancellation charges in accordance with clause 15.1 in addition to the insurance premium. 

15.3 It may be possible for the Passenger to claim these cancellation charges from his/her travel insurance provider, subject to any applicable deductibles. It is the Passenger’s responsibility to make such a claim under the terms of his/her insurance policy. 

15.4 The Passenger may request the cancellation of a Combined Tour, but such a cancellation shall always apply to the whole Holiday Package. All the relevant time limits run from the scheduled date of departure of the first Cruise of the Combined Tour. 

15.5 If the cancellation is due to a Force Majeure event occurring at the place of destination or its immediate vicinity and significantly affecting the performance of the package, or which significantly affect the carriage of passengers to the destination, the Passenger will not be liable to pay the fees mentioned in clause 15.1 and 15.3 above.

16. Booking changes effected by the company

16.1 The Company expressly reserves the right to change the arrangements for the Cruise or the Holiday Package, should MSC Cruises indicate that such changes are necessary or advisable for operational or safety reasons. In such circumstances, to the extent permitted by law, neither the Company nor MSC Cruises is liable for any loss, claims, damage, liability, expenses, costs or injury suffered by the Passenger as a result of such changes. 

16.2 In the event of a significant alteration to an essential term of the Contract pursuant to clause 16.1 (for example, an alteration which significantly changes any of the main characteristics of MSC Cruises’ Services such as a major itinerary change), the Company will inform the Passenger or his/her Agent of such change in writing as soon as reasonably possible. The Passenger will be offered the choice of: 

a) accepting the alteration; or 

b) booking another Holiday Package from the Company’s brochure and/or from the Official Website of equivalent or superior quality, if available; or 

c) booking another Holiday Package from the Company’s brochure and/or from the Official Website of lower quality, if available, with a refund of the difference in price; or 

d) cancelling and receiving a full refund of all monies paid. 

16.3 Passengers must notify the Company of their decision in writing or via their Agent within 15 days of receiving the notification of alteration of the period indicated. If you fail to revert within this period, the Company will consider this to be an acceptance of the alteration and any cancellations after this period shall attract cancellation chargesin accordance with clause 15.1.

17. Cancellation by the company

17.1 The Company reserves the right to cancel any Holiday Package at any time by giving written notice to the Passenger but the Passenger shall not be entitled to additional compensation, if: (a) the cancellation is due to an event of Force Majeure, the consequences of which could not have been avoided by the Company even though it has exercised all due care; or (b) the number of persons enrolled for the Holiday Package is smaller than the 50% of the passenger capacity of the relevant vessel. 

17.2 In both cases (a) and (b) in clause 17.1, the Company will offer the Passenger the choice of: 

(a) receiving a full refund of all money paid; 

(b) booking another Holiday Package from the Company’s brochure and/or from the Official Website of equivalent quality cabin type (and within the same type and length of cruise), at no extra cost, if available; or 

(c) booking another Holiday Package from the Company’s brochure and/or from the Official Website of lower quality, if available, with a refund of the difference in price. 

17.3 The Passenger’s decision must be notified to the Company in writing within 15 days of the notice of cancellation. 

17.4 In cases of cancellation or change of itinerary, to the extent permitted by law, neither the Company nor MSC Cruises is liable for any loss, claims, damage, liability, expenses, costs or injury suffered by the Passenger as a result of such cancellation or change of itinerary.

18. Without prejudice to the above

a) behaved dangerously for their safety and/or the one of other Passengers and/or crew members; 

b) damaged and/or endangered Company’s assets; 

c) did not solve outstanding debts with the Company; d) violated art. 18 of the present Booking Terms and Conditions. 

The Passenger will be informed of the rejection or cancellation made under the present article in writing.

19. Applicable refund recipient

19.1 If a Passenger or his/her authorised representative has made a Booking directly with the Company, the Company will, on behalf of MSC Cruises, pay any applicable refund to the Passenger. 

19.2 If a Passenger or his/her authorised representative has made a Booking through his/her Agent, the Company will, on behalf of MSC Cruises, pay any applicable refund to the Agent. The Passenger must refer to the Agent’s refund policy in the Agent’s terms and conditions and make any claim for a refund to the Agent. If the Agent has ceased to operate for any reason (including but not limited to due to insolvency), the Passenger must seek to obtain a refund from the Agent’s appointed liquidator or representative. Where the Company has already paid the refund to the Agent, neither the Company nor MSC Cruises will be liable to assist the Passenger with such steps that the Passenger will need to take to attempt to obtain a refund from the Agent (subject to Consumer Laws and the Agent’s applicable terms and conditions, if any). 

19.3 If an Agent fails to pass on to the Passenger the refund received by it from the Company, the Passenger has no claim against the Company or MSC Cruises and the Company and MSC Cruises have no further liability in regard to the refund.

20. The company's liability

20.1 Subject to clause 20.2 to 20.17, the Company (on behalf of MSC Cruises) accepts responsibility for death, injury or illness directly caused by the negligent acts and or omissions of it and MSC Cruises in relation to the Passenger’s Holiday Package. 

20.2 The Passenger acknowledges and accepts that: 

(a) the liability of the Company and MSC Cruises is limited, where applicable, under the conventions mentioned in 20.3 to 20.15 inclusive); 

(b) neither the Company nor MSC Cruises are responsible for any failure to perform its obligations under the Contract which is: 

(i) wholly or partially attributable to the fault of the Passenger; 

(ii) an unforeseeable or unavoidable act or omission of a third party unconnected with the supply of any service to be provided under the Contract;

(iii) an unusual or unforeseeable circumstance beyond the control of the Company and/or MSC Cruises the consequences of which could not have been avoided even if all due care had been exercised, including (but not limited to) a Force Majeure; or (iv) an event which neither MSC Cruises nor the Company could, even with all due care, have foreseen or forestalled; 

(c) neither the Company nor MSC Cruises is responsible for: 

(i) any loss caused to you or the Passenger as a result of the Passenger finding he or she is unable to participate in certain activities included in the Holiday Package (due to an unexpected medical condition or otherwise); 

(ii) any loss caused to you or the Passenger as a result of you or the Passenger failing to safe keep any tour vouchers provided to you or the Passenger by the Company or MSC Cruises and failing to produce such vouchers where required; 

(iii) any loss caused due to any injury suffered by you or the Passenger, death and/or any damage to your property or the Passenger’s property and you acknowledge that there are certain risks associated with international travel (including but not limited to risks such as luggage being damaged while participating in your Holiday Package, specific risks associated with Shore Excursions, and the risk of contracting a disease or other medical condition while on the MSC Cruises’ vessel or on a Carrier) and accept such risks; 

(iv) any incidental expenses that you or the Passenger may incur as part of booking a Holiday Package or otherwise; and 

(v) any loss caused by any factors beyond our control. 

20.3 For claims not involving personal injury, death or illness or which are not subject to the international conventions referred to in this clause 20, to the maximum extent permitted by law and subject to certain statutory guarantees you may have under the Consumer Laws (including the CGA and the ACL), the Company’s maximum aggregate liability for breach of the Company’s obligations under these Booking Terms & Conditions or breach of the Company’s duties at law or in equity (however arising) is limited at the Company’s option to: 

(a) the cost you have paid to the Company for the services provided by the Company which you have booked at the date of such breach by the Company and excludes any services related to the Holiday Package which are provided by MSC Cruises and, if applicable, Carriers; or 

(b) the cost of resupplying the services referred to in (a) above. 

20.4 Neither the Company nor MSC Cruises is liable for any special, indirect, consequential or economic loss (including damage or loss of profits or anticipated profits, loss of revenue, loss of use, loss of contract or other opportunity), whether in contract or tort or arising from any other cause of action, suffered by you or any other person resulting from any act or omission by the Company and/or MSC Cruises (including breach, termination or non-observance of the terms of any agreement which incorporates these Booking Terms & Conditions). 

20.5 All carriage (by land, air and sea) is subject to the Conditions of Carriage of the actual Carrier. These may limit or exclude liability. Copies of these terms and conditions are available on request from the Company. 

20.6 Carriage of Passengers and their luggage by air is governed by various International conventions (the “International Air Conventions”), including the Warsaw Convention 1929 (as amended by The Hague Protocol 1955 or the Montreal Protocol 1999 or otherwise) and the Montreal Convention 1999. To the extent that the Company or MSC Cruises may be liable as a non-performing air Carrier to Passengers in respect of carriage by air, the terms of the International Air Conventions (including any subsequent amendments and any new convention which may be applicable to a Contract for a Cruise between MSC Cruises and a Passenger) are expressly incorporated into these Booking Terms and Conditions and in the Conditions of Carriage. The International Air Conventions fix limitations of liability of the Carrier for death and personal injury, loss of and damage to luggage and delay. Any liability of the Company or MSC Cruises toward the Passenger arising from a carriage by air is subject to the limitation of liability provided by said Conventions. Copies of these conventions are available upon request. 

20.7 Insofar as the Company and/or MSC Cruises may be liable to a Passenger in respect of claims arising out of carriage by air, land or sea, the Company and MSC Cruises shall respectively be entitled to all the rights, defences, immunities and limitations available to the actual Carriers (including under the Carrier’s own conditions of carriage) and under all the applicable regulations and/or conventions, such as the Athens Convention and the International Air Conventions and nothing in these Booking Terms & Conditions nor in the Carrier’s conditions of carriage shall be deemed as a waiver thereof. If any term, condition, section or provision becomes invalid or is so judged, the remaining terms, conditions, sections and provisions shall be deemed severable and shall remain in force. 

20.8 The liability (if any) of the Company and MSC Cruises for damages suffered as a result of death or personal injury to the Passenger, or loss or damage to luggage shall be determined in accordance with the following: 

(a) the Carriage by Sea EU Regulation 392/2009 Concerning the Rights of Passengers when travelling by sea in the event of Accidents (EU Regulation 392/2009) will apply to international carriage by sea where the port of embarkation or disembarkation is in the EU or where the vessel has an EU flag or where the contract of carriage is made in the EU (a copy of EU Regulation 392/2009 are available on request and can be downloaded from the Internet at https://www.gov.uk/government/uploads/system/uploads/attachment_data/file/2724/an nex-b-reg-ec-392-2009.pdf. A summary of EU Regulation 392/2009 can be found at http://ec.europa.eu/transport/themes/passengers/maritime/doc/rights-in-case-ofaccident.pdf); 

(b) where the vessel is being used as floating accommodation then the provisions of the Athens Convention 1974 and the limits therein will apply and are hereby expressly incorporated into these Booking Terms & Conditions including any claims for loss of or damage to luggage and or death and or personal injury; 

(c) the level of damages the Company and MSC Cruises may be liable to pay in relation to death and/or personal injury and or loss of or damage to Luggage is limited and shall in no circumstances whatsoever exceed the limits of liability set out in EU Regulation 392/2009, or where applicable Athens Convention 1974; 

(d) the liability of the Company and MSC Cruises for death, personal injury or illness to the Passenger will not exceed 46.666 Special Drawing Rights ("SDR") as provided and defined in the Athens Convention 1974 or, where applicable, the maximum sum of 400,000 SDR pursuant to EU Regulation 392/2009 or The Athens Convention 2002 and, where there is liability for war and terrorism under EU Regulation 392/2009 or The Athens Convention 2002, 250.000 SDR; 

(e) the liability of the Company and MSC Cruises for loss of or damage to Passenger's luggage or other property will not exceed 833 SDR per Passenger under the Athens Convention 1974 or 2,250 SDR where EU Regulation 392/2009 or Athens Convention 2002 applies; 

(f) any liability of the Company and MSC Cruises will be subject to the applicable deductibles per Passenger, such sum to be deducted from the loss or damage to luggage or other property; and 

(g) the Passenger understands that the conversion rate of SDR's fluctuates daily and may be obtained from a bank or Internet. The value of an SDR can be calculated by visiting http://www.imf.org/external/np/fin/data/rms_five.aspx. 

20.9 It is presumed under the Athens Convention 1974 and where applicable The Athens Convention 2002 or EU Regulation 392/2009 that the applicable MSC Cruises’ vessel has delivered Luggage to a Passenger unless written notice is given by the Passenger within the following periods: 

(a) in the case of apparent damage before or at the time of disembarkation or redelivery; and 

(b) in the case of damage which is not apparent or loss of Luggage within fifteen days from the disembarkation or delivery or of the date that such delivery should have taken place. 

20.10 If the carriage provided hereunder is not “international carriage” as defined in Article 2 of EU Regulation 392/2009 or the vessel is being used as a floating hotel and or domestic carriage by sea in the UK, the provisions of the Athens Convention 1974 shall apply to this contract and be deemed to be incorporated herein mutatis mutandis. The Company shall not be liable for loss or damage to any valuables such as monies, negotiable securities, precious metal items, jewellery, art, cameras, computers, electronic equipment, or any other valuables unless they are deposited with the Carrier for safe-keeping, and a higher limit is agreed expressly and in writing at the time of deposit, and an extra charge is paid by the Passenger for declared value protection. Use of the ship’s safe is not a deposit with the ship. Where there is liability for loss of or damage to valuables deposited with the ship then such liability is limited to 1,200 SDR under the Athens Convention 1974 or 3,375SDR where EU Regulation 392/2009 or Athens Convention 2002 applies. 

20.11 The Company and the Carrier shall have full benefit of any applicable laws providing for limitation and/or exoneration of liability in connection with the provision of the Services (including without limitation, law and/or the laws of the vessel’s flag in respect of/or the global limitation on damages recoverable from the Carrier). Nothing in these Booking Terms and Conditions is intended to operate to limit or deprive the Company and the Carrier of any such statutory or otherwise limitation or exoneration or liability. The servant and/or agents of the Company and the Carrier shall have the full benefit of all such provisions relating to the limitation of liability. 

20.12 Without prejudice to the provisions of clauses 20.1 to 20.9 above, if any claim is brought against the Company and Carrier in any jurisdiction where the applicable exemptions and limitations incorporated in these Booking Terms and Conditions are held to be legally unenforceable then the Company and the Carrier shall not be liable for death, injury, illness, damage, delay or other loss or detriment to any person or property arising out of any cause of whatsoever nature which has not been shown to have been caused by the Company and Carrier’s own negligence or fault. 

20.13 The liability of the Company is excluded for claims arising out of loss or damage directly or indirectly occasioned by circumstances where performance and/or prompt performance of the Contract or the Services is prevented by reason of war, or threat of war, riot, civil strike, industrial dispute whether by the Company’s employees or others, terrorist activity or the threat of terrorist activity, failure of power supplies, health risks or epidemics natural or nuclear disaster, fire or adverse weather conditions or adverse sea states, Passenger’s suicide or attempted suicide or the Passenger’s deliberate exposure to unnecessary danger (except in an attempt to save human life), or the consequences of the Passenger participating in an unusual and dangerous activity and any other circumstance of any nature whatsoever outside the Company’s control. 

20.14 Where the Company or MSC Cruises has any legal liability for loss of or damage to property otherwise than in accordance with the Athens Convention or International Air Conventions then, to the extent permitted by law, its liability shall not at any time exceed EUR 500.00 and the Company and MSC Cruises shall not at any time be liable for money or valuables. Passengers must not pack money or other valuables in their luggage. 

20.15 To the extent permitted by law, the Company’s and MSC Cruises’ liability under the Contract will not at any time exceed that of any Carrier under its Conditions of Carriage and/or applicable or incorporated international conventions (including the International Air Conventions). 

20.16 Any damages payable by the Company or MSC Cruises (for any reason) under the Contract shall be reduced in proportion to any contributory negligence by the Passenger (or the Agent, where applicable). 

20.17 The limitations and exclusions in this clause 20 apply only to the extent permitted by the laws applicable to the Contract and the Services (including applicable Consumer Laws).

21. Itinerary/right to change

22. passenger's responsibility.

22.1 The Passenger has a duty to follow the instructions and orders of the master and officers while on board. The Passenger hereby accepts and agrees that the master and officers are entitled and have authority to inspect any person on board, any cabin, baggage and belonging for safety, security or other lawful reasons. 

22.2 The Passenger hereby expressly agrees to allow any such inspection. 22.3 Passengers must have received all necessary medical inoculations prior to the Cruise and have in their possession all tickets, valid passports, visas, medical cards and any other documents necessary for the scheduled ports of call and disembarkation. 

22.4 Each Passenger warrants that he/she is physically and mentally fit to undertake the Cruise. 

22.5 The applicable MSC Cruises’ vessel and/or the master and/or authorised crew members have the right of refusing the boarding or order the disembarkation of any Passenger should they deem it necessary, for the safety, security, of the Passenger, of the other Passengers or of the ship or should the Passenger’s conduct which, in the reasonable opinion of the master, is likely to endanger or impair the comfort and enjoyment of other Passengers on board. 

22.6 No Passenger shall bring any animals whatsoever, except for recognised service or assistance dogs, subject to clause 9 above. 

22.7 Passengers’ behaviour must not affect and reduce the safety, peace and enjoyment of the Cruise by other Passengers. 

22.8 The Passenger must not carry firearms, ammunition, explosives or flammable, toxic or dangerous substances, goods or articles on board any vessels which could be dangerous for the safety of Passengers and the vessels. 

22.9 Passenger is liable for any damage suffered by the Company and/or MSC Cruises and/or any supplier of any service that forms part of the Holiday Package as a result of the Passenger’s failure to comply with his contractual obligations. In particular, the Passenger shall be liable for all damages caused to the vessel or its furnishings and equipment, for injury or loss to other Passengers and third parties, and also for all penalties, fines and expenses attributable by the Passenger that the Company, MSC Cruises or any of MSC Cruises’ suppliers may be liable to pay. 

22.10 Passengers are not allowed to sell and/or purchase from other passengers or travel operators on board the ship any type of commercial services – including but not limited to Shore Excursions – which are not officially offered by MSC Cruises or its agreed independent contractors. 

22.11 Neither the Company nor MSC Cruises will be under any liability whatsoever to any Passenger in respect of any breach or non-observance by any Passenger of the provisions of this clause 20 and any Passenger shall indemnify the Company and/or MSC Cruises against any loss or damage occasioned to the applicable MSC Cruises’ vessel or the Company or any of MSC Cruises’ suppliers by such breach or non-observance.

23. Flights

23.1 Where air carriage is included in the Contract, the Company will advise Passengers of flight timings from data supplied by the air Carrier as part of the holiday documentation. The flight schedule is for information only. The Passenger’s contract of carriage by air and the rights and obligations arising under it remain with the air Carrier. It is the Passenger’s responsibility to ensure arrival at the airport in sufficient time to check in and board the aircraft. Passengers must note that not all medical equipment can be carried or used on board aircrafts. Passengers must check with the airline prior to carriage. 23.2 If the Contract does not include flights, it is the Passenger’s responsibility to obtain a valid ticket directly from an air Carrier suitable for and in time for travel to the vessel (and including local transfers which the Passenger must arrange), as necessary. 

23.3 The Company and MSC Cruises are not be responsible for any liabilities arising in respect of flights or transfers arranged by the Passenger. 

23.4 The Company and MSC Cruises are unable to state the identity of the airline or the aircraft type applicable to the Passenger’s travel package. All flights will be operated on scheduled or chartered services of recognised air Carriers. In those circumstances the air ticket payment needs to be made by the Company in advance and is normally not refunded by the air Carrier (regardless of the cancellation provisions with regard to the Cruise). 

23.5 The Passenger will receive confirmation of flight timings and routes with their travel documents, which will be sent out approximately 30 days before departure. 23.6 For travel on dates other than those published in the Company’s brochure and/or in the Official Website or on a particular Carrier or routing a higher fare may apply in which case the Passenger will be notified before Booking.

