What visa do I need to work on a yacht?

For this article, I am going to have to be very general about my advice.

When you are a professional yacht crew member, it is an understatement to say that you will be ‘travelling a lot’, whether it be by air, sea or land.

You will find that the one thing that comes up in conversation is what visa do I need for XXX country.

Therefore, to explain the superyacht crew visa topic, without waffling on too much, I will break down the requirements into locations.

Consequently, the three types of visa’s that we will discuss here are:

• Schengen visa
• USA B1/B2 visa
• The Australian superyacht crew visa

For all visa processes and to make the application as easy and as stress-free as possible, make sure your passport is up to date with more than twelve months validity on it.

The Schengen Visa

The Schengen Area consists of 22 European Union (EU) state members and four non-EU members who are, Iceland, Liechtenstein, Norway and Switzerland.

Ireland has also opted out of the Schengen policy, and they operate a separate visa policy.

At the time of writing this, the United Kingdom is battling their way through Brexit, but at this stage, UK citizens may move freely within the EU. Furthermore, the UK also run a separate visa programme.

Nationals of EU countries and Schengen nations are visa-exempt and are allowed to reside, move freely and work in each other’s countries.

For those nations outside of the EU and the Schengen visa agreement, then the following rules apply.

They are the Annexe 1 and Annexe 11.

The list of countries in Annexe I includes Asia, Africa and South America (Western part), Russia and China; this means that South Africans and Filipinos are eligible to apply.

The Annexe II countries include the USA, Canada, New Zealand, and Australia. Annexe II citizens need a visa only if they intend to stay for more than 90 days within 180 days.

Therefore, no visa is required for citizens from Annexe II countries to enter the Schengen area.

Below is a generalised explanation of the Schengen visas for non-EU citizens there are:

• Transit type B visa
• Short-stay type C visa
• Longstay type D visa

The first one is the transit visa, and it is commonly known as the Type B visa. As a yacht crew member, who travels a lot, you may know this visa as an entry or exit visa.

That is to say that this visa is only required if you are passing through a Schengen state for no more than five days.

For example, Transit type B visa is very applicable if your visa has expired and you still need to travel home.

The second type is the short-stay type C visa. This visa is valid for 1 to 5 years. When the visa expires, renewal can be testing.

This visa can not be changed, renewed or extended within the Schengen area. You must leave the  Schengen area and reapply.

The documents needed for this visa are:

• The employment letter
• Crew/work contract
• Port letter and yachts itinerary
• The yachts registration details
• Personal travel insurance

In addition to the above requirements, there is a subsection to this visa referring to the “short” part of the visa name. The short-stay relates to the 90 days in and 90 days out within a 180 day period.

Essentially this means that if the yacht intends to spend the summer months cruising within the Schengen area then, the crew member will have to be stamped out by the shipping agent, rendering the crew member limited to the yachts flagged state.

At the end of the season, the crew member can be stamped back into the Schengen area, meaning that the time spent onboard under the flag state was time sent outside of the EU or Schengen area.

The third type of visa is the Longstay type D visa. The type D visa is the best visa to obtain a because it is renewable within the Schengen area.

The visa can be obtained by presenting the same paperwork are the type C visa.

The USA is a megabase for the superyacht industry.

By its very nature, it draws hundreds of young and aspiring superyacht crew, looking for work and adventure on the high seas.

If you are not a US citizen or hold a green card, then you will need to apply for a B1/B2 visa to work on board a superyacht in US waters.

According to the U.S. State Department website,

“The visitor visa is a type of non-immigrant visa for persons desiring to enter the United States temporarily for business (B-1) or for pleasure, tourism or medical treatment (B-2)”.

This visa must not be confused with the C1/D visa which is a crew visa, broadly used for maritime personnel including a cruise ship and cargo vessels.

Unlike the Australian visa, the USA visa is not a straight forward visa to gain.

US Department of State is particularly interested in your ties with your own country.

You must be prepared to show that you pay taxes elsewhere, rent a home or can prove that you reside somewhere else in the world, which means that you are in no way interested in overstaying your visa or have illegal immigration intentions.

To obtain a B1/B2 visa, you really need to have all of your paperwork in order, including a letter of employment from your yacht.

The letter of employment is not stated on the website, so I guess it’s not technically required, but it sure will help during the interview process.

Next,  you will need to fill out a DS-160 form and make an appointment with your nearest US consulate general or embassy.

Be prepared for some tough and at times, rude questioning.

Other helpful papers, as mentioned above, include phone records, utility bills, bank statements and other documents that show that you reside happily elsewhere.

The Australian  Superyacht Crew Visa

The Australian superyacht crew visa was explicitly created to encourage the growth of the superyacht industry in Australia. Therefore,  it is very straight forward to gain this visa.

You must have a contract to work on a superyacht in Australian waters, and a supporting letter from the owner of the yacht confirming the person’s employment.

Hello Elizabeth, Sorry for the delayed reply, and I hope your daughter has found work already. The B1 visa is a challenge to get without a contract. Therefore I suggest she try to find employment in the Mediterranean sea or Pacific and then try for the yachts that will be travelling in US waters.

I am a US citizen and recently crossed from US to Spain. I was fired once we got to port. I decided to stay and get a seasonal job on another boat. I have had an offer from a Portaguese flagged M/Y. The question is do I need an additional VISA to go with my US passport. The job will go thru Sept/ traveling up around the Netherlands/Greece.

The Temporary Activity visa (subclass 408) allows you to work in Australia as a crew member of a superyacht. You can stay here for up to 12 months. To be eligible for this visa, you must have an employment contract or a letter confirming employment as a crew member on a superyacht in Australia.

To be eligible for the Temporary Activity visa (subclass 408) – Superyacht Crew, you must meet the following requirements:

• Have an employment contract or letter confirming employment as a crew member on a superyacht in Australia
• Have a supporter or sponsor
• Be able to support yourself
• Be 18 years or older
• Meet the health requirement
• Meet the character requirement
• Have adequate health insurance
• Be a genuine temporary entrant
• Have paid back any debt to the Australian government
• Sign the Australian values statement
• Declare that you have not paid for visa sponsorship

Visa Requirements

A superyacht Crew Visa subclass 408 is required for all non-Australia and non- New Zealander crew in advance of their arrival.

• Visa can be requested for 3, 6, or 12 months
• Visas required for longer than 3 months require sponsorship
• Sponsorship must be applied for in prior to lodging individual visas
• Visa extensions require sponsorship and can be lodged whilst crew are still in Australia or overseas
• Visas are multiple entry
• Visa period commences for first date of arrival into Australia

Australian Border Force

All vessels are required by law to give 96 hours’ notice of their intended arrival. Penalties apply for failure to do so.

Vessels need to provide:

• Name of vessel
• Country and port of registration
• Intended first Australian port
• Date and time of arrival
• Last 6 ports of call
• Full details of all crew and passengers onboard
• Details of any illness or disease
• Details of firearms and animals
• Depending on the vessels intentions whilst they are in Australia will depend on whether they are to be imported and operate under a Control Permit. Control Permits can be granted for 12 months, however ABF will discuss this with each vessel at arrival clearance. See following link for more information.

Australian Department of Agriculture

(biosecurity/quarantine).

All vessels are required by law to give 12-96 hours’ notice of their intended arrival. There are strict laws to protect Australian Environment and Citizens. Penalties may be imposed for failure to declare certain items.

You must report if you are carrying:

• Restricted and performance enhancing drugs
• Animal or plant material
• Protected wildlife and products made from them food items i.e. meat products, dairy, eggs, grains etc.
• High risk items must be declared and will be taken and destroyed.

Great Barrier Reef Permits

Regulations ensure use of the Great Barrier Reef Marine Park is sustainable. Rules apply to all commercial and recreational vessels Check if permits are required well in advance. Some areas require specific permits for activities.

Please ensure you have access to:

• Zoning maps, plans of management, waste disposal regulations
• Anchorage locations
• Compulsory pilotage regulations
• Know regulations regarding reef wildlife

Pilotage Requirements

Coastal and Reef Pilotage for the Great Barrier Reef is compulsory for vessels with LOA 70 metres up. Port pilotage requirements are risked based and can vary dependent on the port area being accessed. Please refer to individual port procedures or contact your local port agent.