24.-complaints

24. Complaints

24.1 Any Passenger with a complaint whilst on a Cruise must bring it to the attention of the Cruise staff on board the applicable MSC Cruises’ vessel as soon as possible. If the Cruise staff is unable to resolve the problem, any complaint must be notified in writing to the Company within 60 days of the termination of the Cruise. Failure to report the complaint within this time may adversely affect the Company’s ability to deal with it. Complaints relating to any other part of a Holiday Package must be made promptly to the Company or the supplier.

24.2 Notices of claim for loss or damage to luggage or other property shall be given to the Carrier in writing before or at the time of disembarkation, or if not apparent, within fifteen (15) days from the date of disembarkation.

24.3 Complaints under EU Regulation. 1177/2010 concerning accessibility, cancellation or delays must be made to the Company within two (2) months from the date the service was performed. The Carrier shall respond within 1 month to advise whether the complaint is substantiated, has been rejected or is still being considered. A final reply shall be provided within two (2) months. The Passenger shall provide such further information as may be required by the Company to deal with the complaint. If the Passenger is not satisfied with the response then it may complain to the relevant enforcement body in the country of embarkation

25. Consumer Protection

25.1 Certain statutory guarantees, warranties and rights may apply to your purchase of the Services as provided by the ACL, CGA and other relevant laws. 25.2 Nothing in these Booking Terms & Conditions excludes, restricts or modifies any condition, warranty, statutory guarantee, right or remedy implied or imposed by common law, statute or regulation which cannot be lawfully excluded, restricted or modified. 

25.3 If section 23 of the ACL applies to any provisions in these Booking Terms & Conditions, any such provision(s) shall be void to the extent it is unfair within the meaning of section 24 of the ACL. If any provisions in these Booking Terms & Conditions are declared by a court to be an unfair contract term under section 46I of the FTA, any such provision(s) shall be void. 

25.4 To the fullest extent permitted by law, the liability of the Company for a breach of a nonexcludable warranty, condition, guarantee, right or remedy referred to in clause 24.2 is limited, at the Company’s option, to: 

(a) the supplying of the Holiday Package again; or 

(b) the payment of the cost of having the Holiday Package supplied again.

26. Data protection

26.1 By accepting these Booking Terms & Conditions, you acknowledge that you have read and accept the terms in the Company’s Privacy Policy https://www.msccruises.com.au/enau/Privacy.aspx 

26.2 The Company requires Personal Information including but without limitation to name, address, gender, citizenship and dietary requirements which may disclose a Passenger’s religious beliefs, any health, medical disability and any other special needs to process the Passenger’s booking effectively. 

26.3 The Company may pass your and/or the Passenger’s Personal Information on to other relevant individuals such as Agents, hotels, airlines or other transport providers, security and/or credit verification companies, credit and debit card companies or any governmental or public authorities, either as required by law or regulation or, if required by other such bodies. The Company may also circulate a passenger list to all Passengers prior to the Cruise which will include the names and nationality of each passenger. 26.4 Save as is required for the exercise of its rights and the performance of its obligations under the Contract, the Company will not, on behalf of MSC Cruises, disclose the Personal Information of any Passenger to any other person, other than the Company’s and/or MSC Cruises’ own servants, agents and contractors (including Carriers), without the Passenger’s written consent, unless the disclosure is required by applicable law. 

26.5 The Passenger consents to such transfer of information, including to other countries which may not have such robust requirements regarding data protection as Australia or New Zealand, unless the Passenger objects in writing to the Company no later than seven days prior to the scheduled Holiday Package departure date. The Passenger must make sure that information which the Company holds about him/her is up to date and accurate. 

26.6 Personal Information relating to individual Passengers shall be collected, processed, stored and used securely and in accordance with relevant data protection laws. Passengers consent to the collection, processing, storing and use of their personal data to enable the Company to perform the Services. This may include providing Passenger details to Governments,immigration, port state control, police, flag state and other competent authorities and or as may be required by law. In the case of emergencies, the Passenger consents to the Company and MSC Cruises providing Personal Information to shore side doctors, next of kin, the Company and MSC Cruises’ insurers and advisors and the Passenger’s medical insurers. Personal Information shall only be kept for as long as is necessary or required by law. 

26.7 The Company and MSC Cruises will comply with all applicable privacy and data protection laws and regulations of the Commonwealth of Australia and New Zealand including, without limitation, the Australian Privacy Act 1988 (Cth) and the New Zealand Privacy Act 2020.

27. General

27.1 No variation of these terms or the Contract shall be effective unless in writing and signed by the Company. 

27.2 The Passenger must not assign, transfer or otherwise delegate any of its rights or obligations under the Contract without the Company’s prior written consent. 

27.3 If these Booking Terms & Conditions are inconsistent with any other document or agreement between the parties, this document prevails to the extent of the inconsistency.

28. Smoking policy

28.1 In compliance with global standards, smoking is freely permitted in dedicated areas throughout the applicable MSC Cruises’ vessel which is equipped with a special air extraction system. 

28.2 Smoking is not permitted in any food service areas, including buffets and restaurants, the medical centres, child-care areas, corridors or elevator foyers, areas where Guests are assembled in groups for safety exercises, disembarkation or tour departures, public toilets, or in bars close to areas where food is served. 

28.3 The Passenger acknowledges and accepts that MSC Cruises prohibits Passengers from smoking in the cabins of MSC Cruises’ vessels because of the risk of fire. Smoking on cabin balconies is also not allowed. The Company reserves the right to levy a fee should passengers be found smoking in not designated area of the applicable MSC Cruises’ vessel. Repeatedly smoking in non-smoking areas can ultimately lead to mandatory disembarkation, at the Company or the MSC Cruises’ vessel authorised crew members’ discretion. 

28.4 Smoking is permitted in dedicated areas of at least one bar on the applicable MSC Cruises’ vessel, and on one side (indicated by signage) of the principal outer pool deck areas, where ashtrays are provided. 

28.5 Throwing cigarette butts over the side of the applicant MSC Cruises’ vessel is prohibited.

29. Liability of employees, servants and subcontractors

29.1 It is hereby expressly agreed that no servant or agent of the Company and/or MSC Cruises, including the Master and crew of the applicable MSC Cruises’ vessel concerned includingindependent subcontractors and their employees as well as the underwriters of these parties shall in any circumstance whatsoever be under any liability whatsoever beyond these Booking Terms & Conditions and these parties may invoke these Booking Terms & Conditions to the same extent as the Company and/or MSC Cruises.

29.2 Shore Excursions are operated by independent contractors even if sold by Agents or on board the applicable MSC Cruises’ vessel. The Company shall not be responsible in any way for the services provided by such independent contractors. MSC Cruises operates as mere agent for the Shore Excursion provider. MSC Cruises will exercise reasonable skill and care in the selection of a reputable Shore Excursion provider. In assessing performance and/or liability of Shore Excursion providers, local laws and regulations will apply. Shore Excursions shall be subject to the Shore Excursion provider’s terms and conditions including the benefit of any limitation of liability and the level of damages. MSC Cruises’ liability shall never exceed that of the Shore Excursion provider. 

29.3 Notwithstanding clause 29.2, you acknowledge and agree that neither the Company nor MSC Cruises has any direct control over the Shore Excursion providers and their services hence, to the extent permitted by law, in no case whatsoever will the Company or MSC Cruises be held liable for loss, damages and injuries suffered by the Passenger as a result of the negligence or otherwise of the Shore Excursion providers.

30. Law and jurisdiction

30.1 These Booking Terms & Conditions shall be governed by the laws of the State of New South Wales, Australia and the parties irrevocably submit to the non-exclusive jurisdiction of the Courts of the State of New South Wales, Australia.

31. Errors, Omissions and Changes

31.1 Every effort has been made to ensure accuracy of the Company’s brochure and/or of the Official Website content but certain changes and revisions may take place after the printing of the Company’s brochure and/or the publishing of the Official Website. In addition, from time to time, we may publish specific terms and conditions related to a specific promotion, and certain terms including but not limited to the applicable deposit amount may be different from the terms in these Booking Terms & Conditions.

31.2 Since the Booking Terms & Conditions applicable to the single Cruise or Holiday Package are those in force at the time of completing the Booking, irrespective of those published in the relevant Company’s brochure, it is recommended to check with the Company or by visiting the Official website for the most up to date Booking Terms & Conditions.

These are the Terms and Conditions, which apply exclusively to the MSC Cruises and Formula 1® reservations. Please read them carefully as you be bound by them.

Definitions

All Vacation Packages featured in the Company’s brochure and/or in the Official Website are offered for sale by MSC Cruises S.A, hereinafter referred as the “Company”.

In these Booking Terms & Conditions the following expressions shall have the meanings defined hereunder:

  • “Booking” means the steps taken by the Passenger to enter into a Contract with the Company.
  • “Booking Terms & Conditions” means these terms and conditions and the information contained in the relevant Company’s brochure, the Official Website and/or other information which will form the express terms of your Contract with the Company.
  • “Carrier” means the entity who has undertaken the obligation to carry the Passenger from one place to the other as indicated in the Cruise ticket, airline ticket or other ticket issued for any other applicable transport and is thereby indicated on such documents as “carrier”.
  •  “Company” means MSC Cruises S.A. whose registered address is 16, Eugene Pittard, CH-1206 Geneva, Switzerland who organizes Vacation Packages and sells or offers them for sale, whether directly or through a Sales Agent.
  • “Conditions of Carriage” means the terms and conditions under which the Carrier provides transport either by air, road or sea. The Conditions of Carriage may refer to the provisions of the law of the country of the Carrier and/or international conventions which may limit or exclude the liability of the Carrier. Copies of the Conditions of Carriage of any Carrier are available to the Passengers upon request.
  • “Combined Tour” means the combination of two or more Cruises prearranged by the Company and offered for sale as a single Vacation Package. For any relevant purposes, the Combined Tour shall always be considered as a single and indivisible Holiday Package. All terms and references to a Cruise and or Holiday Package shall include and be equally applicable to a Combined Tour unless otherwise stated. References to price are references to the total price paid for the Combined Tour.
  • “Contract” means the contract concluded between the Company and the Passenger relating to the relevant Vacation Package which is evidenced by the issue of the confirmation invoice sent by the Company or its Sales Agent to the Passenger.
  • “Cruise” means the transport by sea and the stay onboard a MSC Cruises vessel (as described in the relevant Company’s brochure, the Official Website or other documentation produced for or on behalf of the Company) as well as, depending on the Cruise itinerary, the call and the duration of any stay on the Ocean Cay – MSC Marine Reserve, operated by the Company. A Cruise – if not purchased with pre- or post-Cruise services – can be considered by itself as a Holiday Package.
  • “Disabled Passenger” or “Passenger with Reduced Mobility” ; means any Passenger whose mobility when using transports is reduced as a result of any physical disability (sensory or locomotor, permanent or temporary), intellectual or psychosocial disability or impairment, or any other cause of disability or impairment or as a result of age, and whose situation needs appropriate attention and adaptation to his/her particular needs for the services made available to all Passengers.
  • “Force Majeure” means any unforeseeable and unpredictable event out of the Carrier’s or the Company’s control including Acts of God (such as, flood, earthquake, storm, hurricane or other natural disasters), war, invasion, act of foreign enemies, hostilities (regardless of whether war is declared), civil war, rebellion, revolution, insurrection, military or usurped power or confiscation, terrorist activities, riots, civil disturbances, industrial disputes, natural and nuclear disasters, fire, epidemics, health risks, nationalisation, government sanction, blockage, embargo, labour dispute, strike, lockout or interruption or failure of electricity or telephone service and/or any unforeseen technical problems with transport including changes due to rescheduling or cancellation or alteration of flights, closed or congested airports or ports.
  • “Holiday Package” means the Cruise whether or not in combination with flight(s) and/or any pre- and/or post-Cruise arrangement for accommodation. It includes, depending on the Cruise itinerary, the call and the duration of any stay on the Ocean Cay – MSC Marine Reserve, operated by the Company. It does not include Shore Excursions or shuttle services which do not form part of the inclusive Holiday Package price.
  •  “Official Website” means the set of related web pages, documents and hypertext links served from the web domain  www.msccruises.ca.
  • “Passenger” means each and every person, including minors, named either on the Booking confirmation or on the invoice or on a ticket issued by the Company.
  • “Sales Agent” means the person or travel agency  that sells or offers for sale the Holiday Package put together by the Company, on its own or on behalf of the Company.
  • “Tour Operator” means the person or travel agency  that sells or offers for sale the Vacation Package put together by the Company, on its own or on behalf of the Company.
  • “Shore Excursion” means any excursion, trip or activity ashore that is not included as part of the all-inclusive price of the Vacation Package and is offered for sale by the Company onboard its vessels.
  • “ World Cruise ” means the tour of the world prearranged by the Company and offered for sale as a single Holiday Package. For any relevant purposes, the World Cruise shall always be considered as a single and indivisible Holiday Package. All terms and references to a Cruise and or Holiday Package shall include and be equally applicable to a World Cruise unless otherwise stated. References to price are references to the total price paid for the World Cruise.

Booking Procedure and Deposit

1.1       In order to proceed with a Booking, the Passenger must contact the Company or one of the Company’s authorized Sales Agents or representatives.

1.2        By booking for an Holiday Package, the person making the Booking confirms, agrees and accepts that all persons named in the Booking request and on the invoice have agreed to be bound by the Booking Terms & Conditions and that he/she has authority to accept these Booking Terms & Conditions on behalf of all the persons named on the Booking request and invoice. 

1.3       A deposit of $99 per adult, (4 nights or less), $199 per adult (5-14 nights) and $300 per person (15 nights or longer) is due and payable by the Passenger at the time of Booking. For Yacht Club, deposit is non-refundable. For the World Cruise, a non-refundable deposit equal to 15% of the price of the Package is due and payable by the Passenger within the first week starting from the date of the booking confirmation.

1.4       A Booking will be completed and the Contract will be effective only when the Company accepts the Booking by sending a confirmation invoice to the Passenger or to the Passenger’s Sales Agent.

2.1       Every Holiday Package is subject to availability at the time of Booking. No Contract shall be made until the deposit or the full amount (according to the present Booking Terms & Conditions) is paid and the confirmation invoice provided to the Passenger.  

2.2      Full payment is required no later than 75 days prior to departure (4 nights or less), 90 days prior to departure (5 to 14 nights), 110 days prior to departure (15 nights or more). For World Cruise 2024, 2025 and 2026, full payment is required no later than 120 days prior to departure.

2.3       If the Booking application is made within the parameters listed in 2.2, then full payment must be sent at the time of Booking.  

2.4       If any Passenger fails to pay the balance within the parameters listed in 2.2, the Company has the right to cancel the Booking without notice and levy cancellation charges in accordance with paragraph 13 below, whether the Holiday Package is resold or not.

2.5 Flight & Cruise Package. Full payment is required no later than 120 days prior to departure, unless special payment conditions apply. If the booking is made within

120 days prior to departure, full payment must be paid at the time of booking. If any passengers fail to pay the balance 120 days prior to departure, the Company has the right to

cancel the booking without notice and levy cancellation charges whether the Holiday package is resold or not.

Prices and Price Guarantee

3.1   No change to the Holiday Package price will be made within the 30-days period before departure or once full payment has been received by the Company.

3.2   The Company reserves the right to modify the Contract price at all times prior to those detailed in 3.1 above to allow variations for:

a)     Air transportation costs ;

b)     Fuel costs for the propulsion of the vessel ;

c)       Dues, taxes or fees chargeable for services such as embarkation or disembarkation fees at ports or airports.

d)      the exchange rates relevant to the Holiday Package.

Variations may be upwards or downwards. For paragraph a) any variation of the Holiday Package price will be equal to the extra amount charged by the airline. For paragraph b) any variation of the Holiday Package price will be equal to 0.33% of the price of the Cruise for every dollar of increase of the fuel per barrel (NYMEX Index). For paragraph c) any variation of the Holiday Package price will be equal to the full amount of the fees. .

3.3   If the increase in the Holiday Package price amounts to more than 8% of the total Holiday Package price at the time of Booking, the Passenger will be entitled to cancel the Contract with a full refund of the Holiday Package price within the limits and to the extent of the amount effectively paid by the Passenger at the time of cancelation. Such right of refund does not include insurance premiums paid which are in no case refundable.

3..4 "The notification of alteration will specify a reasonable response period by which the Passenger must notify the Company of his/her decision. If the Passenger fails to respond within the imparted time contained in the Notice, the alterations will be considered to be accepted. "

3.5 For your convenience, MSC Cruises will automatically add a daily Hotel Service Charge to your shipboard account, based on your chosen itinerary and the number of days for which the services are actually provided. The daily amounts below have been calculated with this in mind and cannot be modified. However, should you wish to remove any of the daily Hotel Service Charge in the unlikely event that you do not receive satisfactory service, you may do so by contacting the Guest Relations Manager onboard. Travel insurance.

All Canadian residents due to embark on any of our vessels are highly recommended to be covered by an insurance policy . This insurance must cover trip cancellation, trip interruption and COVID 19 medical extension for a cruise holiday .  We are please to say that we have partnered with our travel insurance provider,  TUGO  to provide this required coverage. Cancellations, Delays and Refunds

5.1 Passengers must hold fully valid passports for the whole duration of the Holiday Package and the expiry date must be at least 6 months after the return date. Certain countries insist on machine-readable and digital photo passports, especially Russia and USA. 5.2 The Company is not responsible for obtaining visas for any Passenger, this is the responsibility of the individual Passenger. It is the duty of the Passenger to verify that his/her passport, visas, or other documents for travel are accepted in the countries where the Holiday Package is deployed. Passengers are strongly advised to check for all legal requirements for travelling abroad and at the various ports to include the requirement of visas, immigration, custom and health. 5.3 Passengers under 18 years of age (or 21 years of age for US Passengers or Passengers embarking from a US port) must travel accompanied by their parents or a legal guardian. If one of the traveling minor’s parents is not cruising, a signed authorization letter – made in accordance with the laws of the country where the minor resides - from the absent parent authorizing the minor to travel has to be provided at the moment of booking. 5.4 If the minor is travelling with Passengers that are not his parents or legal guardians, the Company shall require, at the moment of booking, a document signed by the parents or legal guardian authorizing the minor to travel with a chaperone or a designated individual, in accordance with Company’s policies.

Fitness to Travel

6.1       The safety of all Passengers is of paramount importance to the Company, hence all Passengers warrant that they are fit to travel by sea (and if applicable by air) and that their conduct or condition will not impair the safety or convenience of the vessel or aircraft and the other Passengers, and that they can be carried safely in accordance with applicable safety requirements established by International EU or national law.

6.2       Any Passenger with a condition that may affect fitness to travel taking into account the vessel’s itinerary must inform the Company at the time of Booking and submit a doctor’s certificate prior to Booking. In any case, the Company and/or the Carriers has the right to request – at their own discretion – the Passenger to produce medical certificates supporting the fitness to travel.

6.3       Pregnant women are requested to seek medical advice before travelling; at any stage of their pregnancy they must obtain a medical certificate from a doctor confirming their fitness to travel on board the vessel taking into account the specific itinerary.

6.4       The Company and/or the Carriers do not have on board any of the cruise vessels adequate medical facilities or equipment for childbirth. The Company cannot accept a Booking and the Carrier cannot carry any Passenger who will be 24 weeks pregnant or more by the end of the Cruise.

6.5       The Company and the Carrier expressly reserve the right to refuse boarding rights to any Passenger who appears to be in any advanced state of pregnancy or who does not provide the medical certificate according to  clause  6.2 above and shall have no liability in respect of such refusal.

6.6       In the case of a Booking made by a Passenger who was not aware at the time of Booking and could not have reasonably known at the time of Booking that she was pregnant over the terms provided by upper clause 6.4 then, the Company will offer the Passenger the choice of Booking another Cruise from the Company’s brochure and/or from the Official Website of equivalent quality compliant with the above mentioned terms, if available; or cancelling and receiving a full refund of the full price paid by that Passenger for any cancellation of Booking as long as such cancellation is notified immediately as soon as such a Passenger becomes aware of her condition. The refund will not include insurance premiums paid which are in no case refundable.

6.7       If it appears to the Carrier, the master or the ship’s doctor that a Passenger is for any reason unfit to travel, likely to endanger safety, or likely to be refused permission to disembark at any port or likely to render the Carrier liable for maintenance, support or repatriation, then the master shall have the right to refuse to embark the Passenger at any port or disembark the Passenger at any port or transfer the Passenger to another berth or cabin. The doctor onboard shall have the right to administer first aid and any drug, therapy or other medical treatment and/or to admit and/or confine the Passenger to the ship’s hospital or other similar facility, if such measure is considered necessary by the doctor and is supported by the master’s authority. Refusal by the Passenger to cooperate with regard to such treatment may result in the Passenger being disembarked at any port, if necessary through the intervention of local police officers or other competent authorities, and neither the Company nor the Carrier shall be liable for any loss, expense or compensation to the Passenger.

6.8       Where a Passenger is assessed as unfit to travel and refused embarkation then neither the Company nor the Carrier has any liability to the Passenger.

Disabled Persons and Persons with Reduced Mobility

Public health questionnaire.

8.1 The Company and/or the Carrier and/or the health authorities in any port shall be entitled to administer a public health questionnaire on their own behalf. In addition to any Health and Safety measures that the Company may adopt, the Passenger shall supply accurate information regarding symptoms of any illness including but not limited to gastrointestinal illness, H1N1 and COVID-19. The Carrier may deny boarding to any Passenger that it considers in its sole discretion to have symptoms of any illness including viral or bacterial illness including but not limited to Norovirus, H1N1 and COVID-19. Refusal by a Passenger to complete the questionnaire may result in denied boarding. 8.2 Where Passengers become ill during the Cruise with viral or bacterial illness the ship’s doctor may request them to remain in their cabin for reasons of safety.

Food Allergies & Medical Assistance

Medical equipment.

11.1     It is important that Passengers contact the manufacturer or supplier to ensure that any medical equipment they are intending to bring on board is safe to use. It is the responsibility of the Passengers to arrange delivery to the docks prior to departure of all medical equipment and to notify the Company prior to Book if they need to have medical equipment on board so that the Company and the Carrier can ensure that the medical equipment can be carried safely.

11.2     It is the Passengers responsibility to ensure that all medical equipment is in good working order and for arranging enough equipment and supplies to last the entire voyage. The ship does not carry any replacement and access to shore side care and equipment may be difficult and expensive. Passengers must be able to operate all equipment. 

Booking changes requested by the Passenger

A name change fee of $50 per name change will apply for any name change made from the time the Booking penalty period begins, as stated in the above cancellation chart, until 7 days prior to departure.  An original passenger must remain in the Booking for the name change not to be considered a cancellation.  If an original passenger does not remain in the Booking, it will be considered a cancellation and is subject to the above cancellation charges. 

For Bookings with the Bella Experience, a departure date change fee of $50 per person will apply for any departure date change made from the time the Booking penalty period begins, as stated in the above cancellation chart, until 30 days prior to departure.  The new departure date must be within 90 days of the original departure date. Any change to a date that is more than 90 days from the original departure date is considered a cancellation and is subject to the above cancellation charges.  Any change made less than 30 days prior to departure is considered a cancellation and is subject to the above cancellation charges. 

For Bookings with the Fantastica, Aurea or Yacht Club Experience, one departure date change can be made free of charge from the time the Booking penalty period begins, as stated in the above cancellation chart, until 30 days prior to departure. Any subsequent departure date change will result in a fee of $50 per person. The new departure date must be within 90 days of the original departure date. Any change to a date that is more than 90 days from the original departure date is considered a cancellation and is subject to the above cancellation charges.  Any change made less than 30 days prior to departure is considered a cancellation and is subject to the above cancellation charges. 

For Bookings for World Cruise, any departure date change must be to another World Cruise and, in such case, will be assessed a fee in the amount of 15% of the price of the Cruise Package paid by the Passenger.  Any departure date change within 30 days prior to departure is considered a cancellation and is subject to the above cancellation charges.

In addition to the administration fees mentioned above, if the price of the new Cruise Package is higher than that of the original Cruise Package, the difference in price and any insurance premium will be borne exclusively by the Passenger.  If the price of the new Cruise Package is lower than that of the original Cruise Package, no refund will be due to the Passenger.

MSC Cruises Canada recommends that every Passenger should have adequate insurance, which covers them sufficiently for cruise cancellation, medical assistance and expenses, and loss and/or damage to luggage. 

Cancellations By Passenger

Cancellation of the Booking must be requested in writing (registered letter, email or fax) from the Passenger or Passenger’s Travel Agent and received by the Company. All tickets issued and the confirmation invoice must be returned together with the notice of cancellation.  To cover the estimated loss incurred by cancellation, the Company will levy cancellation charges in accordance with the following scale:

** “no-show” upon departure or breaking of Cruise Package (disembarkation prior to termination of the voyage) shall be considered as a cancellation made on the day of departure subject to a 100% cancellation charge.

Cancellation charges are assessed on total fares (excluding taxes), which include cruise fare, air add-ons, hotel packages and any other additional services arranged through MSC Cruises, S.A. or MSC Cruises Canada. Please note that hotels have their own cancellation policies and charges. 

In case of a partial Booking cancellation whereby one or more Passengers have cancelled their Cruise Package, leaving one Passenger to occupy the cabin after the cancellation of the other Passenger(s), the remaining Passenger occupying the cabin for single use will be assessed a 100% single surcharge.

It may be possible for the Passenger to claim these cancellation charges from his/her travel insurance provider, subject to any applicable deductibles. It is the Passenger’s responsibility to make such a claim under the terms of his/her insurance policy. Neither Carrier nor Company have any liability under the travel insurance policy in the event of cancellation. 

The Company may, in its sole discretion, waive the fees mentioned in this Section 13 if in the Company’s determination the cancellation is due to Force Majeure circumstance occurring at the place of destination or its immediate vicinity and which Force Majeure circumstance significantly affects the performance of the Cruise Package, or which significantly affects the carriage of Passengers to the destination.

From time to time, the Company may offer a discounted fare with non-refundable deposit. This deposit does not follow the above cancellation policy and takes immediate effect upon transaction. 

No refund will be issued if a Passenger voluntarily or involuntarily does not show up for their cruise, is denied boarding for any reason including failure to provide required travel documents, passport or visa, terminates his/her cruise before the scheduled disembarkation date, or is disembarked pursuant to Section 7 or 18. Cruise contracts are non-transferable.  

Booking changes effected by the company

Cancellation by the company.

The Company reserves the right to cancel any Cruise Package at any time for any reason by giving written notice to the Passenger. In such cases the Company will offer the Passenger the choice of (a) receiving a full refund of all monies paid; (b) booking another Cruise Package from the Company’s brochure and/or from the Official Website of equivalent quality at no extra cost, if available; or (c) booking another Cruise Package from the Company’s brochure and/or from the Official Website of lower quality, if available, with a refund of the difference in price. In no event shall the Company or Carrier be liable for any consequential damages or other damages as a result of such cancellation. The Company reserves the right to reject or cancel any new Bookings made by or on behalf of former Passengers who, during a previous Cruise Package (a) behaved in a manner dangerous to themselves, other Passengers and/or crew members; (b) damaged and/or endangered the Company’s assets; (c) failed to resolve outstanding debts owed to the Company; (d) violated the Booking Terms and Conditions or Conditions of Carriage; or (e) for any other reason in the sole discretion of the Company.

The company's liability

Itinerary / right to change, passenger's responsibility.

18.1 The Passenger has a duty to follow the instructions and orders of the master and Officers while onboard. The Passenger hereby accepts and agrees that the master and officers are entitled and have authority to inspect any person on board, any cabin, baggage and belonging for safety, security or other lawful reasons. 18.2 The Passenger hereby expressly agrees to allow any such search. 18.3 Passengers must have received all necessary medical inoculations prior to the Cruise and have in their possession all tickets, valid passports, visas, medical cards and any other documents necessary for the scheduled ports of call and disembarkation. 18.4 Each Passenger warrants that he/she is physically and mentally fit to undertake the Cruise. 18.5 The Carrier and/or the master have the right of refusing the boarding or order the disembarkation of any Passenger should they deem it necessary, for the safety, security, of the Passenger, of the other Passengers or of the ship or should the Passenger’s conduct which, in the reasonable opinion of the master, is likely to endanger or impair the comfort and enjoyment of other Passengers onboard. 18.6 No Passenger shall bring any animals whatsoever, except for recognized service dogs, subject to clause 7 above. 18.6 the Company and/or the Carrier will be under no liability whatsoever to any Passenger in respect of any breach or non-observance by any Passenger of the provisions of this clause and any Passenger shall indemnify the Carrier and the Company against any loss or damage occasioned to the Carrier or the Company or any of its suppliers by such breach or non-observance. 18.7 Passenger’s behaviour must not affect and reduce the safety, peace and enjoyment of the Cruise by other Passengers. 18.8 It is strictly forbidden for Passengers to carry firearms, ammunition, explosives or flammable, toxic or dangerous substances, goods or articles on-board any Vessels which could be dangerous for the safety of Passengers and the Vessels. 18.9 Passengers shall be liable for any damage suffered by the Company and/or the Carrier and/or any supplier of any service that forms part of the Holiday Package as a result of the Passenger’s failure to comply with his contractual obligations. In particular, the Passenger shall be liable for all damages caused to the vessel or its furnishings and equipment, for injury or loss to other Passengers and third parties, and also for all penalties, fines and expenses attributable by the Passenger that the Company, Carrier or supplier may be liable to pay. 18.10 Passengers are not allowed to sell and/or purchase from other passengers or travel operators on board the ship any type of commercial services – including but not limited to shore excursions – which are not official offered by the Company or its agreed independent contractors.

23.1     No variation of these terms shall be effective unless in writing and signed by the Company.

Smoking policy

Liability of employees servants and subcontractos.

In addition to the other liability and damage limitations provided in this Passage Contract, the liability (if any) of the Company for damages suffered as a result of death, personal injury, emotional distress to the Passenger, or loss or damage to luggage shall be subject to the following limitations and shall be determined in accordance with the following:  (A) Voyages not including a U.S.A. port: The International Convention relating to the Carriage of Passengers and their luggage by Sea, adopted in Athens on 13 December 1974 and (the "Athens Convention"), as subsequently amended in 2002 and as incorporated with effects from 1 January 2013 by EU Regulation 392/2009 Concerning the Rights of Passengers when travelling by sea in the event of Accidents (EU Regulation 392/2009), shall apply to international carriage by sea where the port of embarkation or disembarkation is in the EU or where the vessel has an EU flag, or where the contract of carriage is made in the EU. . The provisions of the Athens Convention and, where applicable, EU Regulation 392/2009 are hereby expressly incorporated into these conditions of carriage. Copies of the Athens Convention and EU Regulation 392/2009 are available on request and can be downloaded from the Internet at www.imo.org. The Carrier shall be entitled to the benefit of all the limitations, rights and immunities provided by the Athens Convention and, where applicable, EU Regulation 392/2009 including the full deductible under Article 8(4) of the Athens Convention. The liability of the Carrier for death, personal injury or illness to the Passenger shall not exceed 46.666 Special Drawing Rights ("SDR") (*approx. $69,365) as provided and defined in the Athens Convention or, where applicable, the maximum sum of 400,000 SDR (*approx. $594,567) pursuant to EU Regulation 392/2009 and, where there is liability for war and terrorism, 250,000 SDR (*approx. $371,604). Liability of the Carrier for loss of or damage to Passenger's luggage or other property shall not exceed 833 SDR (*approx. $1,238) per Passenger under the Athens Convention or 2,250 SDR (*approx. $3,344) where EU Regulation 392/2009 applies. It is agreed that such liability of the Carrier shall be subject to a deductible of 13 SDR (*approx. $19) per Passenger, such sum to be deducted from the loss or damage to luggage or other property. The Passenger understands that the conversion rate of SDR's fluctuates daily and may be obtained from a bank or Internet. The value of an SDR can be calculated by visiting http://www.imf.org/external/np/fin/data/rms_five.aspx . The approximate U.S. dollar conversions of the SDR amounts stated herein and noted with an asterisk symbol “*” are based on the exchange rate as of October 13, 2014. If any provision of these Conditions of Carriage is rendered null and void by the Athens Convention or EU Regulation 392/2009, such invalidity shall be limited to the particular clause and not to the Conditions of Carriage. The Carrier’s liability in relation to death and/or personal injury is limited and shall in no circumstances whatsoever exceed the limits of liability set out under the Athens Convention or, where applicable, EU Regulation 392/2009. The Carrier will only be liable in relation to death and/or personal injury and/or loss of or damage to luggage in the event that the Carrier and/or its servants or agents are guilty of “fault or neglect”, as required by Article 3 of the Athens Convention, or where there is liability for a shipping incident, where EU Regulation 392/2009 applies. The limits of liability under the terms of the Athens Convention shall be applicable to the Carrier’s servants and/or agents and/or Independent Contractors in accordance with Article 11 of the Athens Convention. Any damages payable by the Carrier shall be reduced in proportion to any contributory negligence by the Passenger as provided in Article 6 of the Athens Convention. Further information on these important liability limitation statutes, laws and Conventions can be found at http://europa.eu/legislation_summaries/transport/waterborne_transport/tr0018_en.htm  (B) Voyages including a U.S.A. port: (i) Where U.S.A. law applies under this contract, the liability for death, personal injury and emotional distress to a Passenger shall not exceed the limitations set out in all applicable provisions of Title 46 of the United States Code, including but not limited to 46 U.S.C. § 30509, the Limitation of Liability Act, 46 U.S.C. § 30501 et. seq., and the Death on the High Seas Act, 46 U.S.C. § 30301 et. seq.. (ii)The Company's liability for loss or damage to Passenger's luggage or other property shall not exceed US $100 per Passenger, unless a higher limit is agreed upon in writing before departure and an extra charge for declared value protection is paid as set out below in 24C(ii).  (C) All Voyages: (i) The Company shall not be liable for loss or damage to any valuables such as monies, negotiable securities, precious metal items, jewelry, previous stones, art, cameras, computers, electronic equipment, or any other valuables unless they are deposited with the Company for safe-keeping, and a higher limit is agreed expressly and in writing at the time of deposit, and an extra charge is paid by the Passenger for declared value protection. (ii) Extra charges are: 1% of declared value for a Voyage 1 to 7 days; 2% of declared value for a Voyage 8 to 21 days; 3% of declared value for a Voyage 22 days and over. If the value of any luggage or property is misrepresented, the Company's liability for loss or damage to the property shall not exceed U.S. $100. (iii) The Company and Passenger agree not to demand any security from the other in connection with a claim of any kind. The Passenger waives the right to arrest the Cruise Ship or any other ships owner, operated or chartered by the Company, or to attach any other asset owned, chartered or operated by the Company. If the Cruise Ship is arrested or attached, then the ship and the Company shall have the right to any limitation and all defenses available herein and the Passenger causing such arrest shall be liable to the Company for all lost revenue and other losses or claims that arise from, relate to, or are incident to such arrest. Any action against the Company must be brought as an individual action and Passengers waives any right to initiate or participate in any class action or other lawsuit brought in a representative capacity on behalf of others. In the event more than one liability limitation or exoneration statute, Convention, treaty or provision of this Agreement applies, the Company shall be entitled to take advantage of whichever provision(s) afford the greatest protection to Company.

Law and Jurisdiction

26.1     The present contract is governed by laws of the Province of Ontario. Should any dispute arise on the interpretation or application of the present contract, it will be deferred to the Court of Ontario to be considered has having exclusive jurisdiction on every dispute. 

Errors, Omissions and Changes

28.1     Every effort has been made to ensure accuracy of the Company’s brochure and/or of the Official Website content but certain changes and revisions may take place after the printing of the Company’s brochure and/or the publishing of the Official Website.

Since the Booking Terms & Conditions applicable to the single Cruise or Holiday Package are those in force at the time of completing the Booking, irrespective of those published in the relevant Company’s brochure, it is recommended to check with the Sales Agent or by visiting the Company’s  Official website for the most up to date Booking Terms & Conditions.

Definitions

“Booking” means the steps taken by the Passenger to enter into a Contract with the Company. “Booking Terms & Conditions” means these terms and conditions and the information contained in the relevant Company’s brochure, the Official Website and/or other information which will form the express terms of your Contract with the Company. “Carrier ” means the entity who has undertaken the obligation to carry the Passenger from one place to the other as indicated in the Cruise ticket, airline ticket or other ticket issued for any other applicable transport and is thereby indicated on such documents as “carrier”. Carrier includes the owner and or charterer and or operator and or manager and their servants and or agents. “Company” means MSC Cruises SA, whose registered address is Avenue Eugéne-Pittard 16 1206 Geneva, who organizes Holiday Packages and sells or offers them for sale, whether directly or through a Sales Agent. “Conditions of Carriage” means the terms and conditions under which the Carrier provides transport either by air, road or sea. The Conditions of Carriage may refer to the provisions of the law of the country of the Carrier and/or international conventions which may limit or exclude the liability of the Carrier. Copies of the Conditions of Carriage of any Carrier are available to the Passengers upon request. “Contract” means the contract concluded between the Company and the Passenger relating to the relevant Holiday Package which is evidenced by the issue of the confirmation invoice sent by the Company or its Sales Agent to the Passenger. “Cruise” means the transport by sea and the stay onboard a MSC Cruises vessel (as described in the relevant Company’s brochure, the Official Website or other documentation produced for or on behalf of the Company) as well as, depending on the Cruise itinerary, the call and the duration of any stay on the Ocean Cay – MSC Marine Reserve, operated by the Company. A Cruise – if not purchased with pre- or post-Cruise services – can be considered by itself as a Holiday Package. “Disabled Passenger” or “Passenger with Reduced Mobility” ; means any Passenger whose mobility when using transports is reduced as a result of any physical disability (sensory or locomotor, permanent or temporary), intellectual or psychosocial disability or impairment, or any other cause of disability or impairment or as a result of age, and whose situation needs appropriate attention and adaptation to his/her particular needs for the services made available to all Passengers. “Unavoidable and Extraordinary Circumstances” means any unforeseeable and unpredictable event out of the Carrier’s or the Company’s control including Acts of God (such as, flood, earthquake, storm, hurricane or other natural disasters), war, invasion, act of foreign enemies, hostilities (regardless of whether war is declared), civil war, rebellion, revolution, insurrection, military or usurped power or confiscation, terrorist activities, riots, civil disturbances, industrial disputes, natural and nuclear disasters, fire, epidemics, health risks, nationalisation, government sanction, blockage, embargo, labour dispute, strike, lockout or interruption or failure of electricity or telephone service and/or any unforeseen technical problems with transport including changes due to rescheduling or cancellation or alteration of flights, closed or congested airports or ports. "Combined Tour" means the combination of two or more Cruises prearranged by the Company and offered for sale as a single Holiday Package. For any relevant purposes, the Combined Tour shall always be considered as a single and indivisible Holiday Package. All terms and references to a Cruise and or Holiday Package shall include and be equally applicable to a Combined Tour unless otherwise stated. References to price are references to the total price paid for the Combined Tour “Holiday Package” means the Cruise whether or not in combination with flight(s) and/or any pre- and/or post-Cruise arrangement for accommodation. It includes, depending on the Cruise itinerary, the call and the duration of any stay on the Ocean Cay – MSC Marine Reserve, operated by the Company. It does not include Shore Excursions or shuttle services which do not form part of the inclusive Holiday Package price. “Official Website” means the set of related web pages, documents and hypertext links served from the web domain www.msccruises.ie “Passenger” means each and every person, including minors, named either on the Booking confirmation or on the invoice or on a ticket issued by the Company. “Sales Agent” means the person or travel agency that sells or offers for sale the Holiday Package put together by the Company, on its own or on behalf of the Company. “Shore Excursion” means any excursion, trip or activity ashore that is not included as part of the all-inclusive price of the Holiday Package and is offered for sale by the Company onboard its vessels. “World Cruise” means the tour of the world prearranged by the Company and offered for sale as a single Holiday Package. For any relevant purposes, the World Cruise shall always be considered as a single and indivisible Holiday Package. All terms and references to a Cruise and or Holiday Package shall include and be equally applicable to a World Cruise unless otherwise stated. References to price are references to the total price paid for the World Cruise.