The owners or masters of yachts cruising Australian waters on control permits will be able to obtain Goods and Services Tax (GST)-free repairs or refits by presenting a copy of their control permits and vessel registration certificate to their repairers/refitters. Your agent can handle this.

Chartering in Australia

The Special Recreational Vessel Act 2019 was passed by the Australian Government to facilitate foreign vessel charter. The licence is valid for a period of 12 months. Additional licences can be applied for prior to the completion of each 12 month period. Please speak to our Superyacht Australia trained and endorsed vessel agents to acquire this. In Cairns they are Carter Marine Agencies, Australian Superyacht Services Qld, Major Yacht Services and Super Yacht Logistics. Australia has the largest domestic fleet of superyachts available for charter in Asia Pacific. The majority of these vessels are based in New South Wales and Queensland, however vessels will regularly conduct charters through Western Australia, Northern Territory, Victoria and Tasmania.

Australia has stringent rules and procedures for the arrival of superyachts in Australian waters.

All superyachts of over 24 metres in length, whether for private use or commercial use, are subject to customs , immigration and biosecurity controls when entering and / or departing Australia.

All vessels must enter through a section 15 port - the closest of which to the Whitsundays is Mackay or Townsville.

A 408 Superyacht Crew Visa is required for all members of the crew with the exception of Australia and New Zealand passport holders. This visa permits the crew to remain and work with their vessel. Superyacht agents in Australia can assist with this and all other legislative requirements for visiting superyachts.

Chartering in Australia

Australia has some of the most spectacular cruising grounds in the world and is the ultimate charter destination waiting to be discovered.

Under a the Superyacht Recreational Vessel Bill introduced in 2019, the Australian Government will introduce a single permit system to provide unrestricted access to coastal movement foreign-flagged vessels for up to 12 months.

The permit protects vessels from importation procedures under the Customs Act 1901, and provides the opportunity for foreign-flagged vessels to charter in Australia without the requirement of an import tax.

Great Barrier Reef Marine Park

The Great Barrier Reef Marine Park Authority has provided a detailed Superyacht Guide to the Whitsundays .

All commercial superyacht operations require a permit to operate within the Marine Park. You can apply for a permit online or for assessment enquiries please contact [email protected]

In addition, it is recommended that all Masters of vessels over 35metres familiarise themselves with the Port Procedure Manual , which outlines the Regional Harbour Masters directions to support safe navigation in relation to the Whitsunday Islands pilotage area. 

2017 marked an important year for vessels over 35metres visiting the Whitsunday region, as the marine park has been opened up for cruising superyachts. As of 2 August 2017, the legislation surrounding the Great Barrier Reef Marine Park zoning for vessels over 35metres has been revised to allow better access for superyachts up to 70m throughout the Whitsunday Islands and the unique marine environment that is the Great Barrier Reef .

After extensive lobbying of state and federal government, the Australian government have officially opened up an additional 21 pristine anchorages in the Whitsunday region for superyachts to enjoy. These anchorages have been provided to allow superyachts recreational users and commercial charter vessels a range of anchorage locations to enjoy in the Great Barrier Reef Marine Park.

Pilot Requirements

When transiting through any part of the Great Barrier Reef and Torres Strait, any vessel with an overall length of 70 metres or more are required to use the services of a licensed coastal pilot in the compulsory coastal pilotage areas.