1. Booking Procedure and Deposit

3.1 No change to the Holiday Package price will be made within the 20-day period before departure or once full payment has been received by the Company.

3.2 The Company reserves the right to modify the Contract price at all times prior to those detailed in 3.1 above to allow variations for:

a) Air transportation costs;

b) Fuel costs for the propulsion of the vessel;

c) Dues, taxes or fees chargeable for services such as embarkation or disembarkation fees at ports or airports.

Variations may be upwards or downwards. For paragraph a) any variation of the Holiday Package price will be equal to the extra amount charged by the airline. For paragraph b) any variation of the Holiday Package price will be equal to 0.33% of the price of the Cruise for every dollar of increase of the fuel per barrel (NYMEX Index). For paragraph c) any variation of the Holiday Package price will be equal to the full amount of the fees.

3.3 If the increase would be 2% or less of the holiday price shown on the Passenger’s Confirmation Invoice (excluding insurance premiums and any amendment charges), the Company will absorb the changes in its costs and will only pass on to the Passenger any increase above that level. If any change in the Company’s costs would cause a reduction in the Passengers holiday price, the Company will not make refunds of amounts less than 2% of Passenger’s holiday price but it will refund in full amounts exceeding such 2% after deducting an administration charge of €25.00.

3.4 If the increase in the Holiday Package price amounts to more than 8% on the total Holiday Package price at the time of Booking, the Passenger will be entitled to cancel the Contract with a full refund of the Holiday Package price within the limits and to the extent of the amount effectively paid by the Passenger at the time of cancelation. Such right of refund does not include insurance premiums paid which are in no case refundable.

3.5 To exercise the right to cancel the Passenger must notify the Company in writing within 7 days of receiving the price increase notification.

4. Insurance

7.1 The Company’s and the Carriers’ priority is always the comfort and safety of its Passengers and in order to achieve this the Passenger is asked at the time of Booking to provide as much detail as possible of the matters given below so that the Company and Carrier can consider its obligation to carry the Passenger in a safe or operationally feasible manner, taking into account any issues relating to the design of the passenger ship or port infrastructure and equipment including port terminals which may make it impossible to carry out the embarkation, disembarkation or carriage of the Passenger which may have an impact on the Passengers safety and comfort.

7.2 The Passenger is asked to provide full details at the time of Booking if the Passenger:

a) Is unwell, infirm, has a disability or has Reduced Mobility;

b) If the Passenger requires a special Disabled cabin, since there is a limited number of these available and since the Company would like to, wherever possible, accommodate the Passenger so that the Passenger is comfortable and safe for the duration of the Cruise;

c) If the Passenger has any special seating requirements;

d) If the Passenger needs to bring any medical equipment on board;

e) If the Passenger needs to bring a recognised assistance dog on board the vessel (please note that assistance dogs are subject to national regulations).

7.3 Where the Company and/or the Carrier consider strictly necessary for the safety and comfort of the Passenger and in order for the Passenger to fully enjoy the Cruise, it may require a Passenger with reduced ability or a Passenger with Reduced Mobility to be accompanied by another person who is capable of providing the assistance required by the Disabled Passenger or Passenger with Reduced Mobility. This requirement will be based entirely on the Company and/or the Carrier assessing the need of the Passenger on grounds of safety and may vary from vessel to vessel and/or itinerary to itinerary. Passengers confined to a wheelchair are asked to kindly furnish their own standard size collapsible wheelchair during the whole Holiday Package and might also be requested to be accompanied by a travelling Passenger fit and able to assist them.

7.4 If the Passenger has any particular condition, Disability or Reduced Mobility which require personal care or supervision then such personal care or supervision must be organized by the Passenger and at the Passenger’s expense. The vessel is unable to provide respite services, one-to-one personal care or supervision or any other form of care for physical or psychiatric or other conditions.

7.5 If after careful assessing the Passenger’s specific needs and requirements, the Company and/or the Carrier concludes that the Passenger cannot be carried safely and in accordance with applicable safety requirements then the Company can refuse to accept a Booking or embarkation of a Disabled Passenger or Passenger with Reduced Mobility on the grounds of safety.

7.6 The Company reserves the right to refuse to carry any Passenger who has failed to adequately notify the Company of any disabilities or needs for assistance in order for the Company and/or the Carrier to make an informed assessment that the Passenger can be carried in a safe or operationally feasible manner on the grounds of safety. If the Passenger does not agree with a decision of the Company under clauses 7.5 to 7.6 of these Booking Terms & Conditions then the Passenger must provide a complaint in writing with all supporting evidence to the Company.

7.7 The Company reserves the right to refuse to carry any Passenger who in the opinion of the Company and/or the Carrier is unfit for travel or whose condition may constitute a danger to themselves or others on the Cruise on the grounds of safety.

7.8 For the safety and comfort of the Passenger, if the Passenger becomes aware between the date of Booking the Holiday Package and the date of commencement of the Holiday Package that he/she will require special care or assistance as detailed above, the Passenger is asked to inform the Company immediately so that the Company and the Carrier can make an informed assessment whether or not the Passenger can be carried in a safe or operationally feasible manner.

7.9 Disabled Passengers or Passengers with Reduced Mobility may not be able to go ashore at ports where vessels do not berth alongside. A list of these ports is available upon written request.

7.10 In some ports, it is necessary to anchor offshore rather than alongside. When this is the case, the Carrier will use a tender to take Passengers ashore. A tender is a small vessel and may not be suitable for people with Disabilities or Reduced Mobility or balance problems. When using tenders, safety is the utmost priority. It is important that Passengers are able to use the tender safely. Passengers may be required to descend to a platform or pontoon and into the tender. There may be steps both up and down and Passengers may need to navigate a gap between the platform and the tender (which can be approximately 1.5ft). Depending on weather, tide and sea conditions, there may be some movement, which could change throughout the course of the day. Passengers must be fit and mobile enough to access and disembark the tender. If Passengers have impaired mobility, or use a mobility aid such as a stick, then they must carefully consider their ability to embark the tender safely before making their way down to the platform. Passengers must take into consideration the use of steps, the possibility of a gap and height difference between the platform and the tender, and the potential sudden movement of the tender when making a decision. Wheelchairs and mobility scooters, will not be carried by the crew into the tender. All Passengers must be independently mobile enough to use the tenders. Ultimately, carriage by tender may be refused by the master or any of his officers if there is any doubt as to the safety of any Passenger.

All Passengers must take extra care when stepping on and off the tender. There will be crew members there to guide and steady Passengers as they embark and disembark but they cannot support, lift or carry Passengers. The same precautions apply when Passengers disembark the tender in the port.

8. Public Health Questionnaire

8.1 The Company and/or the Carrier and/or the health authorities in any port shall be entitled to administer a public health questionnaire on their own behalf. The Passenger shall supply accurate information regarding symptoms of any illness including but not limited to gastrointestinal illness and H1N1. The Carrier may deny boarding to any Passenger that it considers in its sole discretion to have symptoms of any illness including viral or bacterial illness including but not limited to Norovirus and H1N1. Refusal by a Passenger to complete the questionnaire may result in denied boarding. 8.2 Where Passengers become ill during the Cruise with viral or bacterial illness the ship’s doctor may request them to remain in their cabin for reasons of safety. Passengers must follow the instructions of the Carrier and refusal to do so may result in disembarkation without any liability for damages or a refund on the Company or the Carrier.

9. Food Allergies

10.1 Passengers are strongly recommended to have comprehensive travel health insurance covering medical treatment and repatriation costs and expenses.

10.2 In compliance with Flag State requirements, there is a qualified doctor onboard and a medical centre equipped for first aid and minor conditions only. The Passenger hereby acknowledges and accepts at the time of Booking that the medical center is not equipped as a land based hospital and the doctor is not a specialist. Neither the Company, nor the Carrier, nor the doctor shall be liable to the Passenger as a result of any inability to treat any medical condition as a result.

10.3 The Passenger acknowledges that whilst there is a qualified doctor onboard the vessel, it is the Passenger’s obligation and responsibility to seek medical assistance if necessary during the Cruise and will be responsible to pay for onboard medical services.

10.4 In the event of illness or accident, Passengers may have to be landed ashore by the Carrier and/or the master for medical treatment. Neither the Carrier nor the Company make any representation or accept any responsibility regarding the quality of the available medical facilities or treatments at any port of call or at the place at which the Passenger is landed. Medical facilities and standards vary from port to port. Neither the Company nor the Carrier makes any representations or warranties in relation to the standard of medical treatment ashore.

10.5 The doctor’s professional opinion as to the fitness of the Passenger to board the vessel or to continue the Cruise is final and binding on the Passenger.

10.6 It is recommended that medical advice is sought before Booking for children up to 12 months of age. For the avoidance of doubt the provisions of clause 6 and the requirement of fitness to travel is applicable to all Passengers including infants.

11. Medical Equipment

112.1 The Passenger is entitled to transfer his/her Booking to a third party, provided that: (i) said third party satisfies all the conditions for the use of the Contract; and (ii) written notice is duly sent to MSC Cruises no later than 7 working days before departure of the Cruise. If the conditions stated above in this clause are met, the name change will in any case be subject to a fee of €50 per change, reflecting the costs for the Company of effectuating the transfer, see clause 12.3 below. Name changes requested within 7 days of the departure will be considered as cancellation. The Passenger and the third party contract assignee shall be jointly liable to MSC Cruises to pay the price of the Contract and any additional cost that may arise as a consequence of the change in Passenger. 12.2 Furthermore, even after the confirmation invoice has been issued, the Passenger is also entitled to exchange, once only, the purchased Holiday Package (“Original Holiday Package”) with another Holiday Package (“New Holiday Package”) on the following conditions: i. the date of departure of the New Holiday Package is later than that of the Original Holiday Package; ii. the request for the substitution of the New Holiday Package in place of the Original Holiday Package is received by MSC Cruises not later than 30 days before the date of the scheduled departure of the Original Holiday Package and there is availability of spaces on the New Holiday Package; iii. the expected date of departure of the New Holiday Package falls within 90 calendar days from the expected date of departure of the Original Holiday Package. If the conditions stated above in this clause are met, the substitution of the Original Holiday Package with the New Holiday Package will in any case be subject to the following administration fee per Passenger: BELLA: €50 per person FANTASTICA, AUREA, YACHT CLUB: One Free of Charge* WORLD CRUISE: Loss of deposit equal to 15% of holiday package as per section 12.8 *Any change to a date that is more than 90 calendar days from the original departure date will result in a fee of €50 per person. Any subsequent departure date change will result in a fee of €50 per person. It is understood that, in addition to the administration fee mentioned above, if the price of the New Holiday Package is higher than that of the Original Holiday Package, the difference in price as well as in insurance premium will be borne exclusively by the Passenger. On the other hand, if the price of the New Holiday Package is lower than that of the Original Holiday Package, no reimbursement will be due to the Passenger. In case of substitution of the Original Holiday Package with the New Holiday Package, the Passenger will still be entitled to withdraw from the Contract and therefore cancellation fees will apply; cancellation fees will be based on the price due (as per above provisions) and the scale provided under clause 13 (Cancellation by the Passenger) according to the Original Holiday Package departure date. MSC Cruises will make reasonable endeavours to comply with the Passenger requests for changes to flight, transport or other services arrangements and adapt them to the New Holiday Package. In no case whatsoever will MSC Cruises be held liable for change requests that cannot be satisfied. 12.3 Name or date changes are not always allowed by air Carriers and other transport or services providers whenever they are made. Most air Carriers and other transport or services providers treat such changes as a cancellation and charge accordingly. Any additional costs including cancellations fees and/or increased prices levied by air Carriers or other third-party providers will be exclusively for the Passenger’s account and be charged as a part of the additional cost mentioned in clause 12.1 (ii) above. 12.4 Save as provided above, other changes to the Booking may be requested (even after the confirmation invoice has been issued) until 63 days prior to departure, subject to a minimum administration fee of €25.00 per person per amendment. Any additional costs that may arise as a consequence of the change will be exclusively for the Passenger’s account. 12.5 Requests of amendments to the Booking received by MSC Cruises beyond the above time limits will be treated as cancellations and the cancellation charges detailed in clause 13 below will apply. 12.7 Any changes requested by the Passenger on a Combined Tour shall always apply to the whole Holiday Package. All the relevant time limits run from the scheduled date of departure of the first Cruise of the Combined Tour. 12.8 Any change request related to the World Cruise shall be permitted exclusively for another World Cruise and, in such case, will trigger the loss of the non-refundable deposit equal to 15% of the price of the Package paid by the passenger. 13. Cancellation by the Passenger 13.1 Cancellation of the Booking must be requested in writing (registered letter, email to or fax) to the Company or via the Passenger’s Sales Agent. All tickets issued and the confirmation invoice must be returned together after the notice of cancellation. The cancellation notice must be sent to the Company at least one working day before departure within 3pm GMT. 13.2 Save what set forth in clause 13.3 below, to cover the estimated loss incurred by cancellation, the Company will levy cancellation charges in accordance with the following scale: Cruises <15 nights 63 days before departure - deposit 62 to 42 days before departure - 25%* 41 to 29 days before departure - 40%* 28 to 15 days before departure - 60%* 14 to 6 days before departure - 80%* 5 to 0 days before departure** - 100%* Cruises >15 nights 93 days before departure - deposit 92 to 72 days before departure - 25%* 71 to 59 days before departure - 40%* 58 to 45 days before departure - 60%* 44 to 15 days before departure -80%* 14 to 0 days before departure ** - 100%* * or loss of deposit whichever is greater. ** “no-show” upon departure and Holiday Package breaking shall be dealt as a cancellation made on the day of departure. WORLD CRUISE 2024, and 2025 60 days or longer before departure 15% of holiday package* 59-10 days prior departure 75% of holiday package* 9-0**days prior departure 100% of holiday package YACHT CLUB (for all cruises) 63 days or longer - Deposit 62-42 days before departure - 25% of holiday package* 41-29 days before departure - 40% of holiday package* 28-15 days before departure - 60% of holiday package* 14-6 days before departure - 80% of holiday package* 5-0 days before departure - 100% of holiday package * or loss of deposit whichever is greater. ** “no-show” upon departure and Holiday Package breaking shall be dealt as a cancellation made on the day of departure.

13. Cancellation by the Passenger

14. booking changes effected by the company.

14.1 Arrangements for the Cruise are made many months in advance by MSC Cruises. Very occasionally it may be necessary to alter them; therefore, MSC Cruises expressly reserves the right to change the arrangements for the Cruise, as does the Company for the Holiday Package, should such changes become necessary or advisable for operational, commercial or safety reasons.

14.2 The Company has the right to assign another cabin for the Passenger, as long as it has similar characteristics. If there is a change in accommodation to a lower-priced cabin, the Passengers affected by such change will be entitled to a refund of the price difference, according to the current rates.

14.3 Most changes are minor but occasionally MSC Cruises or the Company must make a significant change. The following are examples of significant changes when made before you go on the Cruise: A change in the time Passengers are due to leave Ireland to go on the Cruise or the time Passengers are due to come back to Ireland after the Cruise of more than 12 hours. A change of cabin accommodation to a significantly lesser grade. A significant change to the itinerary. i.e. when the itinerary has to be changed by more than 50% and may have to exclude an iconic highlight. All changes which are not significant are treated as minor changes and therefore there is no right to cancel or to claim compensation. Please note: MSC Cruises and the Company do not classify a change of air or sea port as a significant change where coach transfers between a Irish town and the relevant air/sea port are included in the holiday. A change of flight from direct to indirect is not classified as a significant change. In the event of a significant alteration to an essential term of the Contract, MSC Cruises or the Company will inform the Passenger or his/her Agent of such change in writing as soon as reasonably possible. If there is time to do so before departure, we will offer you the choice of one of the following

a) Accepting the alteration; or

b) Booking another Holiday Package from the Company’s brochure and/or from the Official Website of equivalent or superior quality, if available; or

c) Booking another Holiday Package from the Company’s brochure and/or from the Official Website of lower quality, if available, with a refund of the difference in price; or

d) Cancelling and receiving a full refund of all monies paid.

14.4 Passengers must notify the Company of their decision in writing or via their Agent within 7 days of receiving the notification of alteration or the period indicated. A failure to revert within this period will result in the alteration being accepted and any cancellations after this period shall attract cancellation charges in accordance with clause 13.2,3.

14.5 If MSC Cruises or the Company has to make a significant change or cancel before departure, MSC Cruises or the Company, where compensation is appropriate, will reimburse of all monies paid to MSC Cruises or the company as set out in clause 15.1 depending on the circumstances and when the significant change or cancellation is notified to the Passenger, subject to the following exceptions listed below compensation will not be payable and no liability beyond offering the above mentioned choices can be accepted where MSC Cruises or the Company is forced to make a change or cancel as a result of unusual or unforeseeable circumstances beyond our control, the consequences of which MSC Cruises or the Company could not have avoided with all due care .

14.6 No compensation is payable for minor changes and MSC Cruises and the Company cannot accept liability for expenses that may be incurred if Passengers have to change or cancel any arrangements they might have made before the minor change was notified to them before departure.

14.7 Very rarely, MSC Cruises (or the Company) may be forced to change or terminate a Cruise (or Holiday Package) after departure but before the scheduled end of the Cruise (or Holiday Package) as a result of Unavoidable and Extraordinary Circumstances. In particular, when unexpected events such as extreme weather, civil strife or other Force Majeure events occur, MSC Cruises may be required to act to protect the safety of its Passengers. This may require MSC Cruises or the Company to either make substantial alterations to an itinerary, or in extreme cases make urgent arrangements to repatriate customers to the United Kingdom or the port where the Cruise was scheduled to end. If this situation does occur, MSC Cruises and the Company regrets it will be unable to pay Passengers any compensation or meet any costs or expenses incurred by Passengers as a result.

14.8 If, after departure, MSC Cruises or the Company is unable to provide a significant proportion of the services it agreed to provide as part of its Contract or Holiday Package (respectively) with Passengers, MSC Cruises or the Company will do their very best to make suitable alternative arrangements for the services which have not been provided. If MSC Cruises or the Company cannot do so or Passengers refuse to accept these for good reasons, MSC Cruises or the Company will arrange to fly Passengers back to their Irish departure airport (if the arrangements MSC Cruises and the Company agreed to provide included Irish flights) or to transport Passengers to the final disembarkation port as soon as reasonably possible.

14.9 In some circumstances, Passengers may be entitled to the difference in price between the Cruise contracted for and that provided. Refunds will be made for shore excursions not performed.

14.10 Passengers also have rights in certain circumstances which includes refunds and transportation. The circumstances in which these rights apply and the rights are set out in the Passenger Bill of Rights which is on our website. Once a Cruise or Holiday Package has been completed, and it is impossible to ensure the Passenger's return to their departure point as agreed in the Contract because of unavoidable and extraordinary circumstances, the Company shall bear the cost of necessary accommodation, if possible of equivalent category, for a period not exceeding three nights per traveller. Where longer periods are provided for in EU passenger rights legislation applicable to the relevant means of transport for the traveller's return, those periods shall apply.

15. Cancellation by the Company

15.1 The Company reserves the right to cancel any Holiday Package at any time by giving written notice to the Passenger but shall not be liable for additional compensation, if:

(i) the cancellation is due to an event of Unavoidable and Extraordinary Circumstances and/or any unusual /or unforeseeable circumstances beyond the Company’s control, the consequences of which could not have been avoided by the Company even though it has exercised all due care;

(ii) the number of persons enrolled for the Holiday Package is smaller than the 50% of the passenger capacity of the relevant ship.

In both cases above, the Company will offer the Passenger the choice of:

a) Receiving a full refund of all money paid; or

b) Booking another Holiday Package from the Company’s brochure and/or from the Official Website of equivalent or superior quality at no extra cost, if available; or

c) Booking another Holiday Package from the Company’s brochure and/or from the Official Website of lower quality, if available, with a refund of the difference in price.

15.2 The Passenger’s decision must be notified to the Company in writing or via their Sales Agent within 7 days of the notice of cancellation or otherwise instructed by the Company communication.

15.3 Without prejudice to the above, the Company reserves the right to reject or cancel new bookings made by or on behalf of former Passengers who, during a previous Holiday Package:

behaved dangerously for their safety and/or the one of other Passengers and/or crew members;

damaged and/or endangered Company’s assets;

did not solve outstanding debts with the Company;

violated art. 18 of the present Booking Terms and Conditions.

The Passenger will be informed of the rejection or cancellation made under the present article in writing.

27.1 Every effort has been made to ensure accuracy of the Company’s brochure and/or of the Official Website content but certain changes and revisions may take place after the printing of the Company’s brochure and/or the publishing of the Official Website. Since the Booking Terms & Conditions applicable to the single Cruise or Holiday Package are those in force at the time of completing the Booking, irrespective of those published in the relevant Company’s brochure, it is recommended to check with the Sales Agent or by visiting the Company’s Official website for the most up to date Booking Terms & Conditions.

THESE ARE THE TERMS AND CONDITIONS, WHICH APPLY TO YOUR HOLIDAY PACKAGE. PLEASE READ THEM CAREFULLY AS YOU WILL BE BOUND BY THEM.

Roles of the parties

Definitions.

In these Booking Terms & Conditions the following expressions shall have the meanings defined hereunder:

“ Agent ” means the person or travel agency that either sells or offers for sale the Travel Service(s) and Holiday Packages to you on its own behalf as a principal and an organiser; or makes available the Travel Services and Holiday Packages as an agent of MSC Cruises.

“ Booking ” means the steps taken by the Passenger to purchase Travel Service(s) or a Holiday Package, upon which the Passenger will enter into a Contract with MSC Cruises for the supply of the Travel Service(s) or Holiday Package.

“ Booking Terms & Conditions ” means these terms and conditions and the information contained in brochures, the Official Website and/or other information which will form the express terms of your Contract with MSC Cruises.

“ Carrier ” means the entity who has undertaken the obligation to carry the Passenger from one place to the other as indicated in the Cruise ticket, airline ticket or other ticket issued for any other applicable transport and is thereby indicated on such documents as “carrier”. Carrier includes the owner and or charterer and or operator and or manager and their servants and or agents.

“ Conditions of Carriage ” means the terms and conditions under which the Carrier provides transport either by air, road or sea. The Conditions of Carriage may refer to the provisions of the law of the country of the Carrier and/or international conventions which may limit or exclude the liability of the Carrier. Copies of the Conditions of Carriage of any Carrier are available to the Passengers upon request.

“ Contract ” means the contract concluded between MSC Cruises and the Passenger relating to the relevant Travel Service(s) or Holiday Package and which is evidenced by the issue of the confirmation invoice sent by MSC Cruises or the Agent to the Passenger.

“ Cruise ” means the transport by sea and the stay on-board a MSC Cruises vessel (as described in the relevant brochure, the Official Website or other documentation produced for or on behalf of MSC Cruises) as well as, depending on the Cruise itinerary, the call and the duration of any stay on the Ocean Cay – MSC Marine Reserve, operated by MSC Cruises. A purchase of a Cruise on its own is the purchase of a Holiday Package.

“ Disabled Passenger ” or “ Passenger with Reduced Mobility ”; means any Passenger whose mobility when using transports is reduced as a result of any physical disability (sensory or locomotor, permanent or temporary), intellectual or psychosocial disability or impairment, or any other cause of disability or impairment or as a result of age, and whose situation needs appropriate attention and adaptation to his/her particular needs for the services made available to all Passengers.

" Unavoidable and Extraordinary Circumstances " means any unforeseeable and unpredictable event out of the Carrier’s or MSC Cruises’ control including Acts of God (such as, flood, earthquake, storm, hurricane or other natural disasters), war, invasion, act of foreign enemies, hostilities (regardless of whether war is declared), civil war, rebellion, revolution, insurrection, military or usurped power or confiscation, terrorist activities, riots, civil disturbances, industrial disputes, natural and nuclear disasters, fire, epidemics, health risks, nationalisation, government sanction, blockage, embargo, labour dispute, strike, lockout or interruption or failure of electricity or telephone service and/or any unforeseen technical problems with transport including changes due to rescheduling or cancellation or alteration of flights, closed or congested airports or ports.

" Combined Tour ” means the combination of two or more Cruises and offered for sale as a single Holiday Package. For any relevant purposes, the Combined Tour shall always be considered as a single and indivisible Holiday Package. All terms and references to a Cruise and or Holiday Package shall include and be equally applicable to a Combined Tour unless otherwise stated. References to price are references to the total price paid for the Combined Tour

“ Holiday Package ” means the Cruise whether or not in combination with flight(s) and/or any pre- and/or post-Cruise arrangement for accommodation. It includes, depending on the Cruise itinerary, the call and the duration of any stay on the Ocean Cay – MSC Marine Reserve, operated by MSC Cruises. It does not include Shore Excursions or shuttle services which do not form part of the inclusive Holiday Package price.

“ MSC Cruises ” means MSC Cruises S.A., whose registered address is Avenue Eugene-Pittard 16, Geneva, Switzerland 1206.

“ Official Website ” means the set of related web pages, documents and hypertext links served from the web domain www.msccruises.co.uk.

“ Passenger ” means each and every person, including minors, named either on the Booking confirmation or on the invoice or on a ticket issued by MSC Cruises.

“ Shore Excursion ” means any excursion, trip or activity ashore that is not included as part of the all-inclusive price of the Holiday Package and is offered for sale by MSC Cruises on-board its vessels.

“ Travel Services ” means flight(s), accommodation or any other tourist service advertised in the brochures or on the Official Website (excluding Shore Excursions or shuttle services).

“ World Cruise ” means the tour of the world offered for sale as a single Holiday Package. For any relevant purposes, the World Cruise shall always be considered as a single and indivisible Holiday Package. All terms and references to a Cruise and or Holiday Package shall include and be equally applicable to a World Cruise unless otherwise stated. References to price are references to the total price paid for the World Cruise.

1. Booking Procedure and Deposit

1.1 In order to proceed with a Booking, the Passenger must contact MSC Cruises or one of the authorised Agents or representatives.

1.2 By placing a Booking, the person making the Booking confirms, agrees and accepts that all persons named in the Booking request and on the invoice have agreed to be bound by the Booking Terms & Conditions and that he/she has authority to accept these Booking Terms & Conditions on behalf of all the persons named on the Booking request and invoice.

1.3 A non-refundable deposit of £75 per person for cruise only holiday up to 3-nights, £100 per person for cruise only holiday (4 nights onwards) and £250 per person for air inclusive cruise holidays (including for infants up to 2 years) is due and payable by the Passenger at the time of Booking. For the World Cruise, a non-refundable deposit equal to 15% of the price of the Booking is due and payable by the Passenger within the first week starting from the date of the booking confirmation. 1.4 A Booking will be completed and the Contract will be effective only when MSC Cruises confirms the Booking by sending a confirmation invoice to the Passenger or to the Passenger’s Agent.

2.1 Every Booking is subject to availability at the time of Booking. No Booking shall be confirmed, and no Contract shall be made, until the deposit or the full amount (according to the present Booking Terms & Conditions) is paid and the confirmation invoice provided to the Passenger. 2.2 Full payment is required no later than 63 days prior to departure for bookings less than 14 days in duration. (93 days for cruises of 15 nights or more, including the MSC World Cruise 2024 and MSC World Cruise 2025). 2.3 If the Booking application is made within 63 days prior to departure (93 days for cruises of 15 nights or more, including the MSC World Cruise 2024 and the World Cruise 2025), then full payment must be sent at the time of Booking. 2.4 If any Passenger fails to pay the balance 63 days prior to departure (93 days for cruises of 15 nights or more, including the MSC World Cruise 2024 and MSC World Cruise 2025), MSC Cruises has the right to cancel the Booking without notice and levy cancellation charges in accordance with paragraph 13 below, whether the Booking is resold or not.

3. Prices and Price Guarantee

3.1 No change to the price of your Booking will be made within the 20-day period before departure or once full payment has been received by MSC Cruises. 3.2 The price of your Booking may be varied at all times prior to those detailed in 3.1 above to allow variations for: a) Air transportation costs. b) Fuel costs for the propulsion of the vessel. c) Dues, taxes or fees chargeable for services such as embarkation or disembarkation fees at ports or airports. d) the exchange rates relevant to the Holiday Package. Variations may be upwards or downwards. For paragraph a) any variation of the Contract price will be equal to the extra amount charged by the airline. For paragraph b) any variation of the Contract price will be equal to 0.33% of the price of the Cruise for every dollar of increase of the fuel per barrel (NYMEX Index). For paragraph c) any variation of the Contract price will be equal to the full amount of the fees. 3.3 We will absorb, and you will not be charged for, any increase equivalent to 2% of the price of your travel arrangements, which excludes insurance premiums and any amendment charges. You will be charged for the amount over and above that. If this results in an increase equivalent to more than 8% on the total Contract price at the time of Booking, the Passenger will be entitled to cancel the Contract with a full refund of the Contract price within the limits and to the extent of the amount effectively paid by the Passenger at the time of cancellation. Such right of refund does not include insurance premiums paid which are in no case refundable. 3.4 To exercise the right to cancel the Passenger must notify MSC Cruises in writing within 7 days of receiving the price increase notification.

4. Insurance

5. passport, visas and travel advice.

5.1 Passengers must hold fully valid passports for the whole duration of the Contract. For international cruises, the passport expiry date for UK nationals must be of at least 3 months from the departure date. Certain countries insist on machine-readable and digital photo passports, especially Russia and USA. 5.2 MSC Cruises are not responsible for obtaining or checking visas for any Passenger, this is the responsibility of the individual Passenger. Passengers are strongly advised to check for all legal requirements for travelling abroad and at the various ports to include the requirement of visas, immigration, custom and health. 5.3 Passengers under 18 years of age (or 21 years of age for US Passengers or Passengers embarking from a US port) must travel accompanied by their parents or a legal guardian. If one of the traveling minor’s parents is not cruising, a signed authorization letter – made in accordance with the laws of the country where the minor resides - from the absent parent authorizing the minor to travel has to be provided at the moment of booking. 5.4 If the minor is travelling with Passengers that are not their parents or legal guardians, MSC Cruises shall require, at the moment of booking, a document signed by the parents or legal guardian authorizing the minor to travel with a chaperone or a designated individual, in accordance with MSC Cruises’ policies. 5.5 Passengers must hold fully valid passport for the whole duration of the Contract. For international cruises, the passport expiry date for UK nationals must be of at least 3 months from the departure date. Certain countries insist in machine-readable and digital photo passports, especially USA and Russia.

6. Fitness to Travel Pregnancy, Medical Facilities

6.1 The safety of all Passengers is of paramount importance to MSC Cruises, hence all Passengers warrant that they are fit to travel by sea (and if applicable by air) and that their conduct or condition will not impair the safety or convenience of the vessel or aircraft and the other Passengers, and that they can be carried safely in accordance with applicable safety requirements established by International EU or national law. 6.2 Any Passenger with a condition that may affect fitness to travel taking into account the vessel’s itinerary must inform MSC Cruises at the time of Booking and submit a doctor’s certificate prior to Booking. In any case, MSC Cruises and/or the Carrier has the right to request, at their own discretion, the Passenger to produce medical certificates supporting the fitness to travel. 6.3 Pregnant women are requested to seek medical advice before travelling; at any stage of their pregnancy they must obtain a medical certificate from a doctor confirming their fitness to travel on board the vessel taking into account the specific itinerary. 6.4 MSC Cruises and/or the Carriers do not have on board any of the cruise vessels adequate medical facilities or equipment for childbirth. MSC Cruises cannot accept a Booking and the Carrier cannot carry any Passenger who will be 24 weeks pregnant or more by the end of the Cruise. 6.5 MSC Cruises and/or the Carrier expressly reserve the right to refuse boarding rights to any Passenger who appears to be in any advanced state of pregnancy or who does not provide the medical certificate according to clause 6.2 above and MSC Cruises and the Carrier shall have no liability in respect of such refusal. 6.6 In the case of a Booking made by a Passenger who was not aware at the time of Booking and could not have reasonably known at the time of Booking that she was pregnant over the terms provided by upper clause 6.4 then, MSC Cruises will offer the Passenger the choice of Booking another Cruise from the brochure and/or from the Official Website of equivalent quality compliant with the above mentioned terms, if available; or cancelling and receiving a full refund of the full price paid by that Passenger for any cancellation of Booking as long as such cancellation is notified immediately as soon as such a Passenger becomes aware of her condition. The refund will not include insurance premiums paid which are in no case refundable. 6.7 Infants under 1 year old are admitted on board except for cruises starting from 11 nights onwards for which it is required that the minor is at least 1 year old at the moment of embarkation. 6.8 Where a Passenger is assessed as unfit to travel and refused embarkation then neither MSC Cruises nor the Carrier has any liability to the Passenger.

7. Disabled Passengers and Passengers with Reduced Mobility and Tender Safety

7.1 MSC Cruises’ and the Carriers’ priority is always the comfort and safety of its Passengers and in order to achieve this the Passenger is asked at the time of Booking to provide as much detail as possible of the matters given below so that MSC Cruises and the Carrier can consider its obligation to carry the Passenger in a safe or operationally feasible manner, taking into account any issues relating to the design of the passenger ship or port infrastructure and equipment including port terminals which may make it impossible to carry out the embarkation, disembarkation or carriage of the Passenger which may have an impact on the Passengers safety and comfort. 7.2 The Passenger is asked to provide full details at the time of Booking if the Passenger: 7.2.1 Is unwell, infirm, has a disability or has Reduced Mobility; 7.2.2 If the Passenger requires a special Disabled cabin, since there is a limited number of these available and since MSC Cruises would like to, wherever possible, accommodate the Passenger so that the Passenger is comfortable and safe for the duration of the Cruise; 7.2.3 If the Passenger has any special seating requirements; 7.2.4 If the Passenger needs to bring any medical equipment on board; 7.2.5 If the Passenger needs to bring a recognised assistance dog on board the vessel (please note that assistance dogs are subject to national regulations). 7.3 Where MSC Cruises and/or the Carrier consider strictly necessary for the safety and comfort of the Passenger and in order for the Passenger to fully enjoy the Cruise, it may require a Passenger with reduced ability or a Passenger with Reduced Mobility to be accompanied by another person who is capable of providing the assistance required by the Disabled Passenger or Passenger with Reduced Mobility. This requirement will be based entirely on MSC Cruises and/or the Carrier assessing the need of the Passenger on grounds of safety and may vary from vessel to vessel and/or itinerary to itinerary. Passengers confined to a wheelchair are asked to kindly furnish their own standard size collapsible wheelchair during the whole Holiday Package and might also be requested to be accompanied by a travelling Passenger fit and able to assist them. 7.4 If the Passenger has any particular condition, Disability or Reduced Mobility which require personal care or supervision then such personal care or supervision must be organized by the Passenger and at the Passenger’s expense. The vessel is unable to provide respite services, one- to-one personal care or supervision or any other form of care for physical or psychiatric or other conditions. 7.5 If after careful assessing the Passenger’s specific needs and requirements, MSC Cruises and/or the Carrier concludes that the Passenger cannot be carried safely and in accordance with applicable safety requirements then MSC Cruises can refuse to accept a Booking or embarkation of a Disabled Passenger or Passenger with Reduced Mobility on the grounds of safety. 7.6 MSC Cruises reserves the right to refuse to carry any Passenger who has failed to adequately notify it of any disabilities or needs for assistance in order for MSC Cruises and/or the Carrier to make an informed assessment that the Passenger can be carried in a safe or operationally feasible manner on the grounds of safety. If the Passenger does not agree with a decision of MSC Cruises under clauses 7.5 to 7.6 of these Booking Terms & Conditions then the Passenger must provide a complaint in writing with all supporting evidence to MSC Cruises. 7.7 MSC Cruises reserves the right to refuse to carry any Passenger who in the opinion of MSC Cruises and/or the Carrier is unfit for travel or whose condition may constitute a danger to themselves or others on the Cruise on the grounds of safety. 7.8 For the safety and comfort of the Passenger, if the Passenger becomes aware between the date of Booking the Holiday Package and the date of commencement of the Holiday Package that he/she will require special care or assistance as detailed above, the Passenger is asked to inform MSC Cruises immediately so that MSC Cruises and the Carrier can make an informed assessment whether or not the Passenger can be carried in a safe or operationally feasible manner. 7.9 Disabled Passengers or Passengers with Reduced Mobility may not be able to go ashore at ports where vessels do not berth alongside. A list of these ports is available upon written request. 7.10 In some ports, it is necessary to anchor offshore rather than alongside. When this is the case, the Carrier will use a tender to take Passengers ashore. A tender is a small vessel and may not be suitable for people with Disabilities or Reduced Mobility or balance problems. When using tenders, safety is the utmost priority. It is important that Passengers are able to use the tender safely. Passengers may be required to descend to a platform or pontoon and into the tender. There may be steps both up and down and Passengers may need to navigate a gap between the platform and the tender (which can be approximately 1.5ft). Depending on weather, tide and sea conditions, there may be some movement, which could change throughout the course of the day. Passengers must be fit and mobile enough to access and disembark the tender. If Passengers have impaired mobility, or use a mobility aid such as a stick, then they must carefully consider their ability to embark the tender safely before making their way down to the platform. Passengers must take into consideration the use of steps, the possibility of a gap and height difference between the platform and the tender, and the potential sudden movement of the tender when making a decision. Wheelchairs and mobility scooters will not be carried by the crew into the tender. All Passengers must be independently mobile enough to use the tenders. Ultimately, carriage by tender may be refused by the master or any of his officers if there is any doubt as to the safety of any Passenger. All Passengers must take extra care when stepping on and off the tender. There will be crew members there to guide and steady Passengers as they embark and disembark but they cannot support, lift or carry Passengers. The same precautions apply when Passengers disembark the tender in the port.