New Australian Superyacht Visa

The new Australian superyacht work visa is making life easier for foreign flag vessel crew visiting Down Under. Yachting industry group Superyacht Base Australia has been working with the National Marine Safety Committee (NMSC) to formulate a superyacht policy that recognizes international crew qualifications, granting foreign yacht crew temporary work status in Australia. This temporary visa allows crew members to work on board vessels over 24 meters (78'9"), and remain in Australia for up to 12 months. Visa number 488 has replaced the interim visa number 456 since October 2008, and more than 30 crew visas have been processed to date. Lance Cushion, CEO of Superyacht Base Australia (SYBA), says “We have been lobbying with the Australian Federal Government for some time now because the existing visa arrangement was proving a hurdle to opening up the market in Australian waters to visiting yachts wishing to charter here.” In 2007, some 50 superyachts visited the Southern Hemisphere, gracing Australia’s shores and enjoying all that the country and its wonderful cruising grounds have to offer. This new visa system opens the region to the global charter market. The Department of Immigration has been working with crew agents around the country to assist in ironing out any difficulties associated with the paperwork side of the application. “Changes are being made with each issue arising from the process,” says Geoff Majer of Major Yacht Services, an agency headquartered in Sydney. “The paperwork is quite involved and…most captains and crew are finding the current arrangement somewhat busy.” Carrie Carter of Carter Marine Agencies in Cairns comments, “This is a totally new process, and like anything, it will have its grievances.” One excellent feature of the new superyacht visa, however, is that you do not need to make a personal appearance to apply for it. You can download it directly from the Australian Government Department of Immigration and Citizen Website at www.immi.gov.au from anywhere in the world. All the information you need about how the visa works is provided in a systematic guide to track you through. You can nominate a validity period of three, six, or 12 months for each multiple entry crew visa. All applicants must be over 18 years of age, and meet eligibility requirements consisting of a medical check and character references. In addition, all crew need to be sponsored to work in Australia by the owner or captain of the vessel on which they are employed, and the visa is only valid for work on that vessel. There are no application fees for the superyacht crew visa. However, you will need to have the following items in order:

• Signed employment contract
• Letter from owner or captain on company letterhead confirming your employment status
• Evidence of the vessel’s registration
• A copy of the vessel’s insurance certificate or survey papers
• Revision of materials by the Minister for Immigration and Citizenship, Senator Chris Evans

Obligations for applicants and sponsors are set out in detail on their Website: www.immi.gov.au . Should your application for superyacht crew status provide all suitable documentation and your eligibility requirements are satisfactory, expect a wait of two to four weeks from your date of lodgment to receive a reply. 408 Temporary Activity Visa

Subclass 408 is a temporary visa that allows individuals to carry out specific types of work on a short-term basis. This visa does not require nomination, but for applicants who seek to stay longer than 3 months on this visa, the Australian employers need to be approved as temporary activity sponsors. The prescribed types of work include:

• Invited Participation in an event
• Religious Work
• Domestic Work (Executive)
• Superyacht Crew
• Staff Exchange
• “Special Program”
• Entertainment
• Australian Government Endorsed Event

Different criteria apply depending on the types of work to be undertaken. The aforementioned permissible work has been expounded upon hereunder. 

All applicants must maintain adequate health insurance for the duration of their stay and have adequate means of support to fund their Australian travels. 

Domestic Worker for Executives Stream   

This stream is exclusively for persons employed as domestic workers for the residences of senior executives of overseas organisations or foreign government agencies. This is a concession made by the Australian government, as domestic workers are generally not issued temporary residency visas.  

Only experienced domestic workers over the age of 18 are eligible to apply, and the visa can be granted for up to 2 years.

Superyacht Crew Stream   

Applicants may apply for this stream as crew members of a superyacht to stay in Australia for a period up to 12 months. To be eligible, the crew members must be at least 18 years old, and the captain, owner or operator must be a temporary activity sponsor.

A superyacht is defined as a high value luxury sailing ship or motor vessel which is:

• 24 metres or longer in length;
• Not carrying cargo; and
• Used for sport or pleasure.

Research Stream  

The stream is open to:

• Accomplished academics invited to participate in a research project by an Australian tertiary or research institute; and
• Students or recent graduates seeking to undertake a research activity at an Australian tertiary or research institution.

The eligible activities must be aimed at contributing to a research project or undertake research activities at request of an Australian tertiary or research institution.

It is important that the research project is related to the field of the applicant. Furthermore, there can be secondary applicants, and subclass 408 visas can be granted up to 2 years in this stream.