8. Public Health Questionnaire

8.1 MSC Cruises and/or the Carrier and/or the health authorities in any port shall be entitled to administer a public health questionnaire on their own behalf. In addition to any Health and Safety measures that MSC Cruises may adopt, the Passenger shall supply accurate information regarding symptoms of any illness including but not limited to gastrointestinal illness, and H1N1, and COVID-19. The Carrier may deny boarding to any Passenger that it considers in its sole discretion to have symptoms of any illness including viral or bacterial illness including but not limited to Norovirus,H1N1, and COVID-19. Refusal by a Passenger to complete the questionnaire may result in denied boarding. 8.2 Where Passengers become ill during the Cruise with viral or bacterial illness the ship’s doctor may request them to remain in their cabin for reasons of safety. Passengers must follow the instructions of the Carrier and refusal to do so may result in disembarkation without any liability for damages or a refund on MSC Cruises or the Carrier.

9. Food Allergies

9.1 Passengers are reminded that some foods may cause an allergic reaction in certain people due to intolerance to some ingredients. If the Passenger has any known allergies, or is intolerant to any food, he/she is required to inform MSC Cruises at the time of Booking (by duly filling in a specific form) and further to report it to the Maître d’hôtel as soon as convenient after boarding the ship. 9.2 It is the responsibility of the Passenger to ensure that he/she actively avoids any food he/ she is allergic to. MSC Cruises will take all reasonable care if made aware in writing of any specific food or ingredient the Passenger has an allergic reaction to and assist the Passenger within reason to avoid any such food or ingredients if made aware by the Passenger according to clause 9.1 above; in absence of such information neither MSC Cruises nor the Carrier will be held responsible for preparing special meals for the Passenger or any other prepared meals consumed by the Passenger. In case of multiple allergies/intolerances, even though informed according hereto, MSC Cruises or the Carrier might not be able to avoid the risk of cross-contamination during food preparation and therefore neither MSC Cruises nor the Carrier will be held responsible if such contamination occurs.

10. Medical Assistance

10.1 Passengers are strongly recommended to have comprehensive travel health insurance covering medical treatment and repatriation costs and expenses. 10.2 In compliance with Flag State requirements, there is a qualified doctor on-board and a medical centre equipped for first aid and minor conditions only. The Passenger hereby acknowledges and accepts at the time of Booking that the medical centre is not equipped as a land-based hospital and the doctor is not a specialist. Neither MSC Cruises, nor the Carrier, nor the doctor shall be liable to the Passenger as a result of any inability to treat any medical condition as a result. 10.3 The Passenger acknowledges that whilst there is a qualified doctor on-board the vessel, it is the Passenger’s obligation and responsibility to seek medical assistance if necessary during the Cruise and will be responsible to pay for on-board medical services. 10.4 In the event of illness or accident, Passengers may have to be landed ashore by the Carrier and/or the master for medical treatment. Neither the Carrier nor MSC Cruises make any representation or accept any responsibility regarding the quality of the available medical facilities or treatments at any port of call or at the place at which the Passenger is landed. Medical facilities and standards vary from port to port. Neither MSC Cruises nor the Carrier makes any representations or warranties in relation to the standard of medical treatment ashore. 10.5 The doctor’s professional opinion as to the fitness of the Passenger to board the vessel or to continue the Cruise is final and binding on the Passenger. 10.6 It is recommended that medical advice is sought before Booking for children up to 12 months of age. For the avoidance of doubt the provisions of clause 6 and the requirement of fitness to travel is applicable to all Passengers including infants

11. Medical Equipment

11.1 It is important that Passengers contact the manufacturer or supplier to ensure that any medical equipment they are intending to bring on board is safe to use. It is the responsibility of the Passengers to arrange delivery to the docks prior to departure of all medical equipment and to notify MSC Cruises prior to Booking if they need to have medical equipment on board so that MSC Cruises and the Carrier can ensure that the medical equipment can be carried safely. 11.2 It is the Passengers responsibility to ensure that all medical equipment is in good working order and for arranging enough equipment and supplies to last the entire voyage. The ship does not carry any replacement and access to shore side care and equipment may be difficult and expensive. Passengers must be able to operate all equipment.

12. Booking Changes requested by the Passenger

12.1 The Passenger is entitled to transfer his/her Booking to a third party, provided that: (i) said third party satisfies all the conditions for the use of the Contract; and (ii) written notice is duly sent to MSC Cruises no later than 7 working days before departure of the Cruise. If the conditions stated above in this clause are met, the name change will in any case be subject to a fee of £50 per change, reflecting the costs for the Company of effectuating the transfer, see clause 12.3 below. Name changes requested within 7 days of the departure will be considered as cancellation. The Passenger and the third party contract assignee shall be jointly liable to MSC Cruises to pay the price of the Contract and any additional cost that may arise as a consequence of the change in Passenger. 12.2 Furthermore, even after the confirmation invoice has been issued, the Passenger is also entitled to exchange, once only, the purchased Holiday Package (“Original Holiday Package”) with another Holiday Package (“New Holiday Package”) on the following conditions: i. the date of departure of the New Holiday Package is later than that of the Original Holiday Package; ii. the request for the substitution of the New Holiday Package in place of the Original Holiday Package is received by MSC Cruises not later than 30 calendar days before the date of the scheduled departure of the Original Holiday Package and there is availability of spaces on the New Holiday Package; iii. the expected date of departure of the New Holiday Package falls within 90 calendar days from the expected date of departure of the Original Holiday Package. If the conditions stated above in this clause are met, the substitution of the Original Holiday Package with the New Holiday Package will in any case be subject to the following administration fee per Passenger: BELLA: £50 per person FANTASTICA, AUREA, YACHT CLUB: One Free of Charge* WORLD CRUISE: Loss of deposit equal to 15% of holiday package as per section 12.8 *Any change to a date that is more than 90 calendar days from the original departure date will result in a fee of £50 per person, applicable to all experiences. Any subsequent departure date change will result in a fee of £50 per person. It is understood that, in addition to the administration fee mentioned above, if the price of the New Holiday Package is higher than that of the Original Holiday Package, the difference in price as well as in insurance premium will be borne exclusively by the Passenger. On the other hand if the price of the New Holiday Package is lower than that of the Original Holiday Package, no reimbursement will be due to the Passenger. In case of substitution of the Original Holiday Package with the New Holiday Package, the Passenger will still be entitled to withdraw from the Contract and therefore cancellation fees will apply; cancellation fees will be based on the price due (as per above provisions) and the scale provided under clause 13 (Cancellation by the Passenger) according to the Original Holiday Package departure date. MSC Cruises will make reasonable endeavours to comply with the Passenger requests for changes to flight, transport or other services arrangements and adapt them to the New Holiday Package. In no case whatsoever will MSC Cruises be held liable for change requests that cannot be satisfied. 12.3 Name or date changes are not always allowed by air Carriers and other transport or services providers whenever they are made. Most air Carriers and other transport or services providers treat such changes as a cancellation and charge accordingly. Any additional costs including cancellations fees and/or increased prices levied by air Carriers or other third-party providers will be exclusively for the Passenger’s account and be charged as a part of the additional cost mentioned in clause 12.1(ii) above. 12.4 Save as provided above, other changes to the Booking may be requested (even after the confirmation invoice has been issued) until 63 days prior to departure, subject to a minimum administration fee of £25.00 per person per amendment. Any additional costs that may arise as a consequence of the change will be exclusively for the Passenger’s account. 12.5 Requests of amendments to the Booking received by MSC Cruises beyond the above time limits will be treated as cancellations and the cancellation charges detailed in clause 13 below will apply. 12.6 Any changes requested by the Passenger on a Combined Tour shall always apply to the whole Holiday Package. All the relevant time limits run from the scheduled date of departure of the first Cruise of the Combined Tour. 12.7 Any change request related to the World Cruise shall be permitted exclusively for another World Cruise and, in such case, will trigger the loss of the non-refundable deposit equal to 15% of the price of the Package paid by the passenger

13. Cancellation by the Passenger

13.1 Cancellation of the Booking must be requested in writing (email) to MSC Cruises or via the Passenger’s Agent. All tickets issued and the confirmation invoice must be returned together after the notice of cancellation. The cancellation notice must be sent to MSC Cruises at least one working day before departure within 3pm GMT. • Cancellations done after the above deadline or on the departure date would be treated as “no show” with 100% cancellation charges applicability. 13.2 Save for what is set forth in clause 13.3 below, to cover the estimated loss incurred by cancellation, MSC Cruises will levy cancellation charges in accordance with the following scale: Cruises < 15 Nights • 63 days or longer before departure – Deposit • 62 to 42 days before departure – 25%* • 41 to 29 days before departure – 40%* • 28 to 15 days before departure – 60%* • 14 to 6 days before departure – 80%* • 5 to 0** before departure – 100%* Cruises ≥ 15 Nights • 93 days or longer before departure – Deposit • 92 to 72 days before departure – 25%* • 71 to 59 days before departure – 40%* • 58 to 45 days before departure – 60%* • 44 to 15 days before departure – 80%* • 14 to 0** before departure – 100%* * or loss of deposit whichever is greater. ** “no-show” upon departure and Holiday Package breaking shall be dealt as a cancellation made on the day of departure World Cruise 2024 and 2025 • 60 days or longer before departure – 15% of holiday package* • 59 to 10 days before departure – 75% of holiday package* • 9 to 0**days before departure – 100% of holiday package MSC Yacht Club • 63 days or longer – Deposit • 62 to 42 days before departure – 25% of holiday package* • 41 to 29 days before departure – 40% of holiday package* • 28 to 15 days before departure – 60% of holiday package* • 14 to 6 days before departure – 80% of holiday package* • 5 to 0** days before departure – 100% of holiday package * or loss of deposit whichever is greater (£100 for cruise only, £250 for fly/cruise) ** “no-show” upon departure and Holiday Package breaking shall be dealt as a cancellation made on the day of departure. 13.3 In case a cabin remains for single use after the cancellation of a Passenger, the Passenger occupying the cabin for single use will be asked to pay a single surcharge charged by MSC Cruises for any single cabin Booking. Alternatively, should the remaining single passenger opt to cancel the Booking, the latter will pay the cancellation charges in accordance with clause 13.2 in addition to the insurance premium. 13.4 It may be possible for the Passenger to claim these cancellation charges from his/her travel insurance provider, subject to any applicable deductibles. It is the Passenger’s responsibility to make such a claim under the terms of his/her insurance policy. 13.5 The Passenger may request the cancellation of a Combined Tour, but such a cancellation shall always apply to the whole Holiday Package. All the relevant time limits run from the scheduled date of departure of the first Cruise of the Combined Tour 13.6 The Passenger will not be liable to pay the fees mentioned in clause 13.2 and 13.3 above if the cancellation is due to Unavoidable and Extraordinary Circumstances occurring at the place of destination or its immediate vicinity and significantly affecting the performance of the package, or which significantly affect the carriage of passengers to the destination.

14. Booking Changes Effected by the Company

14.1 Arrangements for the Travel Service(s) and Holiday Packages are made many months in advance. Very occasionally it may be necessary to alter them; therefore, MSC Cruises expressly reserves the right to change the arrangements for the Contract should such changes become necessary or advisable for operational, commercial or safety reasons. 14.2 MSC Cruises has the right to assign another cabin for the Passenger, as long as it has similar characteristics. If there is a change in accommodation to a lower-priced cabin, the Passengers affected by such change will be entitled to a refund of the price difference, according to the current rates.

14.3 Most changes are minor but occasionally MSC Cruises must make a significant change. The following are examples of significant changes when made before you go on the Cruise: A change in the time Passengers are due to leave the UK to go on the Cruise or the time Passengers are due to come back to the UK after the Cruise of more than 12 hours. A change of UK airport from the Passengers were due to fly to or from, except where the change is between London airports (Heathrow, Gatwick, Stansted, London City or Luton) or where the new airport is within 50 miles of the original airport. A change of cabin accommodation to a significantly lesser grade. A significant change to the itinerary. i.e. when the itinerary has to be changed by more than 50% and may have to exclude an iconic highlight. All changes which are not significant are treated as minor changes and therefore there is no right to cancel or to claim compensation. Please note: MSC Cruises do not classify a change of air or sea port as a significant change where coach transfers between a UK town and the relevant air/sea port are included in the holiday. A change of flight from direct to indirect is not classified as a significant change. In the event of a significant alteration to an essential term of the Contract, MSC Cruises will inform the Passenger or his/her Agent of such change in writing as soon as reasonably possible. If there is time to do so before departure, we will offer you the choice of one of the following a) Accepting the alteration; or b) Making another Booking from the brochure and/or from the Official Website of equivalent or superior quality, if available; or c) Making another Booking from the brochure and/or from the Official Website of lower quality, if available, with a refund of the difference in price; or d) Cancelling and receiving a full refund of all monies paid.

14.4 Passengers must notify MSC Cruises of their decision in writing or via their Agent within 7 days of receiving the notification of alteration or the period indicated. A failure to revert within this period will result in the alteration being accepted and any cancellations after this period shall attract cancellation charges in accordance with clause 13.2. 14.5 If MSC Cruises has to make a significant change or cancel before departure, MSC Cruises, where compensation is appropriate, will reimburse of all monies paid to MSC Cruises as set out in clause 15.1 depending on the circumstances and when the significant change or cancellation is notified to the Passenger, subject to the following exceptions listed below, compensation will not be payable and no liability beyond offering the above mentioned choices can be accepted where MSC Cruises is forced to make a change or cancel as a result of unusual or unforeseeable circumstances beyond our control, the consequences of which MSC Cruises could not have avoided with all due care . 14.6 No compensation is payable for minor changes and MSC Cruises cannot accept liability for expenses that may be incurred if Passengers have to change or cancel any arrangements they might have made before the minor change was notified to them before departure. 14.7 Very rarely, MSC Cruises may be forced to change or terminate a Cruise (or Holiday Package) after departure but before the scheduled end of the Cruise (or Holiday Package) as a result of Unavoidable and Extraordinary Circumstances. In particular, when unexpected events such as extreme weather, civil strife or other Force Majeure events occur, MSC Cruises may be required to act to protect the safety of its Passengers. This may require MSC Cruises to either make substantial alterations to an itinerary, or in extreme cases make urgent arrangements to repatriate customers to the United Kingdom or the port where the Cruise was scheduled to end. If this situation does occur, MSC Cruises regrets it will be unable to pay Passengers any compensation or meet any costs or expenses incurred by Passengers as a result. 14.8 If, after departure, MSC Cruises is unable to provide a significant proportion of the services it agreed to provide as part of its Contract with Passengers, MSC Cruises will do their very best to make suitable alternative arrangements for the services which have not been provided. If MSC Cruises cannot do so or Passengers refuse to accept these for good reasons, MSC Cruises will arrange to fly Passengers back to their UK departure airport (if the arrangements MSC Cruises agreed to provide included UK flights) or to transport Passengers to the final disembarkation port as soon as reasonably possible.

14.9 In some circumstances, Passengers may be entitled to the difference in price between the Cruise contracted for and that provided. Refunds will be made for shore excursions not performed. 14.10 Passengers also have rights in certain circumstances which includes refunds and transportation. The circumstances in which these rights apply and the rights are set out in the Passenger Bill of Rights which is on our website. Once a Holiday Package has been completed, and it is impossible to ensure the Passenger's return to their departure point as agreed in the Contract because of Unavoidable and Extraordinary Circumstances, MSC Cruises shall bear the cost of necessary accommodation, if possible of equivalent category, for a period not exceeding three nights per traveller. Where longer periods are provided for in EU passenger rights legislation applicable to the relevant means of transport for the traveller's return, those periods shall apply.

15. Cancellation by MSC Cruises

15.1 MSC Cruises reserves the right to cancel any Contract at any time by giving written notice to the Passenger but shall not be liable for additional compensation, if: (i) the cancellation is due to an event of Unavoidable and Extraordinary Circumstances and/or any unusual /or unforeseeable circumstances beyond MSC Cruises’ control, the consequences of which could not have been avoided by MSC Cruises even though it has exercised all due care; (ii) the number of persons enrolled for the Holiday Package is smaller than the 50% of the passenger capacity of the relevant ship. In both cases above, MSC Cruises will offer the Passenger the choice of: a) Receiving a full refund of all money paid; or b) Booking another Contract from the brochure and/or from the Official Website of equivalent or superior quality at no extra cost, if available; or c) Booking another Contract from the brochure and/or from the Official Website of lower quality, if available, with a refund of the difference in price. 15.2 The Passenger’s decision must be notified to MSC Cruises in writing or via their Sales Agent within 7 days of the notice of cancellation or otherwise instructed by MSC Cruises’ communication. 15.3 Without prejudice to the above, MSC Cruises reserves the right to reject or cancel new Bookings made by or on behalf of former Passengers who, during a previous Holiday Package: a) behaved dangerously for their safety and/or the one of other Passengers and/or crew members; b) damaged and/or endangered MSC Cruises’ assets; c) did not solve outstanding debts with the MSC Cruises; d) violated art. 18 of the present Booking Terms & Conditions. The Passenger will be informed of the rejection or cancellation made under the present article in writing.

16. The Liability of MSC Cruises and the Company

illness caused by the negligent acts and or omissions of them and anyone who supplies services, which form part of the Contract. The liability of MSC Cruises is limited, where applicable, by the conventions mentioned in 16.4 to 16.14 inclusive. The liability of MSC Cruises toward the Passenger is governed also by the International Conventions mentioned hereunder (see clauses 16.4 to 16.14 which provide limitations of liability of the Carrier. MSC Cruises are not responsible for any improper or non-performance which is: a) wholly attributable to the fault of the Passenger. b) the unforeseeable or unavoidable act or omission of a third party unconnected with the supply of any service to be provided under the Contract; c) an unusual or unforeseeable circumstance beyond the control of MSC Cruises and/or anyone who supplies services which form part of the Contract the consequences of which could not have been avoided even if all due care had been exercised, including (but not limited to) an event of Unavoidable and Extraordinary Circumstances ; or d) an event which MSC Cruises and/or anyone who supplies services which form part of the Contract could not even with all due care have foreseen or forestalled. 16.2 For claims not involving personal injury, death or illness or which are not subject to the conventions referred to in clause 16.4 to 16.14 inclusive, MSC Cruises’ liability for improper performance of the Contract shall be limited to a maximum of three times the price which the affected Passenger paid for the Contract (not including insurance premiums and amendment charges). 16.3 All carriage (by land, air and sea) is subject to the Conditions of Carriage of the actual Carrier. These may limit or exclude liability. They are expressly incorporated into these Booking Terms & Conditions and are deemed to be expressly accepted by the Passenger at the time of Booking. Copies of these terms and conditions are available on request from MSC Cruises. 16.4 Carriage of Passengers and their luggage by air is governed by various International conventions (“the International Air Conventions”), including the Warsaw Convention 1929 (as amended by The Hague Protocol 1955 or the Montreal Protocol 1999 or otherwise) or the Montreal Convention 1999. To the extent that MSC Cruises may be liable as a non-performing air Carrier to Passengers in respect of carriage by air, the terms of the International Air Conventions (including any subsequent amendments and any new convention which may be applicable to a Contract between MSC Cruises and a Passenger) are expressly incorporated into these Booking Terms & Conditions and in the Conditions of Carriage. The International Air Conventions fix limitations of liability of the Carrier for death and personal injury, loss of and damage to luggage and delay. Any liability of MSC Cruises toward the Passenger arising from a carriage by air is subject to the limitation of liability provided by said Conventions. Copies of these conventions are available upon request. 16.5 Insofar as MSC Cruises may be liable to a Passenger in respect of claims arising out of carriage by air, land or sea, MSC Cruises shall be entitled to all the rights, defences, immunities and limitations available, respectively, to the actual Carriers (including his own terms and Conditions of Carriage) and under all the applicable regulations and/or conventions, such as the Athens Convention, the Montreal Convention and nothing in these Booking Terms & Conditions nor in the Conditions of Carriage shall be deemed as a waiver thereof. If any term, condition, section or provision becomes invalid or be so judged, the remaining terms, conditions, sections and provisions shall be deemed severable and shall remain in force. 16.6 The liability (if any) of MSC Cruises and the Carrier for damages suffered as a result of death or personal injury to the Passenger, or loss or damage to luggage shall be determined in accordance with the following: 16.7 In relation to Carriage by Sea EU Regulation 392/2009 Concerning the Rights of Passengers when travelling by sea in the event of Accidents (EU Regulation 392/2009), shall apply to international carriage by sea where the port of embarkation or disembarkation is in the EU or where the vessel has an EU flag or where the contract of carriage is made in the EU. A copy of EU Regulation 392/2009 is available on request and can be downloaded from the Internet at: https://www.gov.uk/government/uploads/system/uploads/attachment_data/file/2724/annex-b-reg- ec-392-2009.pdf. A summary of EU Regulation 392/2009 can be found at: http://ec.europa.eu/transport/themes/passengers/maritime/doc/rights-in-case-of-accident.pdf Where the vessel is being used as floating accommodation then the provisions of the Athens Convention 1974 and the limits therein will apply and are hereby expressly incorporated into these Booking Conditions including any claims for loss of or damage to luggage and or death and or personal injury. 16.8 The level of damages MSC Cruises and the Carrier may be liable to pay in relation to death and/or personal injury and or loss of or damage to Luggage is limited and shall in no circumstances whatsoever exceed the limits of liability set out in EU Regulation 392/2009, or where applicable Athens Convention 1974. 16.9 The liability of MSC Cruises and the Carrier for death, personal injury or illness to the Passenger shall not exceed 46.666 Special Drawing Rights ("SDR") as provided and defined in the Athens Convention 1974 or, where applicable, the maximum sum of 400,000 SDR pursuant to EU Regulation 392/2009 or the Athens Convention 2002 and, where there is liability for war and terrorism under EU Regulation 392/2009 or the Athens Convention 2002, 250.000 SDR. Liability of MSC Cruises and the Carrier for loss of or damage to Passenger's luggage or other property shall not exceed 833 SDR per Passenger under the Athens Convention 1974 or 2,250 SDR where EU Regulation 392/2009 or the Athens Convention 2002 applies. It is agreed that such liability of MSC Cruises and the Carrier shall be subject to the applicable deductibles per Passenger, such sum to be deducted from the loss or damage to luggage or other property. The Passenger understands that the conversion rate of SDR's fluctuates daily and may be obtained from a bank or Internet. The value of an SDR can be calculated by visiting http://www.imf.org/external/np/fin/data/rms_five.aspx. 16.10 It is presumed under the Athens Convention 1974 and where applicable the Athens Convention 2002 or EU Regulation 392/2009 that the Carrier has delivered Luggage to a Passenger unless written notice is given by the Passenger within the following periods: (i) in the case of apparent damage before or at the time of disembarkation or redelivery (ii) in the case of damage which is not apparent or loss of Luggage within fifteen days from the disembarkation or delivery or of the date that such delivery should have taken place. 16.11 If the carriage provided hereunder is not “international carriage” as defined in Article 2 of EU Regulation 392/2009 or the vessel is being used as a floating hotel and or domestic carriage by sea in the UK, the provisions of the Athens Convention 1974 shall apply to these Booking Terms & Conditions and be deemed to be incorporated herein mutatis mutandis. 16.12 MSC Cruises shall not be liable for loss or damage to any valuables such as monies, negotiable securities, precious metal items, jewellery, art, cameras, computers, electronic equipment, or any other valuables unless they are deposited with the Carrier for safe-keeping, and a higher limit is agreed expressly and in writing at the time of deposit, and an extra charge is paid by the Passenger for declared value protection. Use of the ship’s safe is not a deposit with the ship. Where there is liability for loss of or damage to valuables deposited with the ship then such liability is limited to 1,200 SDR under the Athens Convention 1974 or 3,375SDR where EU Regulation 392/2009 or the Athens Convention 2002 applies. 16.13 MSC Cruises and the Carrier shall have the full benefit of any applicable laws providing for limitation and/or exoneration of liability (including without limitation, law and/or the laws of the vessel’s flag in respect of/or the global limitation on damages recoverable from the Carrier). Nothing in these Booking Terms & Conditions is intended to operate to limit or deprive MSC Cruises and the Carrier of any such statutory or otherwise limitation or exoneration or liability. The servant and/or agents of MSC Cruises and the Carrier shall have the full benefit of all such provisions relating to the limitation of liability. 16.14 Without prejudice to the provisions of 16.7 to 16.13 above, if any claim is brought against MSC Cruises and Carrier in any jurisdiction where the applicable exemptions and limitations incorporated in these Booking Terms & Conditions are held to be legally unenforceable then MSC Cruises and the Carrier shall not be liable for death, injury, illness, damage, delay or other loss or detriment to any person or property arising out of any cause of whatsoever nature which has not been shown to have been caused by MSC Cruises and Carrier’s own negligence or fault. 16.15 Notwithstanding anything to the contrary elsewhere in these Booking Terms & Conditions, MSC Cruises shall not in any circumstances be liable for any loss or anticipated loss of profits, loss of revenue, loss of use, loss of contract or other opportunity nor for any other consequential or indirect loss or damage of a similar nature. 16.16 The liability of MSC Cruises is excluded for claims arising out of loss or damage directly or indirectly occasioned by circumstances where performance and/or prompt performance of the Contract is prevented by reason of war, or threat of war, riot, civil strike, industrial dispute whether by MSC Cruises’ employees or others, terrorist activity or the threat of terrorist activity, failure of power supplies, health risks or epidemics natural or nuclear disaster, fire or adverse weather conditions or adverse sea states, Passenger’s suicide or attempted suicide or the Passenger’s deliberate exposure to unnecessary danger (except in an attempt to save human life), or the consequences of participating in an unusual and dangerous activity and any other circumstance of any nature whatsoever outside MSC Cruises’ control. 16.17 Where MSC Cruises has any legal liability for loss of or damage to property otherwise than in accordance with the Athens and/or Montreal Conventions then its liability shall not at any time exceed £500,00 (in aggregate) and MSC Cruises shall not at any time be liable for money or valuables. Passengers must not pack money or other valuables in their luggage. 16.18 MSC Cruises’ liability will not at any time exceed that of any Carrier under its Conditions of Carriage and/or applicable or incorporated conventions. Any damages payable by MSC Cruises shall be reduced in proportion to any contributory negligence by the Passenger.

17. Itinerary / Right to Change

18. passenger's responsibility.

18.1 The Passenger has a duty to follow the instructions and orders of the master and officers while on-board. The Passenger hereby accepts and agrees that the master and officers are entitled and have authority to inspect any person on board, any cabin, baggage and belonging for safety, security or other lawful reasons. 18.2 The Passenger hereby expressly agrees to allow any such search. 18.3 Passengers must have received all necessary medical inoculations prior to the Cruise and have in their possession all tickets, valid passports, visas, medical cards and any other documents necessary for the scheduled ports of call and disembarkation. 18.4 Each Passenger warrants that he/she is physically and mentally fit to undertake the Cruise. 18.5 The Carrier and/or the master have the right of refusing the boarding or order the disembarkation of any Passenger should they deem it necessary, for the safety, security, of the Passenger, of the other Passengers or of the ship or should the Passenger’s conduct which, in the reasonable opinion of the master, is likely to endanger or impair the comfort and enjoyment of other Passengers on-board. 18.6 No Passenger shall bring any animals whatsoever, except for recognized service dogs, subject to clause 7 above. 18.7 MSC Cruises and/or the Carrier will be under no liability whatsoever to any Passenger in respect of any breach or non-observance by any Passenger of the provisions of this clause and any Passenger shall indemnify the Carrier and MSC Cruises against any loss or damage occasioned to the Carrier, MSC Cruises or any of its suppliers by such breach or non-observance. 18.8 Passenger’s behaviour must not affect and reduce the safety, peace and enjoyment of the Cruise by other Passengers. 18.9 It is strictly forbidden for Passengers to carry firearms, ammunition, explosives or flammable, toxic or dangerous substances, goods or articles on-board any vessel which could be dangerous for the safety of Passengers and the Vessels. 18.10 Passengers shall be liable for any damage suffered by MSC Cruises and/or the Carrier and/or any supplier of any service that forms part of the Contract as a result of the Passenger’s failure to comply with his/her contractual obligations. In particular, the Passenger shall be liable for all damages caused to the vessel or its furnishings and equipment, for injury or loss to other Passengers and third parties, and also for all penalties, fines and expenses attributable by the Passenger that MSC Cruises, the Carrier or supplier may be liable to pay. 18.11 Passengers are not allowed to sell and/or purchase from other Passengers or travel operators on board the ship any type of commercial services – including but not limited to shore excursions – which are not officially offered by MSC Cruises or its agreed independent contractors.

19. Flights

19.1 MSC Cruises are unable to state the identity of the carrying airline or the aircraft type. All flights will be operated on scheduled or chartered services of recognized air Carriers. In those circumstances, the air ticket payment needs to be made by MSC Cruises in advance and is normally not refunded by the air Carrier. Any cancellation by the Passenger at any time will result in the air fare cost being payable by that Passenger regardless of the cancellation provisions with regard to the Cruise. 19.2 The Passenger will receive confirmation of flight timings and routes with their travel documents, which will be sent out approximately 7 days before departure. 19.3 For travel on dates other than those published in the brochure and/or in the Official Website or on a particular Carrier or routing a higher fare may apply in which case the Passenger will be notified before Booking. 19.4 MSC Cruises is not the air Carrier or an operating air Carrier as defined by Regulation (EC) No 261/2004 (the “Regulation 261/2004”) The obligations under the Regulation 261/2004 for compensation are exclusively those of the air Carrier and/or operating air Carrier and all claims relating to cancellation, delay or denied boarding in respect of air transportation must therefore be made to the relevant air Carrier. 19.5 MSC Cruises shall have no liability under the Regulation 261/2004 such liabilities being entirely those of the air Carrier to whom the Passenger must address all claims. In exercising their rights under the Regulation 261/2004 the Passenger must seek to take as much of the Contract as possible and must not prejudice MSC Cruises’ rights under these Booking Terms & Conditions or in law. 19.6 Where air carriage is included in the Holiday Package, MSC Cruises will advise Passengers of flight timings from data supplied by the air Carrier as part of the holiday documentation. It is the Passenger’s responsibility to ensure arrival at the airport in sufficient time to check in and board the aircraft. Passengers must note that not all medical equipment can be carried or used onboard aircraft. Passengers must check with the airline prior to carriage. 19.7 If the Holiday Package does not include flights, it is the Passenger’s responsibility to obtain a valid ticket directly from an air Carrier suitable for and in time for travel to the vessel (and including local transfers which the Passenger must arrange), as necessary. MSC Cruises shall not be responsible for any liabilities arising in respect of flights or transfers arranged by the Passenger.

20. Complaints

20.1 Any Passenger with a complaint whilst on a Cruise must bring it to the attention of the Cruise staff on-board as soon as possible. If the Cruise staff is unable to resolve the problem, any complaint must be notified in writing to MSC Cruises within 28 days of the termination of the Cruise. Failure to report the complaint within this time may adversely affect MSC Cruises’ ability to deal with it. No claims for illness will be accepted unless the Passenger has reported the illness to the Carrier and has been seen by the ship’s doctor. Complaints relating to any other part of the Contract must be made promptly to MSC Cruises or the supplier quoting your booking reference number. Any complaint concerning your holiday will be dealt with carefully and fairly by our staff. Once your complaint has been fully investigated in accordance with this procedure we will inform you of the outcome. If the complaint is upheld, then any compensation that may be awarded would be subject to our compensation terms and conditions. To submit your complaint in writing, please send an email to [email protected] and our team will look into this matter further. 20.2 Notices of claim for loss or damage to luggage or other property shall be given to the Carrier in writing before or at the time of disembarkation, or if not apparent, within fifteen (15) days from the date of disembarkation 20.3 Complaints under EU Regulation. 1177/2010 concerning accessibility, cancellation or delays must be made to MSC Cruises within two (2) months from the date the service was performed. The Carrier shall respond within 1 month to advise whether the complaint is substantiated, has been rejected or is still being considered. A final reply shall be provided within two (2) months. The Passenger shall provide such further information as may be required by MSC Cruises to deal with the complaint. If the Passenger is not satisfied with the response, then it may complain to the relevant enforcement body in the country of embarkation. For Ex-UK Cruises a complaint must be made to the voluntary complaints authority before a complaint can be made to the Maritime and Coastguard Agency (“MCA”) which is the enforcement authority. MSC Cruises will advise you of the relevant voluntary complaints handling body in its letter dealing with your complaint. 20.4 We are a member of ABTA, membership number (Y1379). We are obliged to maintain a high standard of service to you by ABTA’s Code of Conduct. We can also offer you ABTA’s scheme for the resolution of disputes arising out of, or in connection with this contract which is approved by the Chartered Trading Standards Institute. The scheme is a simple and inexpensive method of arbitration on documents alone with restricted liability on you for costs. The upper limit on claims is £5,000 per person and £25,000 per booking form. If we can’t resolve your complaint, go to www.abta.com to use ABTA’s simple procedure. Further information on the Code and ABTA’s assistance in resolving disputes can be found on www.abta.com. You can also access the European Commission Online Dispute (ODR) Resolution platform at http://ec.europa.eu/consumers/odr/ . This ODR platform is a means of registering your complaint with us; it will not determine how your complaint should be resolved.

21. Consumer protection

21.1 MSC Cruises is a member of the Association of British Travel Agents (ABTA) and its consumer protection scheme and is bonded accordingly for all Holiday Packages sold in the UK. 21.2 MSC Cruises complies with the bonding requirements of the Civil Aviation Authority, CAA licence number 11600, which protects all of its Holiday Packages sold with flights. As of 1st November 2009, the Air Passenger Duty, which is payable by all Passengers departing from UK airports, is included in the price of the Holiday Package. In the unlikely event of MSC Cruises’ insolvency the Civil Aviation Authority will ensure that Passengers are not stranded abroad and will arrange to refund any money paid to MSC Cruises for an advance booking. For further information visit the ATOL website at www.atol.org.uk. Please note that all monies paid by the Passengers to their Travel Agent are held by the Travel Agent as agent for MSC Cruises, after confirmation of the booking by MSC Cruises. Under these schemes the Passenger’s money is protected in the unlikely event that MSC Cruises should cease to trade and the same scheme provides for the Passenger’s repatriation in that event. 21.3 MSC Cruises or the suppliers of the services the Passenger has bought will provide the Passenger with the services he has bought (or a suitable alternative). In some cases, where neither MSC Cruises nor the supplier are able to do so for reasons of insolvency, an alternative ATOL holder may provide the Passenger with the services he has bought or a suitable alternative (at no extra cost to the Passenger). the Passenger agrees to accept that in those circumstances the alternative ATOL holder will perform those obligations and the Passenger agrees to pay any money outstanding to be paid by the Passenger under the contract to that alternative ATOL holder. However, the Passenger also agrees that in some cases it will not be possible to appoint an alternative ATOL holder, in which case the Passenger will be entitled to make a claim under the ATOL scheme (or the Passenger’s credit card issuer where applicable).

22. Data Protection

22.1 MSC Cruises requires personal information including but without limitation to name, address, gender, citizenship and dietary requirements which may disclose a Passenger’s religious beliefs, any health, medical disability and any other special needs to process the Passenger’s booking effectively. MSC Cruises may pass this information on to other relevant individuals such as travel agents, hotels, airlines or other transport providers, security and/or credit verification companies, credit and debit card companies or any governmental or public authorities, either as required by law or regulation or, if required by other such bodies. MSC Cruises may also circulate a passenger list to all Passengers prior to the Cruise which will include the names and nationality of each passenger. 22.2 The Passenger consents to such transfer of information, including to other countries which may not have such robust requirements regarding data protection as the UK, unless the Passenger objects in writing to MSC Cruises no later than seven days prior to the scheduled departure date. It is the Passenger’s responsibility to make sure that information, which MSC Cruises holds about them is up to date and accurate. MSC Cruises’ Data Protection Policy is set out in the Privacy Policy which is incorporated into these terms. 22.3 Personal data relating to individual Passengers shall be collected, processed, stored and used securely and in accordance with relevant data protection laws. Passengers consent to the collection, processing, storing and use of their personal data to enable MSC Cruises to perform the cruise. This may include providing Passenger details to Governments, immigration, port state control, police, flag state and other competent authorities and or as may be required by law. In the case of emergencies, the Passenger consents to MSC Cruises and the Carrier providing personal data to shore side doctors, next of kin, MSC Cruises and Carrier’s insurers and advisors and the Passenger’s medical insurers. Personal Data shall only be kept for as long as is necessary or required by law.

23. Variation

24. smoking policy.

24.1 MSC Cruises respects the needs and desires of all Passengers, and we have considered carefully the subject of those who smoke and those who do not. In compliance with global standards, smoking is freely permitted in dedicated areas throughout the ship and equipped with a special air extraction system. 24.2 In principle, smoking is not permitted in any food service areas (buffets and restaurants, the medical centres, childcare areas, corridors or elevator foyers, areas where Passengers are assembled in groups for safety exercises, disembarkation or tour departures, public toilets, or in bars close to areas where food is served). 24.3 The Carrier highly recommends Passengers avoid smoking in the cabins because of the risk of fire. Smoking on the cabin balconies is not allowed. MSC Cruises reserves the right to levy a fee should Passengers be found smoking in not designated area of the vessel. Repeatedly smoking in non- smoking areas can ultimately lead to disembarkation. 24.4 Smoking is permitted in dedicated areas of at least one bar on each ship, and on one side (indicated by signage) of the principal outer pool deck areas, where ashtrays are provided. 24.5 Throwing cigarette butts over the side of the ship is prohibited.

25. Liability of Employees Servants and Subcontractors

25.1 It is hereby expressly agreed that no servant or agent of MSC Cruises and/or the Carrier, including the Master and crew of the vessel concerned including independent subcontractors and their employees as well as the underwriters of these parties shall in any circumstance whatsoever be under any liability whatsoever beyond these Booking Terms & Conditions and these parties may invoke these Booking Terms & Conditions and the Conditions of Carriage to the same extent as MSC Cruises and/or the Carrier. 25.2 Shore Excursions are operated by independent contractors even if sold by Agents or on board the ship. MSC Cruises shall not be responsible in any way for the services provided by such independent contractors. MSC Cruises operates as mere agent for the Shore Excursion provider. MSC Cruises has no direct control over the Shore Excursion providers and their services hence in no case whatsoever will MSC Cruises be held liable for loss, damages and injuries suffered by the Passenger as a result of the negligence or otherwise of the Shore Excursion providers. MSC Cruises will exercise reasonable skill and care in the selection of a reputable Shore Excursion provider. In assessing performance and/or liability of Shore Excursion providers, local laws and regulations will apply. Shore Excursions shall be subject to the Shore Excursion provider’s terms and conditions including the benefit of any limitation of liability and the level of damages. MSC Cruises’ liability shall never exceed that of the Shore Excursion provider.

Please read these terms and conditions carefully before booking an excursion. For shore excursions that are booked online, please check the appropriate check box confirming that you have read and understood the terms and conditions. Please note that if English is not your first language then it is your responsibility to ensure that you have clearly understood these terms and conditions.

As used herein “MSC”, “us” or “we” means MSC Cruises S.A. , and its or their affiliates, subsidiaries, parents and/or vessels. Shore excursions are provided by third independent contractors. MSC will exercise reasonable skill and care in the selection of a reputable Shore Excursion providers. Shore Excursions purchased or booked through this web site, via Sales Agents or onboard any MSC vessel are organized and operated by independent contractors.