Staff Exchange Stream  

Where a reciprocal staff exchange program is in place between an Australian entity and a foreign entity, the foreign worker may be entitled to apply with his or her family members for a Subclass 408 visa to stay in Australia for up to 2 years. This stream is restricted to full time and skilled positions.

The legislative intention for Subclass 408 visas is to facilitate the exchange program, and is not to act as a substitute for the Subclass 482 Temporary Skill Shortage visa. 

Special Program Stream   

This stream permits applicants to participate in one of the 4 approved special programs:

• School language assistants program, or “SLAP”
• School to school interchange program, or “SSIP”
• Approved cultural exchange program
• Cultural enrichment or community benefit program with an approved organisation or organisations. 

This stream is aimed at activities which provide for cultural exchange or community benefit. The special program stream is not intended for activities primarily aimed at study, workplace-based training or employment, for which subclasses 500 , 407 and 482 are better suited respectively.

Q: What is a School to School Interchange Program?

Generally speaking, SSIP arrangements involve reciprocal arrangements between a school in Australia and an overseas school, whereby each may invite from the other a student, generally one transitioning from secondary school to tertiary education, to act as an assistant at the other institution for up to 12 months. Such arrangements may informally be known as a “gap year” by the participating institution.   

Q:  What is a School Language Assistant Program?

A SLAP permits a young overseas prospective teaching professional to remain in Australia to obtain initial experience in assisting qualified Australian language teachers in language and cultural matters. 

Participants are expected to possess less than a years experience and to merely support a full-time qualified Australian language teacher. 

Much like a SSIP, it is generally anticipated that this program runs for no more than 12 months in duration. 

Application Charges  

Subclass 408 visa application fees are as follows:

• Base application charge: $405
• Additional applicant charge for an applicant who is at least 18: $405
• Additional applicant charge for an applicant who is under 18: $105

It is to be noted that no application fee needs to be paid by persons who are sponsored by certain government and non-profit organisations, or are to participate in particular government-endorsed events, such as the COVID-19 pandemic event. In other instances, a reduced concessional fee applies to persons who are sponsored by specified industry entities.

Visa Conditions

Due to the broad range of instances where the Subclass 408 is appropriate, the specific conditions applicable to each visa will depend on the circumstances of the applicant and the steam under which the visa was applied for. In some cases, these conditions can further vary between applications within the same stream. A summary of these conditions is outlined below. 

In relation to the main applicant, the following must be imposed:

• 8107: Approved employment only.
• 8303: The holder must not become involved in activities disruptive to, or violence threatening harm to, the Australian community or a group within the Australian community.

In relation to the main applicant who are entertainers, the following must be imposed:

• 8109: The holder must not change details of times and places of engagements specified in the application to be undertaken in Australia during the visa period, without the prior permission in writing of the Secretary.

In relation to the main applicant, the following may be imposed:

• 8106: The holder must engage in work in Australia only if the work is relevant to the conduct of the business, or performance of the tasks, specified in the visa application.
• 8114: The holder must not work in Australia otherwise than as a member of the crew of a superyacht.
• 8301: After entry to Australia, the holder must satisfy relevant public interest criteria before the visa ceases.
• 8501: The holder must maintain adequate arrangements for health insurance while the holder is in Australia.
• 8502: The holder of the visa must not enter Australia before the entry to Australia of a person specified in the visa.
• 8503: The holder will not, after entering Australia, be entitled to be granted a substantive visa, other than a protection visa, while the holder remains in Australia.
• 8516: The holder must continue to be a person who would satisfy the primary or secondary criteria, as the case requires, for the grant of the visa.
• 8525: The holder must leave Australia by a specified means of transport on a specified day or within a specified period.
• 8526: The holder must notify the Secretary in writing, not earlier than 7 days before the day the visa ceases to be in effect, and not later than that day, of the holder’s place of residence in Australia by posting the notification to the Central Office of Immigration in the Australian Capital Territory.

In relation to a secondary applicant, the following must be imposed:

• 8502: The holder of the visa must not enter Australia before the entry to Australia of a person specified in the visa
• 8522: The holder must leave Australia not later than the time of departure of the person who has satisfied the primary criteria and of whose family unit the holder is a member.