MSC shall not be responsible in any way for the services provided by such independent contractors. MSC does not guarantee the performance or safety of the shore excursions offered nor does MSC guarantee the accuracy of shore excursion descriptions or information shown on this website, and MSC disclaims liability for any inaccuracies relating to the shore excursions offered on this website. MSC undertakes no responsibility for and shall not be liable for the misrepresentations, breaches of contract, breaches of statutory duty, negligence or intentional or accidental conduct of any of the shore excursion providers.

MSC will not be responsible for possible variations to the program due to local holidays and/or closing of the sites to be visited and/or any other event (strikes, demonstrations, mechanical breakdowns, etc.), which could prevent from performing the tour in a complete or partial way. The routing and timing of each tour will be reconfirmed onboard. Every shore excursion/tour requires a minimum number of participants and may have a maximum limit of participants. If the minimum number of passengers required is not achieved the excursion may be cancelled. If the language minimum number of passengers booked for an excursion is not met, the tour may be led by a bilingual guide.

You and all members of your party, by booking a place on any excursion where there is a degree of physical exertion involved, confirm that you and all those others who have booked are in good physical and mental condition, with no history or condition such as seizures, dizziness, fainting, heart condition, respiratory problems or back/neck problems, or any other medical condition of body or mind which could make physical exertion or lack of access to immediate medical care hazardous (these examples are not exclusive) or any other illness, infirmity or condition that would preclude you from participating in any excursions that you have selected. You should also make sure that no one in your party who has booked such an excursion is taking medicine that carries a warning about impairment of physical or mental abilities.

If you are pregnant, certain excursions may not be suitable for you. When booking any excursions, it is your responsibility, including any member of your party that has booked an excursion, to make sure that you are fit and well enough to take part in any excursion booked and to take care of yourself whilst on it.

If you participate in an excursion involving water, you should take care in avoiding alcohol and eating a full meal. Where buoyancy aids are provided for an activity they must be worn at all times. Be aware that the sea is unpredictable. Life guards are not always present and there may not be a flag or other system to indicate whether or not it is safe to go in the water. In addition, beach activities may not be supervised or accompanied so take care to satisfy yourself as to the safety of the beach and/or the sea at the time of your excursion. Children must always be supervised by you at all times whist on an excursion, especially near water.

All such activities are undertaken by you and any member of your party that has booked at your/ their own risk and MSC cannot be held liable for any injury, loss, death or damage whatsoever resulting as a consequence. Before booking any activity excursion it is very important, and your responsibility, that you and any member of your party that has booked an excursion to check that your travel insurance covers the specific type of excursion booked.

You or any member of your booking may be prevented from participating in an excursion (whether pre-booked or not), if it is determined that you or any member of your booking is unsuited to undertake the excursion, or if you or they appear to be under the influence of drugs or alcohol. In the event that you are prevented from undertaking the excursion for any of these reasons then you may not be entitled to any refund of the cost of the excursion booked.

The provider of shore excursions may require participants to sign a liability release and/or assumption of risk form before participating in the excursion. Such releases are particularly common in the case of snorkeling or scuba diving excursions.

By taking part to an excursion guests are accepting and committing to follow the instructions and regulations received by the guide.

If you buy the prepaid shore excursion the full payment must be made at the time of booking by credit card. The shore excursions can be booked, modified or cancelled either up to 2 days before cruise departure either on board*. If you cancel the shore excursion booked before cruise commences, no cancellation fees will be applied, provided that such cancellation is done before the departure date and MSC Cruises is notified in writing of your intention to cancel the reservation of the Shore Excursion.

*On board the excursions can be modified up to 48 hours prior to the commencement of the booked shore excursion. If you want to cancel the shore excursion onboard, no cancellation fees would be applied, provided if the cancellation made 48 hours prior to the commencement of the booked shore excursion. Any refund will automatically be posted to your onboard account . Tours involving flights, trains, special events, overland stays, hotel stay and private arrangements are excluded. Other restrictions may apply.

Before booking your Shore Excursion, please confirm and check the relevant box indicating that you have read and understood these terms and conditions. The booking shall be deemed to be successfully complete only upon full payment.

We will confirm your booking by issuing a confirmation receipt by e-mail. We will communicate with you using the email address you have provided. We will assume that your email address is correct and that you understand the risks associated with using this form of communication.

Once we have received and confirmed your reservation, you the ‘Lead Passenger’ will become contractually liable for the goods and services booked. The Operator may cancel any excursion, should it not reach the minimum number of participants; in this case the reserving passenger will receive a full refund of all money paid for the concerned excursion.

These Terms and Conditions are subject to the Law and Jurisdiction applicable to your cruise Booking Conditions with MSC.

MSC Cruises Drink Packages & Prices (UPDATED)

 On a recent MSC Cruise, I booked an aft balcony with a special rate that included the “Easy Package”. I really had no idea what to expect since I never booked an MSC Cruise with a beverage package in the past.

Upon embarking, I was told by staff how the Easy Package didn’t include much and couldn’t be used at a specialty dining restaurant. With that information, I paid a nominal upgrade on the spot to the “Easy Plus” package to make sure I had more choices and that I could use the package while dining in every restaurant.

So is a drink package on MSC worth it? Let’s find out!

MSC Cruises offers a variety of drink packages for their cruises, including the “Easy” package, “Easy Plus” package, “Premium Extra” package, an Alcohol-Free package for minors, and a Minors package. The packages range in price and offerings, with the Easy Plus package allowing for more choices and access to specialty dining restaurants. Recent changes include gratuity now being included in the pricing. It’s important to understand what each package includes and excludes before making a decision.

Easy Drink Package

The “ Easy Package ” is the most basic alcoholic beverage package on MSC Cruises with a cost of $46 per day per adult and is sometimes offered at no charge as a promotion. (This package is $49 per day on short cruises of less than 6 nights and is even more expensive if purchased onboard)

Liquor choices that go into mixed drinks are generic and sometimes off-brand.

The upside to this beverage package is that it also includes bottled water, soft drinks & juices as well as espresso, coffee cappuccino, and other hot drinks (tea, hot chocolate, etc.) With many cruise lines when purchasing a drink package, they often exclude bottled water and coffee drinks. 

So if you are a heavy coffee drinker and enjoy bottled water with a few beers throughout the day, this is likely your good choice. 

This is the package that was included on my Meraviglia cruise with the base cruise fare. Initially, this seemed like a good option as it covers the basics, but some restrictions were inconvenient enough to make me upgrade to the Premium Plus.

An important exception to the Easy Package!

  You CANNOT use the Easy beverage package in any of the specialty restaurants . So if you want a gin & tonic at dinner, you’re out of luck. Even more bizarre, bringing a beverage to dinner is specifically prohibited forcing you to purchase any drinks regardless of price for the time you are in a specialty restaurant. 

MSC Easy Drink Package Menu & What’s Included

The Easy drink package entitles you to any beverage up to $7.50 ( sort of ). For your convenience, menus throughout the ships have a section specifying what’s included in the easy beverage package. However even though some beer prices by the bottle are $7.50 or less, those are EXCLUDED from this package. Strange, right?

For beer, with the Easy Drink Package, the only option is Heineken Draft or sometimes Miller Light, and the wines are off-label or inexpensive brands only marked as “chardonnay, Sauvignon Blanc, Zinfandel Rose, Cabernet, or Merlot (Plus a random label of sparkling wine or Prosecco). So if you’re not picky, this package may be sufficient.

That really depends. If you drink basic cocktails such as Gin & Tonic, Bloody Mary, Screwdriver , etc, and aren’t picky about the liquor used, the Easy Package may work for you. 

Easy Plus Drink Package

The Easy Plus Package cost is $61 per day , ($64 for shorter cruises of 6 days or less) but you can upgrade from the Easy package for about $23/per day per person

With this beverage package, you can order drinks in specialty dining restaurants as well as anything included in the above Easy package. There are caveats, more on that later.

Any beverages up to $10 are included in this package which gets you all of the beer options, more wine options, and some frozen drink options that aren’t available in the most basic drink package.  There is also a larger range of liquor brands, cordials, and martinis available at this price point.

The Easy Plus Package is the most common drinks package because it includes just about everything that a typical drinker would order. Even better, this package can be used in specialty dining restaurants as well. With recent changes to the beverage packages, the cruise line now allows you to order a drink that is not included in the package and only pay the difference (plus gratuity)

This is what we ultimately upgraded to from our included Easy Package. It was well worth the upgrade not only for the more inclusive offering, but for the simplicity of not having to think about what we were ordering and if it was included.

Premium Extra Package

This drinks package allows you to purchase any beverage up to $16 , however, it comes at a high cost of $85.00 / day per person (this can be as much as $104/day if you are on a short cruise and purchase onboard). You can upgrade from a lower-cost beverage package for the difference in price, i.e. if you have the easy package, for approximately $43/day you can upgrade to this Premium package.  (Note: Prices have changed as of March 1, 2023, and this information reflects the newest pricing)

While this package covers most top-shelf liquor, there are still quite a few wines and drinks that are more than $16, so it’s not as inclusive as other cruise lines’ most premium drink packages.

MSC Premium Extra Drink Menu

Most premium liquors can be purchased with this package including Grey Goose, Aviation Gin, Belvedere, etc. (see the menu below). However, there are still plenty of drinks that are strategically priced above $16, making this package far from all-inclusive. Additionally, most of the champagne and decent wine on board is significantly more than the limit allowed by this package. It’s hard to make sense of this package unless your tastes are squarely within the more premium liquor brands included.

A bonus of these drinks packages is the discounting on bottles of wine (25%), but the reality is good bottles of wine are generally only available at The Butchers Cut Steakhouse, so unless you are dining there regularly, that benefit is minimal.

You ONLY pay the difference in price for a beverage not included in your MSC DRINK package

You can now get a credit towards any drinks not included in your MSC Drink package!. The credit towards a drink is $8 per drink for the Easy Package, $10 per drink for the Easy Plus Package, and $16 per drink for the Premium Extra Package.

For European cruises the credit you get is 7 Euro for the Easy Package, 9 Euro for the Easy Plus and 14 Euro for the Premium Extra package on MSC.

Alcoholic-Free and Minors Package on MSC Cruises

You might be interested in the non-alcoholic package if you’re not a drinker or when traveling with children. This package offers non-alcoholic cocktails, sodas, energy drinks, juices, coffee, tea, and hot chocolate. This package doesn’t apply to specialty restaurants unless it’s for a minor whose group purchased the Easy Plus or Premium Extra alcoholic package. So be prepared to pay for your soda when dining at the Butcher’s Cut, even if you have this package.

These prices will vary if booked on the ship on the day of sailing. Usually by an additional 10% or more. Short sailings are considered anything less than 7 days.

This table of prices is pretty mind-numbing and takes the fun out of figuring out what package is right. Why there are different prices for different lengths of cruise is bizarre and just another way that MSC tends to overcomplicate everything.

In Summary, My experience with the MSC Drink Packages

Originally, I thought the Easy package would be sufficient for our cruise, but discovering the limited beverage options and the fact that you cannot use the package in specialty dining restaurants, we chose to upgrade to the Easy Plus.

Overall this was a good choice, because of the wider variety of options and the ability to use in a specialty restaurant. However, it’s important to know – that when using the Easy Plus in a specialty restaurant like Butcher’s Cut, you must order off of the wine/drink menus in that restaurant!

If your favorite glass of wine isn’t available in the restaurant, you are forbidden to bring anything from an outside bar, which really makes no sense. This is something that they do NOT TELL YOU when upgrading from Easy to Easy Plus on the ship.

Normally this wouldn’t be a big issue except there were very few options on beverage menus that were covered by the Easy Plus package.

On MSc how much doe sit cost if you buy a beer or a soda pop per purchase since i do not drink much alcohol at all and maybe two sodas a day

How do you know if the drink you order is within the 10$ limit on the easy plus package? Do the bartenders tell you? I would hate to get a bill for the extra few dollars if not covered. Thanks!

Hi Robin, They are very good about telling you right away if anything you order isn’t in the package, but the menus are also scattered around everywhere, and you’ll quickly learn what types of drinks are extra. I found that the selection of drinks wasn’t incredibly huge, so I knew fast what they had that I liked, and which were going to cost a little more.

I don’t drink alcohol but would like the occasional soda. Is it possible to purchase just individual drinks without the packages?

Hi Peter, Absolutely! If you take a look at the MSC Drink Menus (here) – on the first menu, flip to the last page. You’ll see the list of sodas and other beverages. It’s definitely not worth a package with the occasional soda.

Hi! Sailing in a couple days. Just want water and maybe a MOCKtail or 2 for a day. I wasn’t clear on how much mineral water is included per day or how to access. No soda, tea or coffee for me. The calculator did not offer the nonalcoholic package so wanted your recommendations- I do need to drink alot of water. Can I bring any sealed bottled water aboard? Is there gratuities on bottled water as well and how big are the bottles? Thanks in advance!

Hi Amy – Good point on the calculator – we’ll fix that and add the non-alcoholic package! At about $28 per day for the non-alcoholic package and a water being about $3.25 + gratuities, You’d end up needing to buy about 7 bottled waters per day to “break even”. (They are the large 17 oz sizes you’d get in a restaurant, so it’s a pretty good value) The non alcoholic cocktails are included as well and are usually about $7 to my recollection, but here’s the menus for MSC Drinks . (the first menu flips through to all the non-alcoholic in the back of the menu) – About bringing water, etc. MSC Is one of the only cruise lines that literally allows no beverages to be brought on the ship. Enjoy your cruise! I hope this helps.

We are looking at doing a cruise with our teens in the spring. We don’t drink alcohol, so is it worth buying a drink package? We would like access to sodas, juices, anything non alcoholic, so wondering if you’d advise to get a drink pkg or not. Thanks!

Hi Diana – Basic tea, coffee, water is included in the fare but soda, specialty coffee and other non-alcoholic beverages aren’t included. There IS an Alcohol free package for $28/day per person +/- which is quite a bit less than the other drink packages. HOWEVER, MSC Often does a promo with the “easy” package or “easy plus” as a perk for a bit of an extra charge. Doing the math, you’ll often find that the little higher rate on a cruise that includes the drink package is far less than buying the package separately. For example, on a 7 day booking I looked and the all included fare was about $37/per person per day more expensive and the drink package was included as well as wifi and onboard credit. More benefits for less money for sure! SO be sure to check that pricing and use our drink calculator for MSC (here) to see if you even drink enough soda/non-alcoholic things to make it worth it.

Your calculator doesn’t take into account that they add a 15% gratuity to each drink, and the package includes the gratuity.

Is there a time limit in between each drink? Like a waiting period of 10/15 minutes?

Hi Sarah – There is not. We would often try a drink of the day or some specialty, hate it, and immediately order something else.

I want to get the easy drinks package but my husband cant drink due to Ill health. Do MSC take this into consideration or will we have to both buy same package.

Hi Karen – Normally with a medical notice from a doctor, the second person doesn’t have to purchase an alcohol package. HOWEVER, MSC rules change… sometimes depending on who you speak to. My experience with this is that they will request you purchase the EASY package for yourself and the NON ALCOHOLIC package for your husband. But it will have to be done by phone, and whether they ask for medical proof will likely depend on who you speak to at the time. I had friends traveling with us that were in your exact situation and they were not asked for proof but were in fact told the non drinking person has to purchase a non-alcoholic package.

Is Redbul available at no additional cost in the easy plus package?

Yes, my recollection is that energy drinks were included with the Easy Plus!

So for my wife who does not drink any alcohol is the minor package the best? Based on the menu the easy plus package covers a variety of beers is that correct vs only Heineken on the easy package.

Hi Jason, they (MSC) will likely require the Alcohol-Free Package as I believe the Minors package is truly teens and below. They’re basically the same thing, you’re just getting penalized for being a grown up 🙂 – That said, the Easy Plus package you are considering does cover all of the beers. There wasn’t a beer served that wasn’t covered by the Easy Plus. And yes, Heineken is the only thing available on the Easy Package. So if you’re a beer drinker, it’s worth looking at the Easy Plus. BUT! Keep in mind, the specials that MSC runs sometimes include the beverage packages and it may be cheaper to go ahead and book with those specials rather than cruise only and adding an Alcohol-Free Package + Easy Plus package. Even if your wife doesn’t take advantage of the alcohol, she can have all of the non-alcoholic beverages she wants and in the end the total price may be less on the promotion. Hope this helps!

If you purchase a non-alcoholic drink package, do you pay the difference for an alcoholic drink or the full price?

Hi Tom – The non alcoholic package won’t work to apply anything towards an alcoholic beverage purchase. However if you have the most basic beverage package (Easy), you can pay the difference for drinks that are more expensive than what is covered by the Easy (this is new for 2023)

What to do if one person drinks and other doesn’t on the same cabin?

Typically everyone of age in the same cabin must have the same drink package. The cruise line will make an exception for medical reasons. Mostly they don’t want one person getting the package and sharing the drinks with their cabin mate 🙁

Thank you for all of this information. It is very hard to navigate all of this from MSC website. I am not a big drinker so I wasn’t sure if the packages were necessary. Your drink calculator is very helpful . If you could answer a question: there are no frozen drinks on the easy drink menu. Does that mean there is no option for frozen margaritas?

Hi Claudia, I’m glad this information helped! We were able to get frozen drinks without a problem, as long as the liquor type was in the basic package. They didn’t distinguish between frozen or on the rocks with things like Margaritas and Daiquiris.

We are sailing to Rome from Durban 20th April and have bought 18 of the 18 unit packages, my question is does a unit mean a short and a mixer, ie, rum and coke or it that 2 units.

Hi Jennifer, we’ve done both Europe & USA cruises on MSC – and in our experience, a rum and coke was in fact a single drink. I know in Europe, it’s common to sell the mixer separate, but that does not seem to be the case on MSC Ships. I hope this helps & enjoy your cruise!

My husband and I are booked to sail from Durban in April on msc Orchestra 25 day cruise to Genoa. Please can you advise if drinks packages are on offer on the ship or if we pay per drink and are soft drinks free? Hi Ann! When you login to your MSC account you should see a way to pre-purchase the packages. If you wait until you get on the ship, they will be about 20% more expensive! We did the “easy” package which covered sodas, specialty coffee, bottled water, and quite a few basic drinks, but upgraded on another trip to the Easy Plus which gets you better beverages and allows you to use the package in the specialty restaurants (which you can’t with the basic Easy package). We put together a handy drink calculator for MSC (See the drink calculator) so you can estimate your budget based on how you normally consume. This will let you know really fast if you’re going to make the drink package worth it! I hope this helps.

Their top package used to include everything but full bottles of wine. Last time on Miraviglia it included everything on the champagne bar menu including $20 drinks. On the Seaside it used to cover the specialty chocolate drinks and gelato. Mildly disappointed. Used to be the best package. Bartenders loved it because they could make the high dollar stuff most people won’t try

I feel your disappointment! When we were on the Meraviglia , the whole drink package was so confusing that even some of the staff weren’t sure what to include or not. I had hoped they’d simplify it, but the new packages with prices were just released, and it’s still a head-scratcher.

Good morning, I am considering booking my first MSC cruise. Reading the cancellation policy, am I correct that the deposit I am paying now is refundable until the 75 day mark?

It also depends on the length of the cruise. 

Most important......actually getting the deposit returned can vary from " quickly " to " still waiting... " whether booked in Yacht Club or not. All of mine have been returned even after the change that made Yacht Club deposits non-refundable... but others have not been so lucky. 

I am still waiting on a cancelled excursion to be refunded but so far that has been the only financial hiccup that I have had with MSC...but others have not been so lucky.

So yes, your deposit is refundable up to 75 days prior to departure if you are booked on a cruise under 4 nights and not in a Yacht Club cabin.