Entering australia.

Australia has stringent rules, regulations and procedures for the arrival and ongoing operation of superyachts whilst in Australian waters.

Large motor or sailing vessels (superyachts) of over 24 metres in length, whether for private use or commercial recreational or sporting activities, are subject to customs, immigration and biosecurity controls when entering and/or departing Australia.

Superyachts can elect to arrive in Australia at either appointed or non-appointed ports of entry. Refer further below for entry details.

ABOUT IMMIGRATION & QUARANTINE / BIOSECURITY CONTROLS

Australian immigration procedures are undertaken by the Australian Border Force (ABF) who manage the pre-arrival and arrival procedures for vessels entering Australian waters.

Biosecurity checks are managed by the Department of Agriculture and Water Resources.

Option 1: All personal food, plant and animal items will be declared on your Incoming Passenger Card for a private vessel (refer further below).

Option 2: All personal food, plant and animal items will be declared through the Maritime Arrivals Reporting System (MARS) for commercial vessels.

A Biosecurity officer will inspect your galley stores and other biosecurity items to ensure that they do not include prohibited goods or items infested with insects or disease. These could harm Australia’s unique environment or introduce plant, animal or human, pests or diseases. Treatable goods will be treated and returned to you. Prohibited goods will be either confiscated, bonded on the vessel for the duration of your stay, or re-exported at the owner’s expense.

Vessels with an animal subject to biosecurity must remain at a mid-water mooring and keep the animal secure for the duration of your stay in Australia.

If you declare prohibited items, you may be given the option of re-exporting them. If you do not declare items of biosecurity concern, a substantial on-the-spot fine could be imposed, or you could be prosecuted.

Whether you are a returning resident, migrating to Australia or a visitor, you need to comply with the requested entry requirements.

When you arrive in Australia, you must first call at a Port of Entry  (Appointed or Non- Appointed) where Australian Border Force (Immigration) and Department of Agriculture and Water Resources (Biosecurity) checks will be completed.


• Make sure each person on board has a valid visa and passport
• You are required by law to notify the Department before you arrive (refer above to before arrival)
• Clearly display the International ‘Pratique Q-flag’ and travel directly to an appointed or agreed boarding station

On Arrival Option 1:

• If you are arriving at an Appointed Port of Entry as a privately-operated non-commercial vessel, please complete the ‘ Smallcraft Arrival Report’ form available using the link: https://www.abf.gov.au/form-listing/forms/b333.pdf
• Complete the ‘Incoming Passenger Card’ for each crew member is available at: https://www.abf.gov.au/entering-and-leaving-australia/crossing-the-border/at-the-border/incoming-passenger-card-(ipc)

On Arrival Option 2: 

• If you are arriving at a Non-Appointed Port of Entry and / or you are planning to operate as a Special Recreation Vessel (SRV) / Commercial Vessel you will have been sent your arrival requirements through the MTPC approval process described above.

Additional Information for all Arrivals

Australia also has strict laws to protect its citizens and natural environment. Penalties may be imposed if you breach those laws by illegally importing:

• Animal or plant material
• Firearms, weapons or ammunition
• Protected wildlife and products made from them
• Some food items
• Some medicinal products including Performance Enhancing Drugs

Immigration and Biosecurity (Australian Border Force and Department of Agriculture) clearance must be completed before any crew can go ashore.

When you arrive at your planned entry point, please observe the following requirements:

• Stay on board. No persons other than a Biosecurity or Border Force officer is allowed to board your craft, nor can any person, animal or article leave the craft until you have been given full clearance.
• Depending on your arrival time, you may be required to remain on board overnight before being cleared the following day.
• Don’t throw any waste or foodstuffs overboard while you’re in Australian waters or while you are moored. Use designated biosecurity disposal points.
• Keep all food and animals secure until your vessel has been inspected by Biosecurity officers;
• Don’t trade foodstuffs with other overseas vessels.
• Keep your vessel free of insects.

It is an offence to go ashore without prior clearance.   Contact with other vessels in port prior to clearance is also prohibited.
